o RIAA Says "Archaic" Napster Filter "Utterly Failing" to Block Songs

Washington -- The Recording Industry Association of America's report on
Napster's filtering of copyrighted songs required by a preliminary
injunction against the company says that Napster's "archaic" filtering
system is not working. The report says that the text-based filter in place
is not blocking all spelling variations of song titles and filenames, and
that the limited success of the filter is not enough. The RIAA suggested
that Napster either add such elements as identifying songs based on "MD5
checksums" -- a unique identifier of MP3 files that does not depend on how
individual users name their files -- or "audio fingerprinting" technology
that identifies unique aural elements in the song itself. "Napster has
flagrantly and intentionally refused to comply with the Preliminary
Injunction," the RIAA wrote in its report. "It is respectfully submitted
that this Court should order Napster to comply fully and immediately by
(a) implementing a "filtering in" system or (b) implementing an effective
"filtering out" system." Napster CEO Hank Barry responded to the RIAA
report in a statement. "The RIAA's call for a fundamental change in
Napster's technology is unsurprising: It is an attempt to change the
subject rather than cooperate with Napster as the injunction specifies,"
said Barry. The parties are due in court again on April 10.

o Film Industry Software Firm Creative Planet Lays Off a Third of Staff

Los Angeles -- Creative Planet, a provider of software tools for
entertainment industry companies, has laid off about a third of its staff,

current market conditions and looming strikes by actors and writers, which
could seriously limit the number of new film, television and commercial
productions, as reasons for the layoffs. Los Angeles-based Creative Planet
said that it will offer the laid off employees four weeks of severance pay
and health benefits through April. The company -- which operates
informational resources and markets proprietary software such as Movie
Magic Producer to industry clients -- raised $30 million in December.
