o AOL Forges High-Speed
Partnership with Charter
Dulles, Va. - Days after announcing several partnerships
with several other providers, America Online on Thursday said that
it has teamed with St. Louis-based Charter Communications to bundle
AOL's service with Charter's high-speed Internet access. Beginning
Feb. 6, AOL members in Charter's territory will be able to sign up
for the new combined offering, which will cost $25.90 a month. Last
week, AOL also announced similar alliances with BellSouth, Time
Warner Cable and Verizon. AOL said that it plans to launch a
nationwide ad campaign encouraging members to upgrade from dial-up
to broadband. Over the past few years, AOL has lost several million
dial-up subscribers to either broadband providers or less expensive
dial-up firms.

o Court Date
Postponed for Google Defense of Government Search Subpoena
San Jose, Calif. - The federal judge appointed to hear
Google's defense of its refusal to turn over search results to the
U.S. Justice Department has been postponed, from Feb. 27 until March
13. The Justice Department has sought records of search engine
results from users of AOL, Yahoo and Microsoft as well, but only
Google refused to provide the data the government hopes to use in
defense of a law meant to protect minors from online pornography. As
a result of the subpoenas, Rep. Ed Markey (D-Mass.), said he plans
to introduce a bill that would restrict the keeping of users' search
records and other data by websites, CNET News.com reported.

o Copyright
Office Recommends New Legislation for "Orphan Works"
Washington - The U.S. Copyright Office said on Friday that
it has delivered its report on orphan works -- copyrighted works
whose owners are difficult or impossible to locate for licensing and
royalty payment issues -- to Congress this week. The Copyright
Office said its report proposes solutions and recommends statutory
language for new legislation that would address orphan works. Under
the proposal, if parties looking to utilize copyrighted works make a
"reasonably diligent search" to find the owner, they may then make
use of the works, and copyright owners are then limited in their
rights to make claims once the derivative work is published.

o SunnComm to
Submit CD Copy-Protection Software for Security Testing
San Francisco - SunnComm Technologies, a developer of CD
copy-protection software that was found to open computers to
security risks, has agreed to address problems with the software and
comply with requests for independent security reviews from the
Electronic Frontier Foundation (EFF), a digital civil liberties
group. SunnComm said that future versions of its MediaMax software
will not install when a user declines the license agreement that
appears when a CD is first inserted into a computer, and also
provide uninstallers in all versions of MediaMax. The company will
also submit all future versions of its copy-protection software to
an independent security-testing firm, and make the results public;
it has also promised not to prosecute legitimate security
researchers for violations of the Digital Millennium Copyright Act.
"While we continue to disagree with SunnComm on the wisdom of CD
copy protection in general, we are pleased that it has taken
important steps to notify consumers of the security vulnerability
and help resolve the security and privacy issues raised by the
MediaMax software," said EFF staff attorney Kurt Opsahl.
