o Report: Nearly Half of U.S. Music
Downloaders Have Paid for Songs
New York -- The popularity of fee-based digital music stores is
on the rise, as nearly half (47%) of American music downloaders
surveyed in December said they have paid to download a song, roughly
double the 22% who said so a year earlier, according to a report
from market research firm Ipsos-Insight. "While fiercely competitive
online music services and download stores undertake high-profile
efforts to attract consumers to their respective sites and business
models, it is clear from these data that consumers are increasingly
experimenting with legitimate online methods of music acquisition,"
said Ipsos-Insight vice president Matt Kleinschmit. The report also
found that, for the first time, an equal proportion of the overall
U.S. population (11%) engaged in both fee-based downloading and
file-sharing. "This is significant both functionally and
symbolically, as operators of fee-based digital music websites are
finally seeing American downloaders embrace their services, and the
broader industry can now see empirical evidence that fee-based
online content can survive and even flourish while non-licensed
content remains available," said Kleinschmit. The firm said the
percentage of Americans who said they have downloaded songs off
peer-to-peer networks has fallen from the 13% who said they had done
so in 2003, and 19% who reported having done so in 2002.

Investigating Internet Leaks of Academy Award "Screener" DVDs
Los Angeles -- The FBI is investigating the appearance of several
"screener" copies of Academy Award-nominated films -- including all
five up for Best Picture -- on Internet file-sharing systems, the
Los Angeles Times reported on Thursday. Screener DVDs are sent to
voting members of the Academy so they may view all of the films up
for awards. Last year, in a highly publicized case one member was
tossed from the Academy and ordered to pay $600,000 in damages to
several studios after being identified as the recipient of several
screeners leaked online. The FBI told the Times it is looking into
the leaking of Warner Bros.' "Million Dollar Baby" and Sony
Pictures' "Spanglish" and "Closer." "We take this criminal activity
very seriously," Louis J. Caprino Jr., acting special agent in
charge of the criminal division of the Los Angeles FBI office, told
the Times. The number of pirated screeners is up dramatically from
last year, a fact some blamed on the studios' lack of a unified
anti-piracy solution. Last year, all DVD screeners featured digital
watermarks that could trace a leak back to their recipient, and were
accompanied by a pledge that recipients were required to sign saying
they wouldn't share their copies with anyone.

Close Game Studios in California, Massachusetts
New York -- Video game publisher Atari on Thursday announced it
will shut its development studios in Santa Monica, Calif. and
Beverly, Mass. as part of a restructuring plan, which, combined with
news of a projected shortfall for the current quarter, sent shares
of the company down 7% in the day's trading. "We've begun taking
aggressive steps to address structural, operational and financial
issues which we anticipate will better position the company," said
Atari president and CEO Jim Caparro. Operations at the two shuttered
studios will be taken up by the company's New York headquarters.
Atari blamed its financial shortcomings on console game system
shortages and stiff competition that affected sales during the
recent quarter, which saw Atari net income fall to $19.6 million
from $23 million a year earlier, and revenue fall to $161.8 million
from $190.6 million last year.

Subscribers Up 50% to 270,000; Company Raises Forecast
Los Angeles -- Napster announced that it ended its third quarter
with a total of 270,000 paying subscribers to its digital music
service, including 44,000 from universities, representing a 50%
increase from the second quarter. While reporting a loss of $16.4
million for the quarter, the company also said it earned $12.8
million -- which included gains from the sale of its Roxio CD and
DVD burning software unit -- compared with a loss of $25.6 million
in the same period a year ago. Los Angeles-based Napster expects to
earn $14 million in its coming quarter, and raised its full-year
revenue projection to $43 million, up from an earlier estimate of
between $35 and $40 million.

Magazine Salon.com Gets New CEO, Editor in Chief
San Francisco -- Salon Media Group, the publisher of online
magazine Salon.com, announced on Thursday that founder, CEO and
editor in chief David Talbot has stepped down from his positions.
The company named Salon president and CFO Elizabeth Hambrecht to
succeed Talbot as CEO, and Joan Walsh, former senior vice president
of editorial operations, as the publication's new editor in chief.
Talbot will retain his role as chairman of the board, and said he
plans to work on a book about John and Robert Kennedy. "It's an
excellent time for me to move into a new role," said Talbot. "Betsy
and Joan have been part of the leadership team that brought Salon
new fiscal and editorial life, and I'm proud to be able to leave
Salon in their hands." The company also reported its first-ever
profit of $400,000 for its third quarter ended Dec. 31, compared to
a loss of $400,000 during the same period a year earlier. Salon
reported 89,100 paying subscribers to its premium service, compared
to the 73,700 it counted a year ago, and said advertising revenues
increased 124% to $1.3 million.

