iTunes Law "State-Sponsored Piracy"
San Francisco - A day after French lawmakers gave
preliminary approval to a bill that would force Apple to allow songs
purchased from its iTunes Store to play on devices other than the
iPod, the company issued a statement calling the move
"state-sponsored piracy," CNET News.com reported. "The French
implementation of the EU Copyright Directive will result in
state-sponsored piracy," Apple said in the statement. "If this
happens, legal music sales will plummet just when legitimate
alternatives to piracy are winning over customers. iPod sales will
likely increase as users freely load their iPods with
'interoperable' music which cannot be adequately protected. Free
movies for iPods should not be far behind in what will rapidly
become a state-sponsored culture of piracy." If passed in the French
Senate, the law would force Apple to reveal its closely-guarded
FairPlay digital rights management technology to competitors, or
else possibly shut down its iTunes Store in France. Gene Munster, a
senior analyst with Piper Jaffray, speculated in a research note on
Tuesday that France likely accounts for less than 2% of Apple's
worldwide iPod and iTunes business. The French law would more
broadly apply to all digital services, such that Sony or Microsoft
would not be able to establish a monopoly that links distribution
channels with playback devices.

Acquire High-Performance Gaming PC Maker Alienware
Round Rock, Texas - PC maker Dell announced on Wednesday
that it will acquire Alienware, a maker of high-end gaming PCs.
Financial terms of the deal were not disclosed. Dell said Alienware
will become a subsidiary and maintain its own product line,
management team, and marketing and sales staffs. "Alienware's
products are an excellent complement to Dell's own line of
high-performance computers designed for gaming, enthusiast and media
content customers," said Dell chairman Michael Dell. Founded in
1996, Alienware makes high-performance designer PCs -- some are
shaped like alien heads -- that cost between $3,000 and $4,000, and
are marketed to PC gamers and multimedia enthusiasts. The company
saw sales of $172 million in 2005, and expects that number to
increase to $225 million this year.

Software Installed Base Gaining on RealPlayer
Manhasset, N.Y. - Apple's iTunes music player software is
approaching the installed base of rival RealNetworks' RealPlayer,
but both remain far behind Microsoft's Windows Media Player,
Information Week reported, citing Nielsen/NetRatings data. The
number of iTunes users has more than tripled from 2005 to 2006 --
from 5.4 million to 18.6 million -- while RealPlayer counted 28.7
million users in January. If the iTunes user base continues this
rate of growth, it will overtake RealPlayer later this year. Both
media player applications are dwarfed by the installed base for
Windows Media Player, which ships with every PC containing
Microsoft's Windows operating system; the application claimed 71.1
million users in January. However, iTunes users on average spend
more time using the software -- 111 minutes -- compared to the 46
minutes logged per session by RealPlayer or Windows Media Player
users.

Michigan Pension Fund Files Class Action Against Take-Two
Interactive
Detroit - The City of Flint, Michigan's pension fund has
become the latest entity to file a class action lawsuit against
"Grand Theft Auto" video game publisher Take-Two Interactive. The
suit alleges the company deceived investors with its inclusion of a
sexual mini-game within "Grand Theft Auto: San Andreas" that caused
the game to be removed briefly from store shelves and given a
stricter rating. Flint's retirement board reportedly invested
$524,000 in Take-Two shares, and lost $176,000 on its investment --
allegedly as Take-Two company officials were selling their own
shares. "Fraud against the taxpayers of Flint and our retired Flint
police officers and firefighters will not be tolerated," said Flynt
Mayor Don Williamson. The city's class action is one of many that
have been filed against Take-Two over the "Hot Coffee" mini-game
scandal, which is also the subject of a FTC investigation.

to Hold Online Contestant Screening Quiz
Los Angeles - The producers of TV quiz show "Jeopardy"
will later this month for the first time allow hopeful contestants
to take a preliminary quiz online, which will serve as the first
round of testing toward appearing on the show, according to The
Hollywood Reporter. The 50-question general knowledge exam will be
offered online from March 28-30, with each time zone getting
different questions on different days. "Our online testing process
allows our many viewers the opportunity to take the test from their
very own computer, at home, at the office -- virtually anywhere,"
Jeopardy executive producer Harry Friedman told THR. About 400 of
the 25,000 hopefuls who go through the Jeopardy's screening process
appear on the game show each year.

Launches New Finance Site to Complete with Yahoo, MSN
Mountain View, Calif. - Hoping to take a share of the
audience away from rivals such as Yahoo and MSN, Internet search
giant Google has launched the beta version of its new finance site,
Google Finance. The free site allows users to search for financial
information about public and private companies, as well as mutual
funds. The company said that the site will incorporate stock prices
with relevant news -- through Google News -- and blog postings in an
attempt to add insight as to why a stock has moved. Though the tool
is mostly focused on the North American market, Google said that it
also will include some international content on markets in
Amsterdam, Brussels, Lisbon, Paris and Toronto.

San Jose, Calif. - Ageia Technologies, a developer of
hardware-accelerated physics for video games, announced on Wednesday
the availability of its PhysX processor, designed to power pervasive
real-time physics in PC games. The chips are immediately available
on gaming PCs from Dell, Alienware and Falcon Northwest, and will
offered as add-in boards from manufacturers beginning in May.
Mountain View, Calif.-based Aegia said more than 100 games that
support the PhysX processor are currently in development, from

THQ Ships 3 Million Units of "Tak," Releases "Worms: Open Warfare"
Agoura Hills, Calif. - Video game publisher THQ announced
on Wednesday that its "Tak" video game franchise, an original
property developed by Avalanche Software, has now sold over three
million units worldwide. Nickelodeon is also developing a TV series
based on the games, featuring the voice talent of Hal Sparks and
Tommy Davidson, that will premiere with 15 episodes in 2007.
Separately, THQ said it has shipped its "Worms: Open Warfare" title
for Sony PSP and Nintendo DS to retailers. Developed by U.K.-based
Team 17, both versions offer wireless multiplayer modes.

that it signed a deal with Universal Studios Consumer Products Group

a mobile version of Electronic Arts' "The Sims 2" game. The title is
