o WSJ: Amazon, Labels in Talks on
Digital Music Subscription Service
Seattle - Online retail giant Amazon.com is in licensing
negotiations with the four major record labels, with eyes toward
launching its own digital music service, The Wall Street Journal
reported on Thursday. On Tuesday, Warner Music Group CEO Edgar
Bronfman told reporters that the company has been in talks with
Amazon. "We certainly have been working closely with Amazon as they
work to launch their service," said Bronfman. "They have a very
powerful base of CD purchasers and we think that their digital
launch, when it comes sort of second half of the year, we hope will
be a successful one." Amazon, which claims 55 million customers with
active accounts, is said to be looking at a subscription-based
service like Napster, The Journal reported. The service would offer
subscribers a discounted, Amazon-branded portable music player made
by Samsung.

o XM Reports
Wider Quarterly Loss; Board Member Resigns
Washington - Shares of XM Satellite Radio dropped 5% on
Thursday after the provider of satellite radio services posted a
significantly wider quarterly loss, due mainly to higher marketing
costs. At the same time, the company said that Pierce Roberts, a
board member for five years who sat on all of the company's major
committees, has stepped down, citing disagreements with other board
members about the direction of the company. "The company believes
the disagreement with Director Roberts primarily involves the
strategic balance of growth versus cash flow," XM said in a
statement. "Director Roberts has historically favored more stringent
cost control in the company, specifically involving lower marketing,
programming and promotional expenditures." For the quarter, XM
reported a net loss of $270.4 million, up from $190.4 million the
prior year. Despite revenue that more than doubled to $177.1
million, the company's per share loss of $1.22 was sharply higher
than Wall Street expectations of $0.92, according to a survey of
analysts from Thomson First Call.

Virtual Mobile Network Helio Partners with MySpace
Los Angeles - Helio, a new youth-focused mobile network
operator joint venture between EarthLink and South Korea's SK
Telecom, announced on Thursday that it has signed an agreement with
MySpace, News Corp.'s social-networking site with 55 million
members. The MySpace Mobile service will let Helio subscribers view
MySpace profiles and photos, blog, send and receive MySpace
messages, and post photos taken with Helio phones directly onto
MySpace. The Wall Street Journal reported that Helio, set to launch
in the U.S. in the spring, will receive $440 million in funding from
its backers. The company's first two handsets -- the "Hero" made by
Pantech and "Kickflip" made by VK Mobile -- were introduced on
Thursday.

o Utah Looks to
Adds Violent Games to Obscenity Law, Ban Sales to Minors
Salt Lake City, Utah - A bill that would include violent
video games in the state of Utah's obscenity laws, and make it a
felony to exhibit such games to minors, has passed in a committee
and now heads to the Utah House for debate, the Utah Daily Herald
reported. The bill would put the same legal test to violent games
that applies to pornography; namely, that games are obscene if they
are deemed so by community standards, and contain no serious
literary, artistic, political or scientific value for minors. "This
is a bill that identifies the effects that different media has on
our children," said Utah Rep. David Hogue, a Republican from
Riverton. The Entertainment Software Association, a video game
industry trade group, said the bill was not needed. "More
importantly, the bill will be challenged as unconstitutional," the
ESA's Scott Sabey told the Daily Herald. "To plug violence into an
obscenity statute won't work." The ESA has already successfully sued
to have video game bans declared unconstitutional on free speech
grounds in a number of states.

o Microsoft
Names New Head of Japanese Xbox Division
Tokyo - Microsoft announced on Thursday that it has
appointed Takashi Sensui to general manager of its Xbox division in
Japan. Sensui replaces Yoshihiro Maruyama, who was appointed to a
position within Microsoft's entertainment and devices division.
Microsoft has sold just 115,000 Xbox 360 consoles in Japan in two
months of availability -- fewer than the original Xbox in the same
period -- compared with 900,000 sold in North America by the end of
December. "Sales have not necessarily lived up to everyone's
expectations since launch," Sensui told Reuters. "But considering
the (software) titles due to be released and the features and
functions of the Xbox 360, we believe we will see very strong growth
from here on out." The company expects sales to increase once
Japanese-developed games for the Xbox 360 are released in the near
future. "There just hasn't been enough software available," Hiroshi
Kamide, an analyst at KBC Securities Japan, told Reuters. "It's all
about the games, and if they aren't there, there is just absolutely
no point."

