Music Pricing Probe, Following Spitzer's Lead
Washington - Likely spurred by a similar probe launched by
New York Attorney General Eliot Spitzer, the U.S. Justice Department
announced that it has opened an investigation into possible
collusion between the major record labels on digital music pricing.
"The Antitrust Division is looking at the possibility of
anti-competitive practices in the music download industry," Justice
Department spokeswoman Gina Talamona told Reuters. The
investigations from Spitzer and the Justice Dept. both relate to the
possible fixing of wholesale prices for digital music, industry
sources told Reuters. Currently, the industry standard price for a
digital song is 99 cents on services like iTunes and Napster,
although label executives have said publicly they would like to
initiate variable pricing for song downloads. Billboard reported
that sources said Spitzer was investigating alleged "most favored
nation" status that labels have with digital music services, such
that no label can receive a deal worse than its competitors,
effectively fixing prices. Record labels declined comment to both
Billboard and Reuters, but sources close to the labels told
Billboard that Justice Dept. subpoenas are expected to be
forthcoming.

Video Game Bills Shelved in Utah, Iowa
Salt Lake City, Utah - A bill passed in the Utah State
House, that would have branded violent video games as obscenity and
prohibited them from sale to minors much like pornography, has
failed to move in the Utah State Senate, and thus will not move
forward this year. "We are pleased that the Utah bill was not
enacted at this time," said Doug Lowenstein, president of the
Entertainment Software Association (ESA), a video game trade group
that has sued to overturn similar laws in several states. "We
continue to believe that bills such as this one are both
unconstitutional and unnecessary." Meanwhile, a bill in the state of
Iowa that would have banned the sale of violent video games to
minors has also been defeated, after failing to be brought to a vote
before a deadline passed.

Accuses EU of Colluding with Software Rivals
Brussels - The protracted antitrust battle between
Microsoft and the European Commission escalated this week after the
software giant accused the Commission of colluding with its rivals.
Microsoft claims the Commission established "inappropriate" contacts
between its competitors and Neil Barrett, the independent trustee
appointed to ensure the company's compliance with an EU ruling that
Microsoft abused its market position. The Commission was less than
amused with Microsoft's latest accusation. "If we pursue the line we
are following now, there will be fines, and they won't be small
fines," EU Competition Commissioner Neelie Kroes told Dow Jones
Newswires.

o AOL Says It
Won't Charge Non-Profits for Mass E-mail
Dulles, Va. - Responding to mounting criticism about its
plan to charge fees to senders of mass e-mails, America Online on
Friday said that it will withhold the fees for qualifying
not-for-profit organizations. The company said that non-profits will
have two options, either qualifying for AOL's program that handles
and delivers e-mail as if it were "certified," or using a
third-party accreditation service to authenticate their e-mail. AOL
said that it will pay the flat-rate, sign-up costs associated with
the third-party program. "We announce this today to make sure that
there is no further confusion or question about what not-for-profits
would need to do to be able to communicate to AOL members," said
Charles Stiles, AOL's postmaster. "There will be no requirement,
ever, for not-for-profits who deliver e-mail to AOL members to pay
for e-mail certification and delivery." The company recently
announced plans to charge senders of mass e-mails from 1/4 of a cent
to 1 cent per message, with the idea that spammers won't pay the
fee.

Promote Programming on YouTube Video-Sharing Service
New York - Viacom's MTV Networks has signed an agreement
with YouTube, a video-sharing site that has been criticized of late
for allowing users to post copyrighted content, and will distribute
promotional videos for MTV2 on the service, according to The
Hollywood Reporter. MTV2 will offer promotional clips for upcoming
seasons and DVD releases of series including "The Andy Milonakis
Show" and "Wonder Showzen." Recently, NBC Universal and CBS News
have requested that YouTube remove hundreds of copyrighted videos
from its site, consisting mainly of clips edited by users and posted
to share with friends. In addition to complying with copyright
holders' requests, YouTube now asks users uploading videos to verify
that they own the content they are posting, and has launched a
co-branded "premium content provider program." MTV2 is the first
partner for the program.

Acquires U.K.-based Developer Juice Games
Agoura Hills, Calif. - Video game publisher THQ has
acquired U.K.-based developer Juice Games, the studio that created
the "Juiced" racing franchise for THQ, GamesIndustry.biz reported.
Financial terms of the deal were not disclosed. Founded in 2003,
Juice Games has developed a number of titles for THQ in the past
several years, including several for mobile phones. The studio is
currently at work on a PSP title in the "Juiced" franchise called
"Juiced: Eliminator," for release in June.

San Francisco - Berkshire Hathaway, the Nebraska-based
investment firm run by financier Warren Buffett, said this week it
has completed its acquisition of San Francisco-based Business Wire,
a major distributor of corporate press releases and regulatory
filings on the Internet. Financial terms of the deal, first
announced in mid-January, were not disclosed. Business Wire will
operate as a unit of Berkshire Hathaway, with its management team
and day-to-day operations remaining unchanged. Lorry Lokey, who
founded Business Wire in 1961, will remain its chairman, but will
focus on philanthropic pursuits.

Worldwide Computer-Chip Sales Increase by 7%
London - Worldwide sales of semiconductors reached €16.4
billion ($19.7 billion) in January, 7% higher than the year before,
but 1.5% lower than December, according to new figures from the
Semiconductor Industry Association (SIA). The SIA said chip sales in
January fared relatively well after the holiday season. "The new
year got off to a good start for the global semiconductor industry
with strong year-on-year growth in a historically weak month," said
SIA President George Scalise. "Retail sales, including consumer
electronics products, were relatively strong in January and helped
dampen the expected seasonal decline in sales."

Wired News: Entice TV Offers Subscription HD IPTV Porn Service
San Francisco - Wired News on Friday reported on Entice
TV, one of the first providers of a subscription-based,
high-definition IPTV adult video service. The service offers
full-length videos in widescreen HD with 5.1 surround sound; a
standard 1.5 mpbs DSL connection can download a full-length HD
feature in 15 minutes, while a faster connection enables real-time
HD streaming. Entice TV charges $5 per month or $30 per year for the
service, while adult video studios charge an additional fee per
rental. "We think we will help drive the adoption of IPTV and
high-definition video," Entice president Susan Keil told Wired News.
"This gives people a reason to take advantage of their fast
connections and to push for developing even faster speeds. After
all, with e-mail it doesn't matter if you have 1.5 (mbps) or 20
(mbps), but with video it does."

New York - The New York Times recently reported on the
proliferation of online video "mashups" that parody the
Oscar-nominated film "Brokeback Mountain," appearing on
video-sharing sites including YouTube.com, GorillaMask.net and
DailySixer.com. Produced by amateurs or comedy troupes and design
shops, the mashups pair the music, themes and slow-motion cuts from
the trailer for "Brokeback Mountain" with clips from other films,
including "Back to the Future," "The Empire Strikes Back," "Heat,"
"The Lord of the Rings," "Titanic," "Fight Club" and "Point Break."
The combinations are then posted on the video-sharing sites with
titles like "Brokeback to the Future," "The Empire Brokes Back" and
"Point Brokeback."
