o Report: IFPI Predicts Legit Music
Services Will Flourish Worldwide in 2004 Geneva -- Legitimate
online music services are poised to take a larger share of the
market from peer-to-peer services like Kazaa during 2004, according
to an annual online music report from the International Federation
of the Phonographic Industry. The trade group points to the
impending launch of iTunes, Napster, Rhapsody and other services in
Europe, as well as the 30 existing legal sites operating there now.
Industry data shows that Americans bought 30 million downloads in
2003, while Europeans purchased 3 million. The number of available
songs on European services has risen 30% in the last three months to
300,000, and is expected to increase further this year. The group
also credits increased awareness worldwide that most forms of
file-sharing are illegal, due to the legal campaign against
file-swappers, and the fact that the number of music files available
on the Internet has fallen by 20% to 800 million over the last year,
after peaking at one billion at the start of 2003. "For everyone
working to create a successful legitimate online music business,
this report reflects a new sense of optimism and evidence of real
change," said IFPI chairman and CEO Jay Berman, IFPI. "We believe
the music industry's Internet strategy is now turning the corner,
and that in 2004 there will be, for the first time, a substantial
migration of consumers from unauthorized free services to the
legitimate alternatives that our industry is providing
internationally." Record industry groups in both Canada and the U.K.
have said they soon plan to start suing individual file-swappers in
their respective countries.

Group Drops Trade Secret Suit Against DeCSS Code Publisher
San Francisco -- A DVD industry group that sued California
programmer Andrew Bunner for publishing code that can crack its DVD
movie security has dropped its lawsuit, four years after its
original filing. The DVD Copy Control Association (DVD CCA) sued
Bunner for violating its "trade secret" by publishing a code called
DeCSS, written by another programmer and intended to allow Linux
users to bypass DVD encryption so they could view movies on their
PCs. The code also allows unfettered copying of DVDs. "We're pleased
that the DVD CCA has finally stopped attempting to deny the obvious:
DeCSS is not a secret," said Electronic Frontier Foundation legal
director Cindy Cohn. Attorney Allonn Levy, who argued on Bunner's
behalf, told CNET News.com, "I think they have finally reached the
conclusion that it is not a fight that they can win." Jon Johansen,
the teenaged original author of the DeCSS code, was recently cleared
of any wrongdoing by a Norwegian appeals court.

Asks for Venue Change for RealNetworks' $1 Billion Antitrust Suit
Redmond, Wash. -- Microsoft has asked a federal judge to move the
$1 billion antitrust suit brought by rival RealNetworks, originally
filed in San Jose, Calif., to its home state of Washington.
Microsoft argued that it makes little sense to try a case between
two Washington-based companies in California, but when filing the
suit Real said that is where most of its witnesses reside. It is
also where many of Microsoft's main rivals -- including Oracle and
Sun -- are located. "RealNetworks likely perceives that a jury pool
in that area would be the most unfavorable to Microsoft," company
spokeswoman Stacy Drake told Reuters.

With Revenue Up, Netflix Plans 2-for-1 Stock Split, Move Into U.K.,
Canada
Los Gatos, Calif. -- Online DVD rental service Netflix on Thursday
reported 2003 revenue of $272.2 million, up 78% compared to $152.8
million for fiscal 2002, and said it will effect a 2-for-1 stock
split. Following the upbeat results, the company predicted it will
reach $1 billion in revenue in 2006 or 2007. Netflix also announced
the departure of chief financial officer Barry McCarthy, who will
leave at the end of the year to pursue other opportunities.
Separately, Los Gatos, Calif.-based Netflix said that it plans to
expand its service into the U.K. and Canada by 2005, and that it is
currently working on a system to allow users to download movies over
the Internet, also slated to launch next year.

o British Politicians Criticize
Apple Over iPod Rechargeable Battery London -- A group of British
ministers of parliament (MPs) has criticized Apple over its policy
of supplying replacement rechargeable batteries for its iPod digital
music player. In particular, MPs accuse Apple of not making enough
of the replacement batteries easily available and affordable for
British iPod users. In a statement, the MPs said "iPods were a
favorite Christmas present, with a value of between 250 to 400
pounds ($460-$737), but that when people come to buy replacement
batteries they find that they cost 100 pounds ($184) and that they
have little knowledge of where such batteries can be obtained from."

o U.K. DJ Launches Weekly Radio Show
Downloadable to 3G Phones
London -- DJ Pete Tong is set to become the first person to present
a music program designed especially for 3G mobile phones, the
Guardian reported on Thursday. As soon as the FastTrax show is fully
launched next month, customers of 3 -- to date, the only company
with 3G service in the U.K. -- will be able to download the weekly
show on their handsets, the Guardian reported. FastTrax is the
brainchild of marketing group Slice and Web marketing company
Profero.

(Hollywood) Fandango, a provider of advance online movie ticket
sales, announced on Thursday it has signed a long-term agreement
with Web portal Yahoo to provide online ticketing services through
Yahoo Movies. Yahoo said its movies site garnered 8.5 million unique
visitors in December 2003, according to Nielsen/NetRatings data.
Currently, users will be re-directed to Fandango's website;
one-click purchasing directly through Yahoo is expected to launch in

Blizzard Entertainment and Naughty Dog announced on Thursday the
formation of their own independent game development firm, Ready At
Dawn Studios. Didier Malenfant, Andrea Pessino and Ru Weerasuriya
have been involved in development of games including "Crash Team
Racing," "Jak&Daxter: The Precursor Legacy," and the "Diablo," "Warcraft"
and "Starcraft" franchises. The company said it is working on its
first title and actively recruiting developers.

that it will release a string of mix compilations as downloadable
playlists through Apple's iTunes Store and Canada's Puretunes
service. After releasing a successful Christmas-themed compilation

label will follow with a Valentine's mix featuring artists including
Sarah McLachlan, BT and Ron Sexsmith. A Halloween compilation is

(London) NewScientist.com on Thursday reported on the potential
for academic research within immersive online multiplayer games like
"EverQuest" and "The Sims Online," as a unique new way to study
social, economic and legal phenomena. The Themis Group predicts such
games will generate over $1 billion in earnings during 2004, $200
million of which will be generated by such features as sales of
player accounts and virtual possessions, and in-game advertising.
"They are a sort of parallel universe for creating socio-legal
systems from scratch. And so long as you have a porous border
between games and the real world your going to have a lot of cross
over," New York Law School's Richard Sherwin told NewScientist.com.