o Report:
Nearly 18 Billion Videos Streamed Online in 2005
Monterey, Calif. - The number of Internet video streams
served in 2005 was up 50% over 2004, to 17.95 billion, with 85% of
these streamed at broadband rates, according to a report from market
research firm AccuStream Research. Surfers also tuned into more
streaming Web radio stations, as aggregate tuning hours for 2005
were 43% higher than the previous year. Music was the top video
category online again in 2005, accounting for 45% of all video
streams served. In addition to traffic generated by new independent
streaming video sites, like Break.com, StupidVideos.com, Roo and
VideoDetective, the largest streaming video networks remained part
of large portals like AOL, Yahoo and RealNetworks, AccuStream said.
"Syndication agreements between large content brands such as
FoxSports and MSN Video, CBS and ABC with AOL, along with ESPN and
high-speed network providers suggests streaming media is following a
maturation path carved out by major broadcast, cable and satellite
distribution platforms," said AccuStream research director Paul A.
Palumbo.

Online Casino Empire Online Settles Legal Dispute with PartyGaming
London - The legal battle between Gibraltar-based online
poker giant PartyGaming and Cyprus-based Empire Online ended on
Thursday after the former agreed to acquire a number of assets
belonging to the latter for approximately $250 million in cash.
Empire operates websites that direct punters to online gambling
companies, which then pay Empire a commission. Six months ago,
Empire sued PartyGaming after the online poker firm unceremoniously
dropped Empire's platform in favor of its own. Under the terms of
Thursday's announcement, PartyGaming will acquire the business,
assets, player databases and IP relating to EmpirePoker and
AceClub.com.

o Podcast Ad
Network Podbridge Gets Up to $12 Million in Funding
Mountain View, Calif. - Podbridge, a provider of targeted
ad delivery technology for podcasts, on Thursday announced the
launch of its service. The company's founder and CEO, Murgesh Navar,
told VentureWire that it has raised between $10 and $12 million in
venture capital funding, from Mayfield Fund and Worldview Technology
Partners. Podbridge said it has already partnered with the BBC,
Military.com and several Clear Channel radio stations, which will be
able to track ad listens, place ads by demographic and location,
rotate multiple ads and manage budgets. "For podcasting to become a
mainstream media, it needs a business model to encourage content
providers," said Navar. "We aim to help our content partners
generate revenue by providing the insight and accountability needed
to attract advertisers." The company added that Ronning Lipset Radio
has signed on to be its exclusive third-party agent, charged with
selling audio spots on the Podbridge network.

o Report:
U.S., Europe Lag Behind Asia in Mobile Gaming Adoption
Dallas - Mobile phone users in the Asia-Pacific region are
more avid consumers of mobile games than their European and North
American counterparts, according to a report from market research
firm Parks Associates. A survey found that 28% of consumers in the
Asia-Pacific region played single-player mobile games on a weekly
basis, compared with 13% in Europe and 8% in North America. In the
nascent market for mobile multiplayer games, the survey found 7%
played them weekly in the Asia-Pacific region, versus just 2% in
both Europe and North America. "Cellular operators in North America
and Europe are lagging behind their Asia-Pacific counterparts in
mobile gaming, but they are starting to increase their focus on this
area," said Parks Associates analyst Yuanzhe (Michael) Cai. "Large
game publishers such as EA are also reevaluating market
opportunities and investing heavily in the space, so with wider
deployments of 3G mobile networks and the continued development of
feature-rich handsets with gamer-friendly designs, these regions
should be able to reduce the international gaming gap."
