o Copyright Office Calls for Public Comment on Digital Music Licensing

Washington -- The U.S. Copyright Office on Friday called for public
comments on the interpretation and application of the industry's
mechanical and digital compulsory licenses for online music. The
mechanical license pays copyright holders for the physical medium a
recording is placed on -- which up to this point has either been vinyl for
records or plastic for cassettes and CDs -- and has now includes digital
files containing ones and zeros, such as an MP3. The compulsory license
has historically ensured that songwriters and composers are compensated
for their creations with royalty payments. The Copyright Office wants to
know the opinions of interested parties such as the RIAA, ASCAP and online
music companies, to see how it should apply these licenses to digital
music recordings. The Office is now seeking "public comment on the extent
of its authority to act, as well as the advisability of exercising any
such authority." It hopes to hear debate on, and clear up such issues as
whether or not a temporary copy that must be stored on a user's hard drive
to enable the streaming of music should be subject to royalty payments.

o AOL Germany to Pay Damages for Music Copyright Infringement

Munich, Germany -- A judge in Germany has awarded unspecified damages to
karaoke CD retailer Hit Box, which sued AOL in 1998 for allowing its users
to upload and share Hit Box music files on its service, Webnoize reported
on Friday. The company had originally sought a total of $50,000 in its
suit. German copyright law differs from U.S. law, which does not hold
Internet service providers such as AOL accountable for the actions of
users who log on to the Internet through its service. Sources say that AOL
was found liable because it advertised the music file-trading capability
to its users.

o Ticketmaster to Acquire Personal Event Organizer Evite.com

Los Angeles -- Ticketmaster announced on Friday that it will acquire
Evite.com, a website that lets users plan and organize gatherings through
email. Terms of the transaction were not disclosed. The Evite.com website
operations will be relocated to the Citysearch.com office in Pasadena.
Ticketmaster has implemented Evite.com's technology into Citysearch -- its
local restaurant, entertainment and events guide network of websites --
and plans to do the same for its Ticketmaster.com site. The service will
allow users who see an interesting concert, for instance, while visiting
Ticketmaster.com to inform their friends of the concert through email and
plan a group outing. "Our users can now easily go from inspiration to
action," said Josh Silverman, CEO, Evite, Inc.

o Game Developer WarCry to Merge with Crossroads Gaming Network

Cambridge, Mass. -- WarCry Corporation, an independent video game
developer and publisher, announced on Friday its intent to merge with
Crossroads Gaming Network, an Internet gaming community. The
stock-for-stock transaction will result in WarCry owning a controlling
interest in the company, with Crossroads becoming a wholly-owned
subsidiary. Crossroads will maintain its current management and
operations. Massachusetts-based WarCry enables gamers to participate in
the game development process while simultaneously allowing game developers
to publish their games independent of large publishers. The company said
it will work to improve Salt Lake City-based Crossroads Gaming Network's
infrastructure and advertising service capabilities as it combines the two
companies' communities.

o Sports Site HoopsTV Shuts Down

Rosemont, Penn. -- HoopsTV.com, a sports site that featured coverage of
academic-level and professional basketball, has shut down, VentureWire
reported on Friday. The company was reportedly in talks with ESPN to
develop one of its programs for television, but when talks fell through,
potential investors in the company's third round of funding pulled out.
"The revenues from the ads and sponsorship model couldn't support the
business," a source told VentureWire. Pennsylvania-based HoopsTV raised
$20 million in its second round of financing back in 1999. The company's
website is no longer accessible, but can be viewed via the temporary copy
stored on search engine Google's website.

(Denver) Texas-based Pla.net.com announced on Friday that it has acquired
Denver-based Third Stream Media, a provider of online sales and
communications tools, in an all-stock transaction. The company's
operations will be relocated to Denver, and a new Board of Directors has
been elected. Third Stream will be responsible for building retail sales,
inventory, distribution, and marketing for an Internet-enabled in-store
kiosk product. The kiosks will allow traditional retailers to sell over
one million products, including CDs, digital downloads, concert tickets,
videos, DVDs, books, and video games.

(Redwood City, Calif.) Napster said it will soon launch marketing
initiatives with TVT Records, one of the record labels that chose to drop
its copyright infringement claims against the company and license its
music for trading on the file-sharing service. Napster will advertise
promotional downloads from TVT artists -- including an unreleased remix of
a track from the "Snatch" soundtrack from the band Klint -- accompanied by
a link to a contest on TVT's website.
