o CBS Sues Howard Stern, Sirius for Breach of Radio Contract

New York - CBS Corporation announced on Wednesday that it has sued radio shock jock Howard Stern, claiming Stern used the last months of his contract at CBS to promote his new broadcasting partner Sirius Satellite Radio on the air, resulting in a $220 million stock windfall for Stern. CBS is suing Stern for compensatory and punitive damages for multiple breaches of contract, fraud, unjust enrichment and "misappropriation of CBS Radio's broadcast time"; the company is also seeking damages from Sirius, for unfair competition and interfering with Stern's CBS contract. The CBS suit says Stern's promotion of Sirius on CBS Radio -- allegedly in breach of his contract -- helped Sirius reach subscriber targets that in turn accelerated Stern's stock payment from 2010 to January 2006. The Motley Fool reported that CBS may have a hard time proving its case, as it paid Stern to talk about his own life -- which often included discussions about his employers -- and it could have censored talk about Sirius the way it sometimes censored other program content. Sirius shares were down about 1.4% on Wednesday.

o Justice Dept.: Three Plead Guilty to Online Piracy of "Pre-release" CDs

Washington - The U.S. Justice Department said on Wednesday that it has obtained guilty pleas from three men accused of distributing "pre-release" copies of songs on the Internet, as part of its Operation FastLink anti-piracy initiative. Assistant Attorney General Alice S. Fisher and U.S. Attorney Paul J. McNulty said that 21-year-old Derek A. Borchardt, of Charlotte, N.C.; 24-year-old Matthew B. Howard, of Longmont, Colo.; and 31-year-old Aaron O. Jones, of Hillsboro, Ore. have each pled guilty to one count of criminal copyright infringement. The men were involved with a group called "Apocalypse Crew," which obtained CDs before their commercial releases from sources such as radio DJs, employees of music magazine publishers, or workers at CD manufacturing plants, and uploaded them onto servers through which the songs eventually reached peer-to-peer file-sharing networks. Under a new federal law that stiffened penalties for "pre-release" piracy, each man will face up to five years in prison and a $250,000 fine. Sentencing for these three and 31-year-old George Hayes, of Danville, Va. -- who also pleaded guilty to pre-release music piracy in an unrelated case -- is scheduled for May 19.

o Napster Criticizes Music Service Technology Partner Microsoft

New York - Napster CEO Chris Gorog on Wednesday criticized the Microsoft technology that powers delivery of its digital music subscription service to PCs and portable music players, Reuters reported. "Our business does rely on Microsoft's digital rights management software and our business model also relies on Microsoft's ecosystem of device manufacturers," said Napster chairman and CEO Chris Gorog. "There is no question that their execution has been less than brilliant over the last 12 months." Apple's marriage of its rival iTunes service with a single player, the iPod, has so far proven far more attractive to consumers than Microsoft-powered services like Napster -- which don't support the iPod. Gorog was still optimistic, though, adding, "To date, only 5 percent of (music) sales have migrated digitally. We are in the very, very early days of this."

o Apple Introduces Hi-Fi Home Speaker Accessory for the iPod

Cupertino, Calif. - Apple on Wednesday introduced the iPod Hi-Fi, a $349 portable home speaker system for its iPod portable music players. Measuring 17" x 6.6" x 6.9", the Hi-Fi features an iPod dock, an Apple Remote for wireless control, and can be powered either through a wall socket or by six D-cell batteries. The iPod Hi-Fi enters a market that features similar speaker products offered by Bose and Altec-Lansing. Separately, Apple on Wednesday introduced a line of $99 leather cases for its iPod and iPod Nano players.

o Yahoo Sues Former Employees for Taking Trade Secrets to Mforma

Santa Clara, Calif. - Yahoo has filed suit against seven former employees, alleging they stole Yahoo source code and other trade secrets before leaving Yahoo to work for mobile game publisher Mforma. The suit alleges that former Yahoo manager David Chang and six other defendants conspired to steal internal data from Yahoo, such as technology that streamlines delivery of mobile phone content, and financial forecasts; it seeks a restraining order against Mforma using the trade secrets, and unspecified damages. Yahoo said that its evidence includes archived instant message conversations from company laptops, in which the former employees discuss their plans.

o Associated Press, MSN Launch Online News Video Network

New York - After two months in beta testing, the Associated Press (AP) and partner MSN on Wednesday launched the AP Online Video Network in the U.S. The breaking news video service allows the 4,000 websites that license AP news content to offer video news reports produced by AP journalists. The service will offer some 40 video clips per day through an MSN Video player, supported by pre-stream advertising, that cover national, international, technology, business and entertainment news. MSN is also working to expand the service to include locally-produced content, local advertising and content syndication systems.

o Game Developer Telltale Raises $1.4 Million in Seed Funding

San Rafael, Calif. - Video game developer Telltale announced on Wednesday that it has raised $1.4 million in seed funding, led by members of the Keiretsu Forum angel investment network. Telltale is currently developing games based on Jeff Smith's "Bone" comics, Steve Purcell's "Sam & Max" comics, and the CBS TV series "CSI." The company's games can be downloaded through Yahoo, Boonty, Direct2Drive and Trymedia Systems; in addition, game publisher Ubisoft plans to release its "CSI: 3 Dimensions of Murder" in the spring. Telltale will use the funds for technology development, marketing, and to invest in additional popular licenses.

o Survey: Most Americans Prefer TV for National News, Papers for Local

Burlingame, Calif. - Most Americans get their news from television, while newspapers continue to cede readership to the Internet, according to a new survey of 2,800 consumers from Burlingame-based research and advisory firm Outsell. Seventy-one percent of respondents said that they rely on network, cable and satellite TV as primary or secondary sources of national news, while only a third choose their local newspapers. Another 28% access sites like Google, Yahoo, MSN and AOL News, which aggregate national news articles from multiple major dailies and wire services, and just 11% rely on the websites of their daily newspapers. The statistics show a generational chasm between older respondents, who prefer TV and newspapers, and younger, who prefer online access for their news and information. When it comes to local news, however, 61% of consumers still turn to their newspapers first.

o Report: Take-Up of Digital TV Continues Apace in U.K.

London - According to the latest Communications Market report by U.K. telecommunications regulator Ofcom, the take-up of digital TV continues apace in the U.K., with more than 1 million new households being added in the first three quarters of this year. Digital TV penetration now stands at 66%, with more than 5.8 million homes subscribed to the Freeview digital terrestrial service, and 10.8 million households connected to satellite and cable services. The report also found that there are now more than 10 million broadband connections in the U.K., with increasing crossover between TV and telecommunications. The average broadband take-up rate during the three months to December was more than 70,000 per week.
