o FCC Upholds Rule on Carrying Local Digital Channels

Washington -- The Federal Communications Commission has voted down a request that would have required cable and satellite operators to carry multiple digital channels offered by local TV stations. As more and more local broadcasters switch to digital, some have chosen to use the extra space to create multiple channels. The 4-1 vote by the FCC, however, upheld a four-year-old ruling requiring cable and satellite companies to carry just one digital channel per station. The decision could potentially slow the transition to digital TV, as broadcasters aren't required to give up their analog spectrum until a vast majority of Americans have the new digital TVs needed to receive digital signals -- and the absence of local channels on cable systems could impede digital TV sales. Congress wants broadcasters off the analog spectrum so they can then auction the bandwidth to wireless companies. Reaction to the decision was varied. While the National Association of Broadcasters called it "anti-consumer," the cable and satellite industries argue that adding the extra channels would eat up valuable space on the dial, and worry that local broadcasters might choose to carry such programming as non-stop infomercials. Cable providers recently reached a separate deal with public broadcasters to carry multicast signals -- which will include the ability for PBS to offer an HD signal and interactive channels on digital cable systems.

o MPAA Wins $1 Million Judgment Against P2P Site, Files More Suits

Dallas -- A federal court in Dallas has ordered a website that provided links to unauthorized movie downloads on the BitTorrent peer-to-peer network to shut down and pay the Motion Picture Association of America (MPAA) $1 million in damages. The court also ordered the operator of LokiTorrent.com, Edward Webber, to turn over records on 750,000 registered members, which the MPAA plans to use to target other individuals with copyright infringement actions. A note on the LokiTorrent.com site now reads, "You can click but you can't hide… Stealing movies leaves a trail. The only way not to get caught is to stop." The MPAA also announced that it has launched a second wave of lawsuits against operators of similar BitTorrent "tracking" sites in both the U.S. and Austria, as well as suits targeting individual movie-swappers. The MPAA also sued four websites selling file-sharing software: Brandnewmovies.com, Moviepros.net, Downloadmuch.com and Downloaditall.com.

o Apple Effects 2-for-1 Stock Split

Cupertino, Calif. -- Apple Computer on Friday announced that it will effect a 2-for-1 stock split, a move fueled by the strength of shares that have risen in value fourfold over the past year on blockbuster iPod sales. Apple shareholders will receive one extra share of Apple for each share they own. Often times a company will effect a stock split to attract smaller investors, and to indicate it believes its earnings, and in turn share price, will continue to rise. News of the stock split sent Apple shares up nearly 4% on Friday.

o EU Resumes Antitrust Review of Microsoft Acquisition of ContentGuard

Brussels -- The European Commission announced on Friday that it has once again taken up its antitrust review of Microsoft's acquisition of digital rights management firm ContentGuard. Microsoft proposed to buy a controlling interest in Maryland-based ContentGuard along with partners Time Warner, but the deal came under scrutiny last August when the European Union said it believed Microsoft could emerge with a monopoly on digital rights management technologies. Commission spokesman Jonathan Todd said that Microsoft has provided additional information on the deal, and a new deadline of April 7 has been set for the EU to grant or deny approval of the deal. The Commission is also now investigating whether Microsoft violated any rules by bringing Thomson in as a third partner, as it would have no antitrust authority on a deal that would provide equal ownership among more than two companies.

o Court to Revisit French Suit Over Yahoo's Nazi Auctions

Sunnyvale, Calif. -- The 9th U.S. Circuit Court of Appeals in San Francisco on Thursday said that it will rehear some arguments in a suit filed by a pair of French human rights groups trying to ban the sale of Nazi-related items on sites run by Yahoo, the Associated Press reported. The Union of Jewish Students and the International Anti-Racism and Anti-Semitism League, both based in France, first sued Yahoo five years ago, winning a French court order to block Yahoo's sites in France from selling Nazi memorabilia. Selling or displaying racist material is a crime in France. Yahoo, however, kept the items -- which included swastika-laden flags and excerpts from Hitler's "Mein Kampf" -- on its more popular U.S.-based site, which is still accessible to French surfers. Following another court ruling in 2001, Yahoo theoretically now owes more than $5 million in fines. "If American companies have to worry that foreign judgments entered against them might be enforceable, it could end up with companies censoring their web sites," Mary Catherine Wirth, a senior corporate council at Yahoo, told AP.

o U.K. Game Publisher Eidos to Close Austin-based Studio Ion Storm

London -- U.K. video game publisher Eidos announced this week that it plans to shut its Austin-based development studio Ion Storm as part of a plan to consolidate its North American operations. The closure will affect about 35 employees at Ion Storm, best known for developing the "Deus Ex" game franchise. The studio was founded in 1996 by "Doom" creators John Romero and Tom Hall, who departed after Eidos purchased the company in 2001. "This is part of the company's move to consolidate and strengthen its technical and management capabilities into a smaller number of studios which are capable of scaling up in order to meet the competitive challenges that lie ahead, particularly in anticipation of next generation technologies and platforms," Eidos said in a statement. Eidos now holds just one North American studio, Menlo Park, Calif.-based Crystal Dynamics, which Eidos said will now hire about 50 new employees.

