o French Consumer Group Sues Apple, Sony Over Music Services

Paris -- A French consumer advocacy group has filed legal complaints against Apple and Sony, claiming the companies' respective digital music download stores are anti-competitive because they only support their own portable music player devices, the French newspaper Les Echos reported on Monday. "The total absence of interoperability between DRM removes not only consumers' power to independently choose their purchase and where they buy it from but also constitutes a significant restraint on the free circulation of creative works," UFC-Que Choisir said in a statement. UFC-Que Choisir has sent a court summons to the French subsidiaries of Apple and Sony; a similar effort from VirginMega last year in France to get Apple to open its iPod to competitors was unsuccessful.

o Motorola Introduces First Cell Phone to Support Apple iTunes

Cannes, France -- Cell phone maker Motorola on Monday introduced a new line of handsets based on its ultra-thin RAZR model, including one that comes loaded with Apple's iTunes music player. The Motorola E1060, expected to ship in the fourth quarter of 2005, will be the first phone to include iTunes; the company signed a deal with Apple last year to make iTunes the default music player on all of its handsets. Motorola and Apple have not announced plans to integrate the iTunes Store, so that songs could be purchased and downloaded directly to cell phones. Motorola added that it will maintain support for other media players on its phones, such as RealNetworks' RealPlayer. The E1060 phone will offer up to 512MB of memory, in addition to a 1.3 megapixel digital camera and VGA video camera.

o Movie Gallery Gets Antitrust Approval for Hollywood Entertainment Merger

Dothan, Ala. -- Movie Gallery, the nation's third-largest movie rental store chain, announced on Monday that antitrust regulators have approved its proposed acquisition of Hollywood Entertainment, the nation's second-largest rental chain. Alabama-based Movie Gallery bid $13.25 per share for Hollywood, or about $900 million. Blockbuster has also bid over $1 billion for the company, but its proposal is still under antitrust review at the Federal Trade Commission.

o Bankrupt Digital Music Provider DMX Music Sold to THP Capstar

Los Angeles -- DMX Music, a unit of Liberty Media that provides digital music and video to digital cable, satellite and other services, announced on Monday that it has filed for bankruptcy protection, and will be acquired by private investment firm THP Capstar for an undisclosed sum. Los Angeles-based DMX, which also secured $10 million in debtor-in-possession financing, said it would entertain better offers and expects a sale of the company to be completed within three months. "Completing the sale through a Chapter 11 filing will allow us to significantly reduce our debt and undertake an orderly transition to our new owners," said DMX Music president and CEO Mark D. Rozells. "Under THP Capstar's ownership, the business will be able to capitalize on its leading market position, proprietary technology and significant operational improvements made since 2002, while having greater access to financial resources necessary to support our future growth." DMX Music provides commercial-free digital music channels to cable and satellite TV firms, as well as to many retail stores, and to airlines for in-flight entertainment.

o Nokia, Loudeye, Microsoft Offer Mobile Music Service

Cannes, France -- Cell phone maker Nokia on Monday announced that it has partnered with Loudeye, a provider of digital music retail services, to offer wireless network operators the ability to offer their own branded mobile music services. The service will let consumers browse, search, listen, and download full tracks and ringtones either to a cell phone or PC. Nokia partnered with Microsoft to integrate support for the company's Windows Media Audio and Video formats, and digital rights management technology into the branded music services. Separately, Finland-based Nokia also introduced a new smartphone model that includes an integrated music player with stereo output, full Internet browser, and both a 1.3 megapixel still image camera and two-way video camera. The Nokia 6680 will go on sale in Europe in April for about $580; a version of the smartphone for the Americas is scheduled to ship in the second quarter of 2005.

o Mobile TV Firm Sling Media Gets Investment from Hearst Corporation

San Mateo, Calif. -- Sling Media, a provider of technology that lets consumers view the live TV programs they subscribe to at home from any Internet-connected device, announced on Monday that it has received an undisclosed investment from The Hearst Corporation. The investment follows on a $10.5 million first round of funding closed in November. San Mateo, Calif.-based Sling Media expects to ship its $249 Slingbox Personal Broadcaster set-top box, which lets users "placeshift" their satellite and cable TV shows, as well as programs recorded with a digital video recorder, in the first half of 2005. "The media marketplace is undergoing rapid change, and we are impressed with Sling Media's pioneering approach of placeshifting the living room television experience," said Scott English, vice president of strategic investments for Hearst Interactive Media.

