o WSJ: Carl Icahn Giving Up Battle
for Control of Time Warner
Dulles, Va. - Billionaire financier Carl Icahn has ended
his battle to gain control of AOL-parent Time Warner, and is now in
talks with the media giant about a potential settlement, The Wall
Street Journal reported on Friday. Icahn, whose group owns about 6%
of Time Warner, had been seeking to gain control of the company's
board with the goal of breaking it into four separate companies to
increase its value to shareholders. But Icahn, who has been unable
to gain much traction with other large shareholders, on Thursday
backed down from his original goal by nominating only five
candidates for the board, which has 14 seats. "Many shareholders
want change on the board, but they feel a full slate would be
disruptive," Icahn told the Journal "I agree it's disruptive, which
is why we're cutting down the slate."

Posts Wider Loss Despite Strong Subscriber Growth
New York - Sirius Satellite Radio, a provider of
subscription radio programming, on Friday posted a bigger loss than
expected, citing promotional costs for the launch of Howard Stern's
show, while expanding its subscriber base at a faster pace last
quarter than rival XM. Sirius posted a fourth quarter loss of $311.4
million, while its revenue tripled, to $80 million. The company
ended the year with 3.3 million subscribers, and projects it will
count 6 million by the end of 2006; the 1.14 million subscribers it
added in the fourth quarter outpaced rival XM's 898,000 new
subscribers. For Sirius, subscriber acquisition costs in the fourth
quarter were $113, compared with $89 for XM. Shares of XM fell
yesterday, after the company reported higher losses and the
resignation of board member Pierce Roberts Jr., who voiced concerns
the company was spending too much to attract subscribers.

Sales Prompt Studios to Reconsider Release Schedules
Los Angeles - Sales of movies on Sony's UMD format for its
PSP handheld video game have been weaker than expected, according to
a report in Variety, causing studios including Paramount, Warner and
Sony itself to cut back on future movie releases. The report said
successful releases have sold upwards of 100,000 units, but average
UMD titles topped off around 50,000 units; top-selling UMD titles
included "Napoleon Dynamite," "Chappelle's Show" and "Beavis &
Butthead." "We are re-evaluating our position on any future releases
at this time," Jeff Baker, senior vice president and general manager
of Warner Bros. theatrical catalog, told Variety. "We're looking at
this on a case-by-case basis. We're disappointed with consumer
demand at this time." Warner Bros. said it has cancelled releases
for six planned UMD titles. In a bid to help increase sluggish
sales, Sony has plans to release an adapter that would enable the
PSP to connect to a TV to play UMD movies.

More Class Actions Over "Grand Theft Auto" Scandal
New York - Video game publisher Take-Two Interactive is
facing more legal woes this week, as two new class action lawsuits
have been filed by shareholders against the company over
controversies surrounding its top-selling "Grand Theft Auto" game
franchise. The law firms of Milberg Weiss and Stull, Stull & Brody
both announced their class actions against Take-Two this week,
following other similar class actions filed after the company's
shares fell 30% in the wake of a scandal over a sexual mini-game
that could be unlocked within its "Grand Theft Auto: San Andreas."
The game was pulled from store shelves and given a more restrictive
"Adults Only" rating, but the "Hot Coffee" mini-game's existence
prompted an FTC investigation, and more recently a lawsuit from the
Los Angeles city attorney's office.

Booker BETonSPORTS Calls for U.S. 'Net Gaming Regulations
London - Citing recent betting scandals and actions in the
U.S. Congress, BETonSPORTS, a London-based online sports betting
firm, on Friday renewed its push for government regulation of the
online gaming industry in the U.S. The company also said that it
remains "vehemently opposed" to any prohibition attempts in
Congress. "Prohibition has never worked in the U.S. for any
activity," said CEO David Carruthers. "The idea that prohibition
would suddenly work now on any aspect of the Internet is a falsehood
and trying to shut out a multi-billion industry with the consumer
demand of online gambling through prohibition won't work."
BETonSPORTS, which focuses primarily on the North America, Asia and
Latin America regions, last month published a white paper on why
regulation is needed in the U.S. Carruthers said that the industry
needs regulation and tracking, "not to be pushed even further in the
shadows where organized crime and other less reputable individuals
can carve out a niche for themselves."