Creates Peer-to-Peer Music Sharing Service for Cell Phones
Seattle -- Melodeo, a developer of mobile music delivery technology,
announced on Thursday that it has developed a new peer-to-peer
mobile music sharing service, that lets cell phone owners send
purchased tracks to one another over Bluetooth connections. The
service will let the recipient listen to a 30-second sample of a
track sent over Bluetooth, and then purchase the full track -- with
Melodeo sending a decryption key over the carrier's network to
unlock the song and billing the purchase to the recipient's cellular
account. Seattle-based Melodeo also lets users purchase and download
track to their own cell phones. The company said it will initially
launch the new music-sharing service in Europe during the first
quarter.

Launch National Video-on-Demand Dating Service
Philadelphia -- Comcast, the nation's largest cable TV provider,
said on Thursday that it plans to launch a national video-on-demand
dating service, Dating on Demand, on Valentine's Day. The service
invites Comcast subscribers to submit a video personal ad, or else
attend a local taping event, and contact singles whose profiles they
have viewed on the service through a HurryDate e-mail account.
Comcast said that, since launching the service in Philadelphia last
summer, member profiles have been viewed more than one million
times. The company added that initially, only profiles from
Philadelphia and Chicago will be available to all Comcast viewers;
additional profiles from subscribers in Baltimore, D.C., Portland
and Denver will be added later this spring.

Beach, Calif.) Acacia Research, a holder of patents on various
digital media technologies that has aggressively sought to license
them to major digital video providers, announced on Thursday that it
plans to raise $19.6 million through a private placement of its
shares with Apex Capital. Newport Beach, Calif.-based Acacia has
compelled firms including Disney and Playboy to license its digital
media transmission technologies, while suing others, including
DirecTV and Comcast, for infringement.

(Washington, D.C.) Shares of XM Satellite Radio, a provider of
satellite radio services with more than 3.2 million subscribers,
were up more than 2% on Thursday after the company reported a
quarterly net loss that was lower than analysts' expectations. The
company, which added more than 700,000 subscribers during the
quarter, said that it recorded a net loss of $190.4 million, up from
$170.2 million the previous year. Though revenue more than doubled
to $83.1 million, the company said that it spent heavily on
programming and marketing.

higher-capacity model portable digital music player, the Dell DJ 30,
which can hold 30GB of music and will retail for $299. The company

memory chip for use in cell phones, portable music players, digital

announced on Thursday that it has signed an agreement with
U.K.-based video game developer SCi Games, for the North American
publishing rights to the company's "Conflict: Global Terror," "Carmageddon"

2.5 million unit-selling franchise, while "Reservoir Dogs," based on
the Quentin Tarantino film, is being adapted for consoles and the PC

Thursday introduced its ION Educational Gaming System (E.G.S.), an
interactive TV game for children ages 3 to 7 that will include a
camera that projects a child's image onto the screen and directs
game action through motion-sensitive technology. The game is meant
to teach younger kids letters, numbers and colors, and older
children elementary skills like reading, math and problem solving.
Developed with motion-capture technology from GestureTek, the $119
ION will come with Active Learning Discs containing five games
apiece and retail for $17.99. Playskool also said it is negotiating
licenses to incorporate characters from children's TV producers
Nickelodeon, Sesame Workshop and HIT Entertainment.

(San Francisco) CNET News.com on Thursday reported on research
being done at Royal Philips Electronics and Audible Magic to develop
a "video fingerprinting" technology, that could potentially identify
movie files on peer-to-peer networks and block them from being
transferred illegally. Similar technology for audio files from
Audible Magic has been touted by the Recording Industry Association
of America (RIAA) and is being used on several college networks.
While Audible Magic has developed a small test library of
fingerprinted video, Philips has not yet created such a library,
although both companies said they have held discussions with
Hollywood film studios.