Peppercoin, a provider of online micropayment processing technology, announced on Monday that Mashboxx, a peer-to-peer file-sharing network licensed by the major labels, will use Peppercoin's technology to facilitate the sale of digital song downloads. Scheduled to launch in the first quarter of 2005, Mashboxx will allow searches on major file-sharing networks and sell authorized downloads for $0.99. The service will use digital licensing and copyright management technology developed by Snocap -- a start-up launched by Napster founder Shawn Fanning.

(San Jose, Calif.) Royal Philips Electronics announced on Monday that it plans to offer a single chip that will enable the delivery of TV on mobile phones in the fourth quarter of 2005. The company plans to offer the chips, which are based on the DVB-H standard and will offer 10 hours of viewing between charges, to handset makers for trials in the second quarter of 2005. Philips added that it has partnered with Silicon & Software Systems (S3) to integrate the company's onHandTV software into the solution.

(Culver City, Calif.) Sony Pictures Home Entertainment announced that it will release four movie titles on the Universal Media Disc (UMD) proprietary discs that Sony Computer Entertainment has developed for use with its PlayStation Portable (PSP) handheld gaming system. Sony will offer "XXX," "Hellboy," "Resident Evil 2" and "Once Upon a Time in Mexico" on UMD on April 19, shortly after the PSP's release in North America. The company will also include a copy of "Spider-Man 2" on UMD with its initial launch shipment of the PSP in North America. The company will offer UMD video titles for PSP in Japan in April, with Europe to follow.

(New York) Atari announced on Monday that it plans to release a new "Matrix" video game, "The Matrix: Path of Neo," based on a license from Warner Bros. Interactive Entertainment. The new title will be developed by Atari's Newport Beach, Calif.-based Shiny Entertainment, which also created the 6 million unit-selling "Enter The Matrix" game. "Path of Neo" will feature the likenesses of all of the key actors, in addition to footage from all three films and "The Animatrix." Throughout the game, the path the player takes to resolve each scenario and the resulting consequences will be scripted and directed by the Wachowski Brothers, creators of the film trilogy. The game will ship for PlayStation 2, Xbox and PC in the fall of 2005.

(New York) Video game publisher Atari said on Monday that it has signed a multi-year agreement with mobile game publisher Sorrent, to develop and publish games based on Atari's console game title, "Marc Ecko's Getting Up: Contents Under Pressure." Apple announced on Monday that its iTunes Store is offering a version of the Beatles' "Across the Universe" -- performed live at last night's Grammy Awards -- by artists including Brian Wilson, Bono, Stevie Wonder and Velvet Revolver. All proceeds from sales of the $0.99 download will go to Southeast Asia tsunami relief efforts. Apple will also offer all albums featuring a Grammy Award-winning track for $7.99, a $2 discount, for a limited time on iTunes.

(Los Angeles) Jazz artist Maria Schneider's Grammy-winning album "Concert in the Garden" was sold exclusively online through ArtistShare, a website that lets artists raise money to fund production of their albums from their fans, Reuters reported. Only 10,000 copies of Schneider's CD were pressed, with 9,000 of them pre-ordered from fans through ArtistShare. "This record cost $87,000 to make. I already made my money back," Schneider told Reuters. "I'm not splitting the profits with the distributor, the record store and the record company. It's working so well for me."
