o NY Times: Amazon in Talks With
Studios on DVD Download/Burning Service
New York - The New York Times reported on Friday that
online retail giant Amazon.com is in talks with three Hollywood
studios on launching a service that would let users download movies
and TV shows and then burn them to DVD. The Times cited "three
people briefed on the discussions," who said Paramount, Universal
and Warner Bros. were involved. So far, no online video-on-demand or
movie download service licensed by the studios has allowed users to
burn downloaded movies to DVD. Amazon is already a large retailer of
the physical DVDs released by the studios, and has long been rumored
to be considering such a download service, as well as a mail-order
DVD rental service that would compete with Netflix and Blockbuster.
The Times said one advantage Amazon would have in the market is its
ownership of the movie information database IMDB.com, which counted
15.1 million unique users last month.

Fans Face 11 Years in Prison for Posting Pre-release Album Online
Nashville, Tenn. - Two fans of alt-country singer Ryan
Adams have been indicted on federal copyright infringement charges,
for breaking a new law that makes it a felony to post copyrighted
music or movies on the Internet before their commercial release.
U.S. Attorney Jim Vines and My Harrison of the FBI's Memphis
Division allege that Robert Thomas, of Milwaukee, and Jared Bowser,
of Jacksonville, Fla. obtained and made portions of "Jacksonville
City Nights," an album from Ryan Adams & the Cardinals on Universal
Music Group's Nashville-based Lost Highway Records, available on a
website frequented by Ryan Adams fans months before its official
release in September 2005. The two men have been indicted under the
Family Entertainment and Copyright Act (FECA), and if convicted each
face a maximum of 11 years in prison. "Theft of music, trade secrets
and other intellectual property victimizes the creators of such
works, who have a legal right to determine how their work is
distributed," said U.S. Attorney Jim Vines. The case was
investigated by the FBI and is being prosecuted by the Computer
Hacking and Intellectual Property Section (CHIPS) of the U.S.
Attorney's office. "We commend Congress for giving prosecutors the
tools they need to achieve swift and successful enforcement of this
devastating form of piracy," said Recording Industry Association of
America CEO Mitch Bainwol.

Airlines Subpoenas YouTube, Google Video Over Training Video
San Francisco - American Airlines has filed subpoenas
seeking the identities of persons who uploaded portions of its
copyrighted training videos to video-sharing site YouTube and Google
Video, CNET News.com reported. The airline maintains that the
persons who posted the video violated the Digital Millennium
Copyright Act, and have made requests authorized under that law that
their identities be turned over -- similar to the actions taken
against file-swappers by the music and movie industries.
Representatives from both companies told News.com that they will
comply with valid subpoenas and applicable laws. Recently, YouTube
has respected requests from ABC and NBC to remove copyrighted video
from its network, with no legal action taken. The video-sharing site
tells users they may not upload material for which they do not own
the copyrights.

Nasdaq Delisting Notice
New York - Struggling video game publisher Atari announced
this week that it has received notice from the Nasdaq that it is not
in compliance with the minimum $1 share price requirement, and is in
danger of being delisted from the exchange. The company has until
August 30, 2006 to maintain a $1 minimum share price for at least
ten days, or its shares will be delisted from the Nasdaq -- at which
point they would likely begin trading on the exchange's
Over-The-Counter bulletin board. New York-based Atari, a unit of
France-based Infogrames, saw its shares tumble after reporting much
weaker-than-expected sales in its most recent quarter. Since being
founded in 1972, the company has published over 1,000 game titles.

to Test Internet TV "Multicasting" System
London - The BBC announced that it has teamed up with U.K.
broadcaster ITV to test a new "multicasting" system that will allow
the continuous broadcast of TV channels over the Internet. The
system would allow thousands of people to watch a program
simultaneously using a single signal. As it is, viewers can only
watch programs online by downloading them using individual feeds.
The BBC said the trial could soon pave the way for the whole country
to watch live TV on the Internet.

U.S. Broadband Market Reaches 41.2 Million Subscribers in '05
Arlington, Va. - The U.S. broadband market has grown from
4.5 million subscribers in 2000 to 41.2 million subscribers last
year, according to a report from the Telecommunications Industry
Association (TIA). The organization said that it expects the market
to reach 69.2 million subscribers by 2009. For the first time last
year, the TIA said that more new broadband subscribers signed up for
DSL than for cable -- a trend that it doesn't expect to continue,
with cable prices now falling faster than those for DSL.

o EU Defends
Trustee Neil Barrett against Microsoft Criticisms
Brussels - The European Commission has come out in defense
of Neil Barrett, the independent expert in charge of overseeing
Microsoft's compliance with a landmark 2004 antitrust ruling.
Microsoft has openly questioned Barrett's impartiality in recent
weeks, demanding that the EU to disclose correspondence between him
and Microsoft's rivals. The Commission, however, rejected
Microsoft's claims. The Commission said Barrett was entitled to
gather views on compliance through contacts with not only Microsoft
engineers, but also "potential beneficiaries". "The trustee's
contacts with such potential beneficiaries are therefore part of his
obligations under the trustee decision and not in any way a form of
inappropriate collusion as has been suggested," the Commission said.
