o Judge Orders Verizon to Turn Over Identity of Kazaa User to RIAA

Washington -- A federal judge has ordered Internet service provider
Verizon to turn over the name of one of its subscribers -- an alleged user
of the Kazaa file-sharing service who offered 600 files online -- to the
Recording Industry Association of America (RIAA), which subpoenaed the
information under the Digital Millennium Copyright Act in order to stop
the alleged piracy. Previously, Verizon had petitioned the court to rule
that the request was an invasion of privacy, and instruct the RIAA to make
use of a more burdensome process to find out the user's identity. In a
37-page ruling, U.S. District Judge John Bates ruled that Verizon's
suggestion that the RIAA be required to file a "John Doe" lawsuit to
obtain a subscriber's name in such cases, rather than use the much
speedier subpoena it served Verizon, was "more burdensome and less
timely." "We appreciate the court's decision, which validates our
interpretation of the law," said RIAA president Cary Sherman. "Now that
the court has ordered Verizon to live up to its obligation under the law,
we look forward to contacting the account holder whose identity we were
seeking so we can let them know that what they are doing is illegal."

o Norwegian Prosecutors Appeal Acquittal of DVD-Cracking Code Writer

Oslo, Norway -- Prosecutors in Norway have appealed the acquittal of a
teenager who was charged with creating DeCSS, a computer code that can
crack the security technology on DVD discs. Jon Johansen, who was 15 years
old when he created DeCSS, was acquitted on Jan. 7 of all charges brought
at the behest of the Motion Picture Association of America (MPAA), which
represents Hollywood movie studios. The prosecution appealed the acquittal
on grounds of legal interpretation, evidence and errors it claims were
made in the first trial. "There were some principles for storing and
distributing data on new media that the court should have considered,"
Norwegian prosecutor Rune Floisbonn told the Norwegian news agency NTB.
Johansen's attorney, Halvor Manshaus, said in a statement that, "If the
appeal is granted, this means that there will be full proceedings before
the appeal court on all aspects of the case."

o Canada Outlaws Unauthorized 'Net Retransmissions of U.S. TV Shows

Hull, Quebec -- Canada's version of the Federal Communications Commission
issued a ruling on Friday making it illegal to offer Internet video
retransmissions of TV programming originating in the U.S. to Canadian
Internet users. Several start-ups, including JumpTV, had hatched plans to
take advantage of a "loophole" in Canadian law that would have allowed
them to offer U.S. TV shows to Canadian users without the permission of
U.S. networks, so long as they ensured the retransmissions were only
viewed by Canadian users. In its ruling, the Canadian Radio-Television and
Telecommunications Commission said that, "at present, there is no
completely workable method of ensuring that Internet retransmissions are
geographically contained." The U.S. National Association of Broadcasters
(NAB) lauded the ruling. "We are gratified with the CRTC's conclusion that
Internet retransmission of broadcast signals should not be permitted
without the consent of the broadcaster and its program suppliers. We
regard this decision as a major victory for consumers in the protection of
free, over-the-air television signals and programming," said the NAB, in a
statement.

o Microsoft Introduces CD Copy-Protection Technology

Cannes, France -- Microsoft has introduced new CD and DVD copy-protection
technology that the company says will prohibit users from "burning"
perfect copies of store-bought discs. Developed in conjunction with
Arizona-based technology firm SunnComm, the Windows Media Data Session
Toolkit lets content creators add a "second session" to a CD, so that a
version of the CD's songs -- featuring Microsoft's digital rights
management technology -- may be played back on a PC but not copied onto a
recordable CD. Microsoft said that France-based MPO International Group,
the world's largest independent CD manufacturer, will offer the technology
to record labels using its facilities. Current U.S. releases featuring the
technology include the U.S. version of Sinead O'Connor's "Sean-Nos Nua,"
on Vanguard Records, and an upcoming DVD-ROM from Capitol Records' artists
Fischerspooner.

o Music Companies Offer Sequel to European "Digital Download Day" 

Cannes, France -- Following a trial in October that brought servers down
while U.K. residents downloaded free digital music, a number of music and
technology companies are today offering a broader scope of European
Internet users free tracks, "in a bid to draw their attention to where and
how to download legal digital music." Beginning today, the European
Digital Download Day will offer users in Germany, Spain, Italy, the U.K.
and The Netherlands five euros of free credits, which may be used toward
streaming or downloading digital music. The tracks are being distributed
by U.K.-based OD2 and its retail partners. The International Federation of
the Phonographic Industry (IFPI), an international record label trade
group, gave its endorsement to the program. "IFPI welcomes all new
legitimate music services, and European Digital Download Day is an
excellent showcase for the growing legitimate online music business in

Santa Monica, Calif. -- Game developer Activision announced on Tuesday an
exclusive licensing agreement with film studio DreamWorks SKG to publish
games based on DreamWorks' three upcoming computer-animated feature films:
"Sharkslayer," "Madagascar" and "Over the Hedge." Under the agreement,
Santa Monica, Calif.-based Activision will create PC, console and handheld
games for each film. "Sharkslayer," the first title in the agreement, is
currently scheduled for theatrical release in the fall of 2004.

Tokyo -- Video game developer Sega of America has announced that Peter
Moore, the company's president and chief operating officer, has resigned
his position. Sega said that Tetsu Kayama, president and COO of the
Tokyo-based parent company, will take over for Moore. Meanwhile, Microsoft
on Tuesday announced that it hired Moore as corporate vice president of
retail sales and marketing. In the newly created position, Moore will
oversee retail business in Microsoft's Home and Entertainment Division,
including the Xbox video game console, Xbox and PC games from Microsoft
Game Studios, and home software and hardware products sold at retail, in
Europe and Japan.

Irvine, Calif. -- VitalStream, a provider of webcasting and other digital
media services, announced on Tuesday that it has completed its acquisition
of key assets of Web hosting firm Epoch Networks. Terms call for
VitalStream to offer 12.5 percent of its stock and $200,000 in cash.
Irvine-based VitalStream plans to integrate Epoch's Los Angeles data
center into the company's content delivery network and will enhance the
facility with advanced digital broadcasting capabilities. VitalStream also
announced that Dolphin Equity Partners has invested $1.1 million in the

gaming company, announced on Tuesday its plans to market "a high
performance gaming console and delivery system to provide consumers with
options and capabilities that are not available in today's marketplace,"
which the company says will "outperform the Xbox, Sony PlayStation 2 and
GameCube." Infinium Labs said its console will support games on demand,
game rentals, game demos, seamless upgrades and patch management. The
company plans to unveil a prototype in March and release the console to
