o Beatles Catalog Going Digital

London - The Beatles' lucrative catalog will soon be sold in digital form online, according to the director of the band's Apple Corps record label, Reuters reported. Neil Aspinall, the band's road manager and now head of Apple Corps, testified that the catalog is being digitally remastered, during the label's case against Apple Computer -- over that company's forays into the music industry. "I think it would be wrong to offer downloads of the old masters when I am making new masters," Aspinall testified. "It would be better to wait and try to do them both simultaneously so that you then get the publicity of the new masters and the downloading, rather than just doing it ad hoc." An Apple Corps spokeswoman confirmed for Reuters that the label will make Beatles songs available from online retailers, but dot not specify a date.

o Youth-Focused Cellular Network Amp'd Mobile Raises $150 Million

Los Angeles - Amp'd Mobile, a youth-focused mobile virtual network operator, announced on Thursday that it has raised $150 million in its third round of venture capital financing. Participating in the round were new investors Intel Capital, Tudor Investments, Rho Ventures, Qualcomm, Quilvest Ventures, Polygon Investment Partners and Heights Capital Management; previous investors MTV, Universal Music Group, Highland Capital Partners, Columbia Capital and Redpoint Ventures also contributed. Los Angeles-based Amp'd offers a cell phone service that includes exclusive music, video, sports and games content that is geared towards the youth and young professionals markets. The company, whose content partners include MTV and Universal Music, plans to launch its service nationwide by the end of the year.

o Fifteen States Now Tax Downloads of Digital Music, Other Media

San Francisco - Fifteen states and the District of Columbia now impose taxes on downloaded music, movies and books, and other states are considering following suit, CNET News.com reported. Among those states that currently tax downloads are Texas, Indiana and Washington, while proposals to expand taxes to include downloads exist in New Jersey, Vermont and Rhode Island. "More states are beginning to tax downloaded products," Steve Krantz, of the Council on State Taxation, told News.com. "Some are doing it through specific legislation. Others are doing it through the interpretation of previous law." Spokespersons for the states of California and New York both told News.com that they don't believe downloadable music and other media is taxable because it is not tangible property. "We don't use any state or physical resources other than the networks over which the digital goods travel, so it's pretty hard to justify their requirement to tax at the state level on digital sales," David Pakman, CEO of digital music retailer eMusic.com, told News.com.

o Report: 12% of U.S. Population Listens to Internet Radio

New York - The U.S. Internet radio audience has grown 50% over the past year, evinced by the fact that an estimated 12% of the population (about 30 million people) reported having listened in the past week -- up from 8% in 2005 -- according to a report from Arbitron and Edison Media Research. The study also found that nearly 20% of 18-34 year-olds listened to Internet radio in the past week. "Consumers are quickly embracing radio’s digital platforms and this new research reveals that these advertising vehicles are becoming increasingly viable," said Bill Rose, senior vice president of marketing for Arbitron.

o XM Satellite Radio to Refinance Debt

Washington - XM Satellite Radio, a subscription radio service with more than 6.5 million subscribers, said on Thursday that it plans to refinance its debt and establish a $230 million revolving credit facility. Under the refinancing, the company plans to replace higher interest debt with new lower interest debt, lowering its ongoing interest expenses and extending the maturity dates. XM said that it has launched a cash tender offer for notes due in 2009 and 2010, with the offer set to expire on May 10. Once that deal closes, the company said that it expects to open the credit facility with an unnamed group of banks and financial institutions.

o 102,000 Disney-branded DVD Players Recalled Over Battery Pack Hazard

Washington - Over 100,000 battery packs sold with Disney-branded portable DVD players have been recalled, due to a risk of overheating and possibly bursting while recharging. The U.S. Consumer Product Safety Commission, along with China-based battery manufacturers McNair Technology and Unitech Battery, and Florida-based distributor Memcorp made the announcement on Thursday, adding that consumers should stop using the battery packs and contact Memcorp for a replacement. Some 17 battery packs have already caused various injuries. The DVD players -- which feature characters such as Mickey Mouse or the Power Rangers -- were sold at electronics retailers and Disney theme parks for between $70 and $130 from April 2005 through March 2006.

o Open Source Blogging Software Firm Automattic Raises Funds

San Francisco - Automattic, a San Francisco-based developer of open source blogging technologies, said on Thursday that it has raised an undisclosed amount in its first round of funding. Polaris Venture Partners led the round, which also included participation from Blacksmith Capital, CNET and Radar Partners. The company said that it will use the funding for product development and service infrastructure. Founded in August 2005, Automattic is a startup best known as the creator of the WordPress blogging platform and the Akismet blog spam blocking technology.

o Robotic Vending Machine Firm Zoom Systems Raises $10 Million

San Francisco - Zoom Systems, a San Francisco-based maker of 40-square-foot robotic vending machines that sell consumer electronics and other items in places like airports, hotels and malls, said that it has raised $10 million in its third round of funding, led by Goldman, Sachs & Co. Also participating in the round was Zoom's chairman, Bruce Quinnell, the former vice chairman, president and COO of retailer Borders Group. The company's robotic stores are located in high traffic areas, and allow shoppers to select products through a touch screen graphic interface. They can pay for items with a credit or debit card and receive them from a robotic arm. All of Zoom's stores are networked and centrally monitored. Sierra Ventures and NeoCarta Ventures led earlier rounds of financing for Zoom.

Santa Monica, Calif. - Giant Mobile, a publisher of adult entertainment content for cell phones, announced on Thursday that it has sued Hustler publisher Larry Flynt's LFP Inc. for breach of contract, and is seeking damages of $23 million. Santa Monica, Calif.-based Giant claims that LFP reneged on its deal to license Hustler and other LFP content to Giant for mobile distribution, and further, that "LFP and its new licensee were undermining Giant's relationships with its distributors of adult mobile content even before LFP sought to terminate its agreement with Giant."

The U.K. Association of Independent Music (AIM), a collection of independent record labels, has signed an online distribution agreement with Chinese Web portal SINA.com, the BBC Online reported. The deal -- which will bring no profits to the labels -- will make free streaming music and music video clips available to SINA.com visitors. AIM told the BBC it plans to vet all tracks offered for sex and drug references.

Emeryville, Calif. - Orb Networks on Thursday introduced its DVR Everywhere application, which allows TiVo Series 2 digital video recorder owners to access their recorded shows from any Internet-connected device. Users can play and also program TiVo recordings from their mobile phones, as well as from any Internet-connected PC. "I can watch [recorded shows] at work, stream them to my Nokia phone on Cingular here in the U.S., or remotely initiate a TiVoToGo transfer to my laptop's TiVo Desktop to watch them on the flight back from Japan," said Orb Networks vice president of marketing Ian McCarthy.

o LA Times: 10 Million Howard Stern Listeners Aren't Sirius Subscribers

Los Angeles - The Los Angeles Times recently reported on the missing members of Howard Stern's radio audience, as only an estimated 1 or 2 million of his 12 million terrestrial radio listeners have subscribed to Sirius Satellite Radio, where his show now resides. Stern's replacements -- David Lee Roth on the East Coast and Adam Carolla on the West Coast -- are registering less than a fifth and a quarter of Stern's audience, respectively, on his former stations. A poll conducted by a Michigan-based rock radio consulting firm found that more than half of Stern's former audience from 79 rock stations have migrated to established programs similar to Stern's.
