o U.K. Record Industry Plans to Begin
Suing Music File-Swappers
London -- The British Phonographic Industry (BPI) announced on
Wednesday that it might begin to sue individual Internet
file-sharers in its ongoing battle against online music piracy. "We
want to increase awareness of the legal implications of
file-sharing," said BPI Director General Andrew Yeates. "If these
are not working, there has to be a degree of enforcement." Yeates
also hinted that enforcement wouldn't begin until after the launch
of legitimate services like iTunes in the region later this year,
but said that the BPI was currently negotiating with ISPs across
Europe in order to speed up and improve the process of identifying
the people who distribute the most songs. Yeates also emphasized
that the lawsuits would be filed against serious offenders only.

o U.S. Firms to
Mount Legal Challenge of Canadian Tariff on MP3 Players
San Francisco -- A group of U.S. MP3 player manufacturers and
retailers intends to mount a legal challenge to the recent addition
of a tariff on such products by the Copyright Board of Canada, CNET
News.com reported. The tariff added an extra fee of to the cost of
each player based on its capacity; the fee will be divided among
musicians, songwriters and record labels as a means of compensating
them for copyright infringement. MP3 player makers Apple, Dell and
H-P, along with retailers Wal-Mart and Best Buy will argue the
matter during an appeal of the Copyright Board's decision to be
heard by a Canadian federal court.

o Kodak to End
Sales of Film-Based Cameras in U.S.
Rochester, N.Y. -- In a sure sign that digital photography is
eroding market share from its traditional film-based counterpart,
photography equipment giant Eastman Kodak has announced that it will
cease selling film-based cameras in the U.S., Canada and Western
Europe by the end of the year. The company said it will still
manufacture and sell film cameras in more lucrative emerging markets
such as China, India, Eastern Europe and Latin America.

o Head of
Microsoft Games Publishing Division Resigns
Redmond, Wash. -- Microsoft on Wednesday confirmed that the
corporate vice president of its Games Publishing division, Ed Fries,
has resigned from the company, Reuters reported. Fries is credited
with heading the company's console game software efforts, including
the creation of popular titles like "Halo" and "Flight Simulator."
The unit's Microsoft Game Studios also had its best holiday season
ever, with strong sales for titles such as "Project Gotham Racing 2"
and "Crimson Skies." Robbie Bach, the senior vice president of
Fries' division, told Reuters that he hopes to name a successor
before the Electronic Entertainment Expo industry trade show in May.
Xbox co-creator Seamus Blackley also resigned from the company in

raised $10 million in new equity financing. Investors included
Siemens Mobile Acceleration, GrowthWorks WV Funds, Covington
Capital, Greenstone Venture Partners and a number of the company's

o Second "Screener" Copy of
Oscar-Hopeful Film Found Online
Los Angeles -- The Associated Press reported on Wednesday that a
second "screener" copy of a Hollywood film sent to Academy Awards
voters has been leaked onto the Internet. The Academy of Motion
Picture Arts and Sciences said that a copy of Warner Bros.' "The
Last Samurai" was found available on the Internet, just a day after
Sony reported that a screener for its "Something's Gotta Give"
surfaced online. The Motion Picture Association of America (MPAA)
tried last year to ban distribution of screeners, citing piracy
concerns, but that decision was overturned by a federal court
ruling. While Sony identified the source of its leak as actor Carmen
Caridi ("The Godfather: Part II"), Warner said that it has not yet
determined who received the copy of "Samurai" found online.

4th
Annual
Digital Music Forum
March 1, 2004 | New York City
www.digitalmusicforum.com
OVERVIEW
While unauthorized file sharing and shifts in consumer spending
from CDs to DVDs and video games resulted in a 2.2% decline in
total U.S. music sales in 2003, the roll out of licensed online
services, like iTunes and Napster, which offer a large selection
of licensed content that can be purchased as digital singles,
seems to be having a positive effect on the industry and is
expected to generate $1.8 billion in sales by 2008. Labels are
reinventing themselves and the industry as a whole is
experimenting with emerging technologies that are creating new
opportunities and challenges. Digital Music Forum, now in its 4th
year, brings together decision-makers from labels, record
companies, music publishers, producers and distributors,
technology companies, wireless companies, rights organizations,
industry bodies, radio, advertising, attorneys, artists investors
and venture capitalists to focus on the role of digital
technologies in the future of music.
ABOUT THE PROGRAM
This year's forum focuses on the following questions:
- Is there a viable business model for selling music online?
- Can licensed services compete with free downloads from
file-sharing networks?
- Who will be the winners and the losers in the world of online
music sales?
- What is the status of pending lawsuits and legislation
concerning digital copyrights? Can the music industry profit
from legitimate uses of P2P?
- How are consumers reacting to new formats for music delivery?
- Will new formats generate the kind of success that the industry
experienced with CDs during the '80s and '90s?
- What are the challenges and opportunities for music industry
executives seeking to maximize the potential of the mobile
market?
- What does the future hold for satellite and Internet radio?
