o Japanese Video Game Maker Tecmo
Sues Alleged U.S. Game Hackers
Torarnce, Calif. -- Japanese video game publisher Tecmo announced
on Wednesday that it has filed suit in a Chicago federal court
against a number of alleged hackers, who the company says violated
Tecmo copyrights by breaking the security to change the code in
games like "Ninja Gaiden" and "Dead or Alive." In the past, Tecmo
has sued several programmers for creating hacks of its "Xtreme Beach
Volleyball" game that removed the bikinis worn by the game's female
athletes. Defendants named in the current suit include Mike Greiling,
of Eden Prairie, Minn. and Will Glynn, of Davie, Fla. -- along with
a number of unidentified individuals -- who are accused of "hosting
and contributing content to a forum created to foster and facilitate
the knowing infringement of Tecmo's proprietary software." Tecmo
said the defendants committed copyright infringement and violated a
provision of the Digital Millennium Copyright Act that prohibits
circumventing copyright protection systems. "Hacking of this kind
will not be tolerated and we intend to take all necessary measures
to protect our intellectual property," said Tecmo general manager
Hohn Inada. "Ignoring the situation will ultimately hurt future
gaming experiences for both casual and hardcore gamers." Tecmo is
seeking an injunction against the alleged hackers, as well as
damages for willful copyright infringement.

Appeals Court Upholds Ban on iPod Levy
Ottawa, Canada -- The Canadian Federal Court of Appeal has upheld
a lower court's ruling that outlawed a levy on the sale of hard
drive-based digital audio recorders, like Apple's iPod, that would
have compensated artists and copyright holders for implied lost
sales from piracy enabled by the devices. The court did, however,
rule that Canada's existing levies on the sale of blank recordable
media -- like cassettes and CD-Rs -- were constitutionally valid.
The country's copyright regulators tried to extend this idea by
imposing a levy of $15 on MP3 players with up to 10GB of memory, and
$25 on players with greater than 10GB capacities, which the courts
have tossed out. Canada's courts have also previously ruled that
downloading music from peer-to-peer file-sharing services like Kazaa
and BitTorrent is legal in the country, while uploading music to
such networks is not.

Reveals Talks With Apple on Adding Satellite Radio to iPods
New York -- Sirius Satellite Radio, a provider of
satellite-delivered digital radio programming, said on Wednesday
that it has had discussions with Apple about including the satellite
radio service on Apple's iPod music players, Reuters reported. Apple
CEO Steve Jobs "did not see the need at this point to combine the
functions," a Sirius spokesman told Reuters. The discussions were
announced on Wednesday by Sirius CEO Mel Karmazin at a media summit
in New York.

Robertson Launches New Digital Music Store, MP3tunes
San Diego -- MP3tunes, a new digital rights management-free
online music store started by MP3.com founder Michael Robertson, on
Wednesday announced its official launch. The service will initially
offer 300,000 songs from more than 20,000 independent artists in an
unrestricted 192k MP3 format, for $0.88 per track and $8.88 per
album. Once purchased, songs will also be stored permanently in a
"music locker," accessible to users from any Internet-connected
device with a Web browser. The site also offers charts, artist
features, user reviews and recommendations. "A consumer-friendly
digital music store that provides true music ownership to paying
customers can triple the digital music business almost overnight,"
said Robertson. "MP3tunes gives the consumers more value because
they can use the music on all their computers and MP3 players --
whatever brand they may have." Robertson founded MP3.com in 1997 and
grew its offering to over 1 million songs, before selling the
company to Vivendi Universal in 2001 for $372 million.

Government Offers Timetable for Digital TV Switchover
London -- According to a report published by U.K. communications
regulator Ofcom on Wednesday, the government's goal of switching the
country to digital TV by the end of 2012 is possible only if carried
out on a region-by-region basis. Ofcom said the switchover would
need to start in 2008 to meet the current target date of 2012,
meaning that TV viewers in Wales and the Border and West country
could have their analog TV signals switched off in just four years.
Which? magazine has criticized the timetable, saying it could force
many consumers pay as much as over $500 to make the switch against
their will. For its part, the government has emphasized that no
decision will be made on the timetable until consumers' interests
are protected. Currently, more than half of households in the U.K.
(about 60%) have a digital TV service with BSkyB, NTL, Telewest or
Freeview.

U.S. Ringtone Retail Sales to Surpass $500 Million
New York -- Performing rights organization BMI, which represents
more than 300,000 songwriters, predicts that retail sales of cell
phone ringtones in the U.S. this year will surpass $500 million, up
from $245 million in 2004 and $68 million in 2003. The organization,
which has processed over 150 million ringtone sales since entering
the market in 2001, said it based its projection on census-based
sales data aggregated from 225 mobile entertainment retailers. "We
see the growth trend in ringtones and mobile entertainment
continuing through mid 2006," said Richard Conlon, BMI vice
president of business development. "We believe that the market will
double for the ringtone sector alone. Any revenues derived from the
ringback-tone services and mobile subscription music services, which
have just begun to roll out in the U.S., will be incremental."

LAUNCH Brand for Online Music Services
Santa Monica, Calif. -- Yahoo announced on Wednesday that it has
rebranded its music destination, LAUNCH, which will now be known as
Yahoo Music. Yahoo purchased LAUNCH, an early provider of online
music videos and Web radio channels, in 2001 for $12 million. Since
then, the company has acquired other music firms, including media
player developer Musicmatch in September for $160 million, in a bid
to develop its online music offerings to compete with services from
Apple, Napster, RealNetworks, Microsoft and others. "The Yahoo Music
brand will allow for deeper integration across the Yahoo network as
we continue to develop new initiatives to expand our music services
for consumers around the world," said Yahoo Music vice president and
general manager Dave Goldberg. Yahoo added that it will rebrand its
LAUNCH sites in Europe, Australia and Latin America in the coming
months.

Brisbane, Calif. -- IGN Entertainment, a provider of video game news
and information, announced on Wednesday that it has acquired 3D
Games, a provider of gaming news and file downloads. Financial terms
of the deal were not disclosed. Launched in 1996, 3D Gamers offers
game news and downloads of official and third-party demos, patches,
screenshots and movies to an audience that reached 2 million in
November 2004. "Having FilePlanet, Direct2Drive and 3D Gamers in our
portfolio solidifies our ability to offer game publishers an
incredible opportunity to reach the largest and most active audience
of game file downloaders," said IGN Entertainment CEO Mark Jung. IGN

Nokia Expand Mobile Media Delivery Partnership
Seattle -- Media delivery technology provider RealNetworks and cell
phone maker Nokia announced on Wednesday that they have expanded
their agreement to extend the availability of audio and video on
mobile devices. Under the agreement, Nokia will license RealAudio,
RealVideo and the RealPlayer for inclusion on mobile devices, and
also join RealNetworks' Helix Community of developers. To date,
Nokia has shipped 20 handsets that feature the RealPlayer as the
default method of playing audio and video content. Separately,
Seattle-based RealNetworks announced the release of a new mobile
licensing program and Technology Compatibility Kit for its media
technologies, designed to let handset manufacturers integrate
RealAudio and RealVideo support into their cell phones.
