o RIAA May Have to Pay Damages in MP3Board Case

San Rafael, Calif. -- MP3Board, operator of a website that provides a
search engine that returns hyperlinks to MP3 files on the Internet,
announced on Monday that a U.S. District Court has denied the RIAA's
(Recording Industry Association of America) motion to dismiss its claim
for damages when MP3Board's list of music files was taken down for ten
days in April 2000. The site was taken down when the RIAA sent a "takedown
notice" to MP3Board under the provisions of the Digital Millennium
Copyright Act. The ruling implies that the RIAA's notice was not valid
because it didn't comply with the rules set forth in the DMCA for such
takedown notices. "MP3 Board has alleged sufficient activities by the RIAA
which, if proven, would make out a prima facie case that the trade
association sent notices to MP3 Board's service providers with the
intention of disrupting MP3 Board's contractual relationships," Judge
Sidney H. Stein wrote in his ruling. A trial on the merits of the case is
set for late May; however, MP3Board said in its statement that it is
actively seeking a settlement with the RIAA.

o Secret Service Busts CD Piracy Ring in New York

New York -- The U.S. Secret Service has raided and seized computers, CD
burners and printers from a group of alleged CD pirates in New York that
had the means to produce almost three million illegal CDs per year.
Working with the RIAA's New York anti-piracy unit, the Secret Service took
102 CD burners along with 20,000 recorded CD-Rs and 1,200 master
recordings of artists like the Beatles, Jay-Z and Jennifer Lopez. The RIAA
estimated that sales losses from this one pirate operation could have cost
it over $47 million annually.