Stockholm, Sweden - Stardoll.com, a website aimed at girls
that lets them makeover and dress paper doll versions of celebrities
in various clothing and accessories, announced that it has raised $4
million in its first round of venture capital financing. Index
Ventures led the investment round; angel investors also
participated. Launched in 2004 by a 50-year-old retired Scandinavian
woman, Stockholm-based Stardoll.com (formerly Paperdoll Heaven) now
claims 900,000 members. The company also said it named Mattias
Miksche, founder and CEO of E-trade in Germany and Scandinavia, as
its new CEO.

to Acquire Mobile Marketing Firm HipCricket for $4.5 Million
Fort Myers, Fla. - Continuing a recent string of
acquisitions, NeoMedia Technologies, a provider of mobile Internet
technologies, has agreed to pay $4.5 million in cash to acquire
HipCricket, a Connecticut-based provider of mobile marketing
technology for broadcasters and brand marketers. HipCricket provides
customers with a range of mobile media technology, including
marketing and mobile strategy development, creative content
development, tracking and analysis, and database development and
maintenance. Founded in 2004, HipCricket has already worked with
four national radio groups, TV networks, a top TV reality show, and
more than two dozen major marketers, NeoMedia said. Last week
NeoMedia acquired Mobot, a provider of mobile visual recognition
technology, for $10 million in cash and stock. Earlier this week,
NeoMedia announced the purchase of 12snap, a Germany-based provider
of marketing and entertainment applications and programs for
cellular phones, for $22 million.

Worldwide PDA Shipments Reach Record Level in 2005
Stamford, Conn. - Worldwide shipments of personal digital
assistants (PDAs) reached a record 14.9 million units in 2005, a 19%
increase from the prior year, according to a newly release report
from market research firm Gartner. Research In Motion (RIM), the
maker of the BlackBerry, became the No. 1 PDA vendor based on
worldwide shipments, accounting for 21.4% of total shipments. Palm
shipped 2.77 million PDAs, down 25%.

San Diego - UltraStar Cinemas, a Southern California
theater operator with 102 screens, announced on Friday that it has
become the first exhibitor in the nation to equip all of its screens
with digital cinema projection systems. San Diego-based UltraStar
partnered with Access Integrated Technologies and Christie Digital
Systems to equip its screens with digital systems. The company said
it has already screened alternative entertainment such as a live
Duran Duran concert and the Super Bowl via its digital system, and
also plans to project the Academy Awards live in some locations.

confusion set to befall early adopters of next-generation Blu-ray
and HD DVD technologies, due to projected incompatibilities between
computers, drives and monitors caused by stringent copyright
protection technologies. While a setup with a standalone Blu-ray or
HD DVD player and HDTV is expected to work smoothly, it's possible
that initially, resolution could be degraded to sub-DVD quality --

Sex Workers' Group Calls for Boycott of "Grand Theft Auto"
San Francisco - A sex workers' advocacy group has called
for a boycott of Take-Two Interactive/Rockstar Games' "Grand Theft
Auto" video games, saying it opposes the representations of
prostitutes in the games. The San Francisco-based Sex Workers
Outreach Project (SWOP) said in a statement that it "will always be
adamantly opposed to any and all forms of censorship," but, "since
the video game Grand Theft Auto accrues points to players for the
depiction of the rape and murder of prostitutes, SWOP-USA calls on
all parents and all gamers to boycott Grand Theft Auto." The group
also cited a report from the National Institute on Media and the
Family, which found "a strong correlation between exposure to
violent video games and various forms of antisocial behavior."
