o Google Denies Napster Buyout
Rumor
New York - Google has denied a report published yesterday
in the New York Post that it is in talks with Napster about an
exclusive alliance or acquisition of the digital music service, the
Associated Press reported on Wednesday. The company told AP in a
statement that it has "no plans to acquire Napster" or "develop a
music store at this time." Napster declined comment for the AP
story. Google recently launched an online video store, and also
began offering a version of its search engine tailored specifically
for music-related searches, prompting speculation the company may
enter the digital music market.

o Take-Two
SEC Filing Reveals Potential Lawsuits, Acquisition Costs
New York - A recent SEC filing reveals that, in addition
to lawsuits filed against the company by the FTC, Los Angeles City
Attorney's office, and families of slain police officers, "Grand
Theft Auto" video game publisher Take-Two Interactive also faces
lawsuits filed in Pennsylvania, Illinois and New York. The company
has seen its shares tumble recently, both as a result of alleged
accounting irregularities and the lawsuits related to a hidden
sexual mini-game and the degree of violence in its "Grand Theft
Auto" games. The attorney generals of North Carolina and
Connecticut, as well as the Delaware Chancery Court, have also
requested documents related to "Grand Theft Auto: San Andreas." The
SEC filing also showed that the company spent over $70 million on
acquisitions in 2005, picking up developers Visual Concepts and Kush
Games ($32 million), Firaxis ($27 million) and Gaia Capital Group
($11 million). The company also purchased Irrational Games for $10
million in January.

o Remaining
Free File-Sharing Networks Negotiating with Labels
San Francisco -- File-sharing network operators such as
eDonkey, LimeWire and BearShare are nearing a time when they will
likely either shut down or switch to legitimate paid services in
order to avoid record industry litigation, CNET News.com reported on
Wednesday. Many peer-to-peer companies were sent cease-and-desist
letters by the record labels in the wake of last summer's landmark
Supreme Court ruling on file-sharing, and while some, like Grokster,
WinMX and i2Hub have shut down, others like iMesh have gone legit
and still others continue to negotiate with the labels. "I honestly
had expected everything to move more quickly," Sam Yagan, the chief
executive of eDonkey parent MetaMachine, told News.com. "We look
forward to a settlement (with the record industry) very soon. It's
not months away, that's for sure." When the iMesh service converted
to paid subscriptions, the company also agreed to pay $4 million in
to the record labels to account for alleged losses from its free
service. Yagan hopes eDonkey's average of 3.5 million simultaneous
daily users will be attractive to the labels and other file-sharing
providers alike. "If you compare us shutting down versus us
converting, there's a heck of lot more value in us converting versus
scattering those users," Yagan said.

o DISH Network
Joins Firms Providing "Family-Friendly" Channel Tiers
Englewood, Colo. - Following the lead of rival DirecTV and
cable companies Comcast, Time Warner Cable and Cox, EchoStar
Communications, operator of the DISH Network satellite TV service,
on Wednesday announced a new "family-friendly" programming tier. The
"DishFAMILY" service will offer 40 channels -- including Animal
Planet, Nickelodeon, Food Network, CNN, Fox News and Trinity
Broadcasting Network -- for $19.95 per month. The family-friendly
service offerings come after some in Congress have pressed cable and
satellite companies to offer a la carte programming, in part so that
parents and others may choose not to subscribe to channels they feel
offer inappropriate programming.
