o MovieBeam Re-launches with HD Movies, $48.5 Million in VC Funding

Menlo Park, Calif. - MovieBeam, a video-on-demand service originally launched by Disney in 2003 but later discontinued, on Tuesday announced the re-launch of its service in 29 U.S. markets, and a new round of venture capital financing totaling $48.5 million. Mayfield Fund led the investment round; Cisco Systems, Intel and Disney also participated. The MovieBeam service uses over-the-air "datacasting" technology to deliver a weekly-updated library of 100 movies to TV set-top boxes. The required set-top box costs $199, while new releases rent for $3.99 each for a 24-hour rental period. Disney initially launched MovieBeam in three markets, but discontinued the service in April 2005 with plans to upgrade technology. With its re-launch, MovieBeam becomes the first video-on-demand service to deliver high-definition versions of some movies, which will cost $1 extra to rent.

o Spitzer Sends Labels New Subpoenas in Digital Music Pricing Probe

New York - Record labels have received a new round of subpoenas from New York Attorney General Eliot Spitzer, who is investigating the pricing of digital music downloads, CNET News.com reported on Tuesday. Warner Music Group disclosed in an SEC filing today that it received a second subpoena, while "music industry sources" told News.com that labels complained to Spitzer that earlier subpoenas they received were too broad. In addition to record labels, Spitzer has also sent subpoenas to a number of digital music retailers. Some label executives have recently said that they favor changing the current 99-cent pricing for digital songs, so that new releases could be sold at higher prices while library titles would sell for less.

o RIAA: Sellers of Used iPods Loaded with Songs Breaking the Law

New York - According to the Recording Industry Association of America (RIAA), consumers upgrading to the latest iPod and selling their old models online or elsewhere must first wipe their hard drives clean of music, or else they are in violation of copyright law, MTV.com reported. "Selling an iPod preloaded with music is no different than selling a DVD onto which you have burned your entire music collection," the RIAA said in a statement. "Either act is a clear violation of U.S. copyright law. The RIAA is monitoring this means of infringement. In short: seller beware." The RIAA told MTV.com it has already contacted at least one eBay seller who was selling video iPods loaded with 6,000 songs, and is working with the online auction service to create a warning that would appear for those who post pre-loaded iPods for sale. "When you buy a CD, you have it for personal use on your computer or iPod, but you can't give it away and keep it for yourself," RIAA president Cary Sherman told MTV.com. "That's having your cake and eating it too. If everyone did that, [record labels] would only sell one CD."

o Video Game Publisher Activision Cuts 7% of Staff

Santa Monica, Calif. - Video game publisher Activision has laid off 7% of its staff, or about 150 of its 2,200 employees, from its headquarters in Santa Monica, Calif. The company said the cuts are part of a strategy to optimize its cost structure and resource allocation during the transition to next-generation game consoles. The layoffs at Activision come shortly after rival Electronic Arts cut under 5% of its worldwide staff; both game publishers have also recently slashed prices on their games for current-generation consoles, in a bid to increase sales. Activision's games include the top-selling "Call of Duty" and Tony Hawk skateboarding franchises.

o Microsoft Acquires French Mobile Search Developer MotionBridge

Barcelona - Microsoft announced that it has acquired MotionBridge, a France-based provider of mobile search technology and navigation services, for an undisclosed sum. Under the terms of the deal, Microsoft will obtain MotionBridge's operator partnerships (T-Mobile, Orange, Sprint and O2 Ltd., among others) and its flagship technology, which provides clustered results and "deep links" to downloadable content from multiple providers. MotionBridge was founded in 2000 and later funded by Siemens Mobile Acceleration.

o BT, Virgin Mobile to Launch Mobile TV, Radio Service in the U.K.

London - U.K. telecommunications firm BT Group announced that it has signed an agreement with Virgin Mobile to offer a digital TV and radio service to mobile phone users in the U.K. With the news, Virgin is set to become the first mobile operator in Europe to offer broadcast TV to mobile customers. Virgin Mobile subscribers will be able to view five digital TV channels and listen to more than 350 radio stations on a new handset, the Virgin Trilogy, which will run Microsoft's Windows Mobile software. The service will be launched sometime later this year.

o NeoMedia to Acquire Germany-based 12snap for $22 Million

Ft. Myers, Fla. - NeoMedia Technologies, a provider of technology for delivering mobile Internet-based information, has agreed to pay $22 million in cash and stock to acquire 12snap, a Munich-based provider of marketing and entertainment applications for cellular phones. This is NeoMedia's first European acquisition. Last week, the company acquired Mobot, a Massachusetts-based provider of mobile visual recognition technology. Founded in 1999, 12snap has a total of about 75 employees in New York, London, Milan, Vienna and Stockholm, as well as Dusseldorf and Munich, and a technical development center in Romania.

o EU "Monitoring" Windows Vista Bundling, Report Says

Brussels - According to a report by IDG, the EuropeanCommission is looking into a number of complaints against the bundling of products into Microsoft's Windows Vista -- the software giant's first operating system using protocols set down by antitrust decisions in the EU and U.S. "Several companies have expressed concerns to the European Commission related to Windows Vista," Commission spokesman Jonathan Todd told IDG. Todd said the Commission has not opened a formal investigation because it has not received a formal complaint, but added that it was "monitoring" the situation. Vista is scheduled to ship by year's end.

Los Angeles - Napster announced on Tuesday that SunCom Wireless, a mobile network operator serving the Southeast U.S., Puerto Rico and the U.S. Virgin Islands, is the first U.S. mobile operator to offer the Napster Mobile music service to its subscribers. Hosted by Ericsson, the Napster Mobile service lets users browse and sample ringtones and full-length songs, and purchase copies for their phones and PCs. New York - Sports Illustrated has expanded its annual swimsuit issue to include iTunes Video downloads and other online content, The New York Times reported. Eight swimsuit videos will sell on iTunes for $1.99 each, while a special code included on each print edition of the issue will unlock a free movie download. "[The swimsuit issue] is the mother ship of what we do. We want to leverage the power of that franchise," Sports Illustrated president and publisher Mark Ford told The Times. o E-Book Industry Working Towards Unified Container Format

La Jolla, Calif. - eBook Technologies, a provider of e-book delivery technologies, announced on Tuesday that company co-founders Garth Conboy and John Rivlin will co-chair a working group within the International Digital Publishing Forum (IDPF), whose goal will be to develop a unified e-book container format.
