o AOL Loses More Subscribers, Posts Better Earnings

Dulles, Va. -- Despite losing another 464,000 subscribers during the quarter, America Online posted slightly brighter results in the most recent quarter, the company announced on Friday. The unit's revenue rose 1% to $2.2 billion and its operating income climbed 8% to $326 million, though the latter was due in part to restructuring charges that were $30 million less than a year ago. As of December 31, the AOL service had 22.2 million U.S. subscribers, down 2 million from the year before. Time Warner also said that it is close to wrapping up its settlement with the Securities and Exchange Commission regarding its investigation into accounting fraud at AOL. Time Warner already has settled with the Department of Justice over similar issues.

o France Fines Song-Swapper $13,000 in First Criminal P2P Conviction

Paris -- France has convicted its first citizen of criminal copyright infringement via peer-to-peer file-swapping, French newspaper Le Monde reported. Twenty-eight year-old Alain Oddoz was initially arrested in August 2004 by French authorities, on charges he was sharing 30GB of music through a site called France Barter. On Thursday, he was convicted and fined $13,300, had his computer equipment confiscated, and was ordered to take out several ads in newspapers to publicize his deed and what the consequences were. The major record labels expanded their legal campaign against individual file-swappers to Europe late last year, when nearly 500 were sued in the U.K. and France. The Recording Industry Association of America (RIAA), which represents the labels, has now sued over 7,000 file-swappers in the U.S. alone.

o Report: Kazaa Employees "Hate" Installing Kazaa on Their Own Computers

Sydney -- Employees at Sharman Networks, distributors of the Kazaa file-sharing application, "hate" to install Kazaa on their own computers because of how slow it makes them run, the company's chief technology officer wrote in document recently released in court, ZDNet Australia reported. The document came to light -- against pleas from the company -- during the major record labels' Australian copyright infringement case against Sharman Networks, which seeks to shut the company down. The comment, from Kazaa CTO Phil Morle, referred more to the adware that is bundled with Kazaa, which "slows down users' machines and can affect other activity such as browsing the Internet… Consider how many people that work for Sharman Networks and its partners that hate installing Kazaa on their machine," Morle wrote. The document also revealed that Sharman was aware of the potential legal backlash from its product. "Our competitors are taking risks legally, but delivering compelling consumer solutions. We need confidence in what we do and must take similar leaps of faith. eDonkey is not yet being sued and is in a strong position to out-innovate us," Morle wrote.

o Yahoo Launches Test of Y!Q Contextual Search Tool

Sunnyvale, Calif. -- Yahoo this week launched a test of a new "contextual" search feature, which lets users highlight text within a given Web page and derive search results based on those words -- instead of typing queries into a separate search engine. Yahoo is offering the Y!Q feature on its own news sites and as a downloadable toolbar, in addition to providing developers tools to incorporate the contextual search tool into their websites.

o Mobile Entertainment Firm Dwango Raises $15 Million in Private Placement

Seattle -- Dwango North America, a publisher of mobile entertainment content, announced that it has raised $15 million through a private placement of its shares with four investor groups. Seattle-based Dwango Wireless has created ringtones, games and mobile phone applications for Napster, Playboy and Rolling Stone. "This financing allows us to continue the strong growth we are experiencing and to enhance our presence in the mobile arena. We see significant opportunities to develop and acquire additional content as well as to expand our distribution channels," said Dwango Wireless CEO Rick Hennessey.

o Study Finds Spam Costs Consumers $22 Billion a Year

College Park, Md. -- Unwanted "spam" e-mail costs U.S. consumers $21.58 billion a year in lost productivity, according to a new study by the University of Maryland's Robert H. Smith School of Business and technology research firm Rockbridge Associates. The data indicates that adult consumers spent an average of three minutes deleting spam each day they checked e-mail in 2004. The study's authors reached their dollar figure by multiplying that by the 169.4 million online adults in the U.S., then figuring the worth of 22.9 million lost hours a week based on the average working wage. "We all know that spam is a nuisance, but this allows us to assign a real value to what it is costing U.S. society," said Roland Rust, director of the Smith School's Center for Excellence in Service. "This should serve as a loud wake up call to government and business," said Charles Colby, the president of Rockbridge Associates. The study also found that four out of five adults receive spam on a daily basis, with 14% actually reading the e-mails. About 4% admitted to purchasing a product or service advertised in spam over the past 12 months.

(Dallas) Video rental giant Blockbuster said on Friday that it plans to launch the first national ad campaign for its online DVD rental service on Super Bowl Sunday. Blockbuster's $14.99 per month service, along with a rumored online DVD rental offering from Amazon.com, are seen as major rivals to Netflix, which originated the market and offers online DVD rentals for $17.99 per month.

(London) The BBC announced that it plans to deliver live streaming of rugby matches played in the upcoming Six Nations tournament, allowing broadband subscribers in the U.K. the opportunity to watch entire games on the BBC's website. Matches can also be seen on the official website of the Six Nations tournament, but overseas visitors to either website will only be able to view highlights, the BBC said. The BBC said it is making the games available in order to test-run its broadband streaming technology, much as it did last year during the Olympic summer games in Greece.

(New York) The New York Times recently reported on some clever adaptations that tinkerers have come up with for the metal boxes that the Altoids brand of "curiously strong" mints are sold in, including one that was fashioned into an MP3 player. The tins have also historically been used in short wave radios, because of their ability to block electromagnetic interference. Other uses that emerged from a contest staged by ReadyMade magazine included an Altoids tin iPod battery pack, and a pair of tins that were transformed into portable iPod speakers.
