o Canadian Judge Postpones Ruling on
ISPs Revealing Song-Swapper IDs
Toronto -- A Canadian federal judge yesterday adjourned until
March 12 a motion from the Canadian Record Industry Association (CRIA),
that asks the court to compel five Internet service providers to
reveal the names of 29 subscribers' identities that CRIA believes
illegally uploaded songs to file-sharing services. Judge Konrad von
Finckenstein ordered the ISPs to keep a record of Internet activity
from the time periods in question, but granted them more time to
review technical and privacy aspects of the motion. Joel Watson, a
lawyer representing ISP Telus Corp., told Canada's Globe and Mail
that it has reached two of the three subscribers accused of
copyright infringement -- while the third did not hold an account
with Telus last fall when the alleged infringement was to have
occurred. Another ISP, Shaw Communications, said that it will mount
a legal challenge to the motion, asking the court to respect the
privacy of its subscribers.

o Yahoo Drops
Google Search Technology in Favor of Its Own
Sunnyvale, Calif. -- Yahoo on Wednesday officially dropped
long-time partner Google as the provider of its search engine
results, and launched its own Yahoo Search Technology. The new
service -- a combination of technologies acquired from Inktomi,
Overture Services and others -- will be rolled out across all of
Yahoo's international properties in the next several weeks. The new
search results on Yahoo will also include the company's paid
inclusion program, which allows advertisers to pay to come up higher
in search results. Yahoo said in a statement that following the
deployment, it estimates its search technology will power nearly
half of all online searches in the U.S.

o DVD Copying
Software Firm 321 Studios Faces New Lawsuit
Los Angeles -- The DVD Copy Control Association (DVD CCA), a DVD
security technology trade group, has become the latest in a string
of companies to file suit against 321 Studios, a provider of
software that can make copies of DVD movies, PC games and other
software. The DVD CCA claims that 321's DVD X Copy software
infringes on its patented Content Scramble System (CSS) encryption
scheme, during its process of defeating the security measure to make
a copy of a DVD. "In taking this legal action, DVD CCA is turning
its focus toward those who produce and broadly distribute products
in the marketplace that facilitate the widespread infringement of
the copyrights on motion pictures that CSS was designed to protect,"
said DVD CCA attorney Steven Reiss. St. Louis-based 321 Studios has
also been sued for copyright infringement in both New York and
California by a group of Hollywood movie studios, as well as by
Macrovision, a distributor of DVD copy-protection technology. 321
has stated that Macrovision's claims of patent infringement and
violations of the Digital Millennium Copyright Act are without
merit.

Report: Total 'Net Video Streams Up 104% in 2003 to 7.8 Billion
Monterey, Calif. -- A total of 7.8 billion of Internet video streams
were accessed during 2003, an increase of 104% over 2002 totals,
according to data released on Wednesday by Monterey, Calif.-based
AccuStream iMedia Research. Of these, 78% were viewed at broadband
rates. Music videos comprised the largest segment of content with
33%, followed by news (28%) and sports (17%). "Length of view and
total views in streaming video segment were up significantly in
2003, primarily because the streaming experience has become more
modular in format, with video clips now running back-to-back, the
Internet's version of television," said AccuStream director of
research Paul A. Palumbo. The report, which also surveyed Internet
radio streams, found that aggregate tuning hours for Internet music
radio were 53% higher when compared to 2002.

Publisher Bam Entertainment to Acquire Scottish Developer VIS
San Jose, Calif. -- Video game publisher Bam Entertainment announced
on Wednesday that it will acquire Scottish game developer VIS
Entertainment, as well as SOE Development Limited, a company set up
to fund the development of "State of Emergency 2," one of VIS' key
properties. Financial terms of the transactions were not disclosed.
The deal includes VIS' 50% stake in an interactive TV joint venture
with Telewest that owns the rights to the animated iTV horse-racing
game, "I-RACE." San Jose, Calif.-based Bam said the companies' first
joint effort will be the publishing of "State of Emergency 2," a
sequel to the million unit-selling title that at one time topped
both the U.S. and U.K. game charts.

Developer Acclaim Raises $15 Million in Note Sale
Glen Cove, N.Y. -- Acclaim Entertainment, a developer and publisher
of video games, announced on Wednesday that it has raised $15
million through the sale of convertible notes, due in 2007, to an
undisclosed investor. The investor also has the opportunity to buy
an additional up to $10 million in notes. New York-based Acclaim is
responsible for developing games including "NBA Jam" and "All-Star
Baseball," a title based on the TV series "Alias" and sports titles
featuring BMX rider Dave Mirra.

Named Chairman of Japanese Video Games Firm Sega
Tokyo -- Japanese video game maker Sega announced that current
company chairman Hideki Sato will step down, to be replaced by
Hajime Satomi, CEO of Sammy, the Japanese maker of Pachinko and
video games that purchased a controlling stake in Sega last year.
Sega said that Sato will become vice chairman of the company, while
Hisao Oguchi will retain his current role as president.

(New York) Playboy announced on Wednesday that it will expand its
online distribution into France with the launch of Playboy.fr by the
end of March. The site will be launched by 1633SA, which also
publishes the French edition of Playboy magazine. The launch will
include a wireless initiative allowing cell phone owners to download
wallpaper images, still photos, video clips and wireless games.
Playboy also operates international websites in Germany, Taiwan, the
Netherlands and Brazil.

(Washington, D.C.) XM Satellite Radio, a provider of
satellite-delivered digital radio programming, said on Wednesday
that automaker Volkswagen will make XM a standard feature on its
specially-themed "Satellite Blue" Beetle, and a factory and dealer

Satellite Beetle will come with a year's subscription to XM service,

Universal Games will create a version of its popular "Crash
Bandicoot" title for the N-Gage, Nokia's hybrid cell phone/handheld

(Los Angeles) Square Enix U.S.A., the U.S. distribution arm of
the Japanese video game developer, announced on Wednesday that it
will produce an orchestral and choral performance of music from its
"Final Fantasy" game franchise at the Walt Disney Concert Hall in
Los Angeles during this year's Electronic Entertainment Expo. "Final
Fantasy" series composer Nobuo Uematsu will create a score for the
two-hour performance on May 10, which will feature the Los Angeles
Philharmonic and Los Angeles Master Chorale.

(London) According to media reports, the BBC is looking to
distribute its archive of programming on peer-to-peer services, in
part to offset the bandwidth costs it expects to come along with
great demand for the service. BBC new media director Ashley
Highfield recently said that the broadcaster is developing a "super
electronic program guide" that will allow users to program the
recording of shows via a PC, much like a digital video recorder.
Programs will also be available for download after they air. The BBC
is also reportedly in talks with bandwidth providers including BT
for the service.