o Songwriter Puts Rights to Tune Co-Written with Elvis on eBay

Memphis, Tenn. -- The rights to the purported last remaining unreleased and unpublished song by Elvis Presley have been put up for auction on eBay. Songwriter Paul Terry King, who also co-wrote Elvis' song "Idabel" and Alabama's "Love in the Third Degree," has decided to sell his 50% interest in another song he co-wrote with Elvis in 1973, "If I'd Only Bought Her Roses." King said he has lost possession of the only tape recording of Elvis performing the song. A minority interest in the song is also owned by Robert FX Sillerman, founder of concert promoter SFX Entertainment, who paid $100 million in December to Lisa Marie Presley to acquire a controlling stake in Elvis Presley Enterprises. A starting bid of $10,000 on eBay (item #4074240562) is being asked for the rights to half of "If I'd Only Bought Her Roses."

o Mobile Game Publisher Kayak Interactive Acquires Synergenix

San Mateo, Calif. -- Mobile game publisher Kayak Interactive announced this week that it has acquired Sweden-based publisher Synergenix Interactive. Financial terms of the transaction were not disclosed. Under the deal, Synergenix will become a subsidiary of San Mateo, Calif.-based Kayak Interactive. In addition to titles such as "Reservoir Dogs," and "Conflict: Vietnam," Synergenix has also developed cross platform game middleware called mophun, while Kayak markets its Kayak Live multiplayer software for mobile games as well as games like "Bill Dance Bass Fishing."

o Video-on-Demand Start-up Veveo.tv Raises $14 Million

Waltham, Mass. -- Veveo.tv, a Massachusetts-based start-up developing video-on-demand technology, has raised $14 million in its first round of venture capital, the Boston Business Journal reported. The company was started last year by Murali Aruvamudan, who previously founded Winphoria Networks, which was acquired by Motorola in 2003 for $172 million. Veveo.tv is doing most of its development work in India, the Business Journal reported.

o European VC Investment Ends 4-Year Downturn; Holds Steady in '04

London -- For the first time since 2000, annual investment in European venture-capital-backed companies held steady, with $4.5 billion invested last year, nearly the same amount that was invested in 2003, according to a new report from VentureOne and Ernst & Young. The number of venture capital rounds, however, decreased by 20%. Still, the fact that European investment stabilized after four years of decline was viewed in a positive light. "Some of the factors which contributed to recent growth in U.S. venture capital investment are now being observed in Europe," said Gil Forer of Ernst & Young. "In 2004, Europe saw significantly higher M&A valuations and the most VC-backed IPOs in three years, creating a clearer path to quality exits for investors." Early stage rounds represented a third of all deals in Europe last year, up from 28% the prior year.

(New York) Billboard magazine this week began factoring sales of digital song downloads into its overall "Hot 100" list of the most popular singles in the country. Previously, the chart had been compiled using a combination of radio airplay data and sales of physical 45 rpm records, cassette and CD singles, but will now also incorporate sales data from online retailers like iTunes and Napster. Billboard also offers a separate chart that compiles data just from digital retailers; this week's top-selling download was Green Day's "Boulevard of Broken Dreams," followed by 50 Cent's "Candy Shop" and Kelly Clarkson's "Since U Been Gone."

(Espoo, Finland) Macromedia, a developer of web publishing software, said on Friday that it has signed a deal to integrate its Flash technology into the smartphone platform of Finish wireless equipment maker Nokia. Through the deal, nearly 2 million registered developers in Forum Nokia and more than 1 million Macromedia Flash developers will be able to create new Flash content and applications for mobile phones.

(Redwood City, Calif.) Electronic Arts announced on Friday that it has partnered with Warner Bros. Interactive Entertainment to include the voices and likenesses from actors in the upcoming Chris Nolan film "Batman Begins" in its games based on the movie. Currently being developed by EA and U.K.-based Eurocom for PlayStation 2, Xbox and GameCube, the game will include contributions from actors including Christian Bale (Bruce Wayne/Batman), Michael Caine (Alfred Pennyworth), Liam Neeson (Henri Ducard) and Morgan Freeman (Lucius Fox). The game will ship to retailers on June 17, on the same day as the film's debut in theaters.

(San Francisco) CNET News.com reports that a "hack" that last year let consumers find out which Pepsi bottles contained a free iTunes song download can also be used to cheat this year's iteration of the promotion. The "hack" consists simply of tilting the Pepsi bottle at the right angle so one can view whether the inside of the cap reads "Free Song" or "Please play again." However, the cost of the soda will cover the cost of each $0.99 download, and Pepsi has limited the number of downloads a single person can redeem to 10 per day and 200 total over the course of the three-month promotion.
