o French Court: Google Breached Louis
Vuitton Trademark Rights
Paris -- The Parisian District Court has ruled that U.S.-based
search engine firm Google's practice of selling brand-name triggered
advertising infringed on the trademark of Louis Vuitton. Google
makes around 98% of its money by selling so-called "keyword-linked"
advertising. Charged with trademark counterfeiting, unfair
competition and misleading advertising, Google must now pay the
French luxury goods firm $250,000, the court said. Google must also
stop displaying ads for Vuitton's competitors whenever Internet
users type the company's name into the search engine. Google said it
was still considering whether or not to appeal the ruling. "We're
studying the ruling," said Google spokesperson Myriam Boublil. "No
decision's been taken yet on an appeal." Only a month ago, Google
lost a similar case with Le Meridian Hotels, in which the search
engine firm was fined $2,550 and ordered to pay costs.

Mistakenly Sues Deceased Elderly Woman for Illegal Song-Swapping
Charleston, W. Va. -- An 83-year-old, deceased West Virginia
woman is among the individuals recently sued by the Recording
Industry Association of America (RIAA) for illegally offering songs
for download on the Internet, the Associated Press reported. Robin
Chianumba told AP that her elderly mother, Gertrude Walton, who
passed away in December, actually hated computers. "My mother
wouldn't know how to turn on a computer," Chainumba told AP. "I am
pretty sure she is not going to leave Greenwood Memorial Park (where
she is buried) to attend the hearing." Chianumba added that she sent
the RIAA a faxed copy of her mother's death certificate several days
before the lawsuit was filed, in response to a letter from the RIAA
notifying her of the impending lawsuit. "Our evidence gathering and
our subsequent legal actions all were initiated weeks and even
months ago," RIAA spokesman Jonathan Lamy told AP. "We will now, of
course, obviously dismiss this case."

Microsoft Options Movie Rights for "Halo" Video Game
Los Angeles -- Microsoft has licensed the rights to create a
feature-length film based on its "Halo" Xbox video game franchise to
author Alex Garland ("The Beach," "28 Days Later"), Variety magazine
reported. The multi-million dollar deal will reportedly combine the
two iterations of the "Halo" franchise into a single film. The link
between video games and movies is becoming increasingly pronounced
in Hollywood, with a growing number of video games being made into
films ("Tomb Raider," "Resident Evil"), and games based on movies
figuring as a key element of film merchandising. Microsoft touted
the recent release of "Halo 2" as having outsold the top-grossing
film of all time. "Halo 2" made $125 million on its first day of
sales, and has since sold over 6.4 million copies, while in
comparison, the record-setting opening weekend for "Spider-Man 2"
grossed $115 million in box office sales.

2004 Online Holiday Shopping Rose 22% to $22.1 Billion
New York -- U.S. consumers spent $22.1 billion shopping online
during the 2004 holiday period, a 22% increase over the 2003 period,
according to a report from market research firm JupiterResearch. An
influx of 17.7 million new online holiday shoppers largely fueled
the increase. "Not only were millions of people shopping online for
the first time, but three-quarters of consumers bought from a site
they had never purchased from before," said JupiterResearch retail
analyst Patti Freeman Evans. A report from Nielsen/NetRatings
similarly found that U.S. consumers spent about $23.2 billion
shopping online during the holidays. Jupiter predicts that 2005
total online retail sales will surpass $79 billion, up from $66
billion in 2004.

Xfire Over Patent on Gamer Chat Application
Sunnyvale, Calif. -- Web portal Yahoo has sued video game
technology developer Xfire for patent infringement of technology
that allows gamers to instant message one another and connect for
online gameplay, GameSpot.com reported. The patent for Yahoo's
GameProwler application was granted to Yahoo employees Brian
Gottlieb and Chris Kirmse in March 2004; Kirmse now serves as
Xfire's vice president of engineering. Menlo Park, Calif.-based
Xfire says it now counts 1 million registered users for its gamer
chat application, for which it is also currently seeking a patent.
Yahoo is seeking an injunction against the distribution of Xfire's
product, as well as unspecified damages.

Phone Use Booms in EU over Last Decade
Brussels -- According to a new report by Eurostat, the EU
statistical office, there were about 80 mobile phone subscriptions
for every 100 inhabitants of the EU in 2003. The report found that
cell phone use in general has experienced enormous growth since
1995. Between then and 2003, the number of mobile telephone
subscriptions increased by about 42% each year, Eurostat said. In
2003, there were more than 364 million subscriptions in the EU,
compared with just 22 million in 1995, when there were only five
mobile subscriptions per 100 inhabitants. Luxembourg (120 per 100
inhabitants), Sweden (98), Italy (96) and the Czech Republic (95)
recorded the highest numbers of mobile phone subscriptions per 100
inhabitants, while the lowest numbers were recorded in Poland (46),
Latvia (52) and Lithuania (62).

(San Francisco) Disney's Buena Vista Home Entertainment has
ceased distributing movies on a new disposable DVD format that made
the discs unplayable 48 hours after being removed from their
packages, Wired News reported on Monday. The EZ-D, developed by
Flexplay Technologies, was criticized by environmental groups as
wasteful, and by consumers, who have largely balked at paying $7 for
a movie that self-destructs. Convex Group, which acquired Flexplay,
said it still plans several EZ-D releases this year, and is working
to develop a way to include permanent content -- like a game or
music video -- so that consumers will want to keep the discs once
the movie content expires.

delivery and billing technology, announced on Friday that Yahoo
Europe has selected it to be its European mobile content delivery

(Palaiseau, France) French chipmaker DiBcom announced on Monday
that it has developed what it says is the first chip capable of
receiving both Digital Video Broadcasting - Handheld (DVB-H) and
Digital Video Broadcasting - Terrestrial (DVB-T) signals. The DVB-H
mobile TV standard is expected to be deployed in Europe in 2006, and
as early as 2005 in the United States. DiBcom said its new chips are
capable of receiving mobile TV signals at speeds exceeding 100 mph,
and will be integrated into cell phones and other portable devices
beginning in March.

on Monday that the highest replayed moment during last night's Super
Bowl broadcast among TiVo owners was not during the game or a
commercial, but when a phone number was displayed that prompted
viewers to cast votes for the game's MVP. TiVo said the
most-replayed commercial was one from GoDaddy.com that spoofed the
"wardrobe malfunction" that figured as the most-replayed moment from
last year's broadcast, while adding that this year's halftime show
actually retained 5% more TiVo viewers than did last year's infamous
MTV-produced halftime show.

The Director will lead a team of people who deliver many key
aspects of our ZoomPanel product. ZoomPanel is a MarketTools
proprietary online panel community. Require: 3-5 years Direct
Marketing background. Internet marketing, consumer promotions
or marketing research experience preferred. Some classical
brand management experience at major packaged goods companies
preferred. Creative problem solving skills a must.
International business experience and foreign language skills
a plus. Strong communication skills, oral and written,
required. Must have the ability to handle multiple projects
simultaneously. Bachelors degree required, MBA strongly
