o Injunction Prohibits RecordTV.com from Streaming TV and Movies

San Rafael, Calif. -- RecordTV.com, a site that allowed users to record
streaming versions of TV shows and movies, has settled lawsuits brought
against it by the major movie studios and TV networks. An injunction
issued against the company as part of the settlement prohibits
RecordTV.com from offering its "Internet VCR" service. No damages will
have to be paid to the studios or networks for alleged copyright
infringements. San Rafael-based RecordTV.com will pay only $50,000 to
partially cover its opponents' attorney fees. "I am pleased, after nine
months of litigation, that this case has been resolved," said David Simon,
CEO of RecordTV.com. "RecordTV.com has always wanted to work with the MPAA and its members to implement an online VCR and the cloud of litigation has
always acted as a roadblock to industry cooperation and the raising of
venture capital. I am hopeful that one day, the right balance between
copyright protection, security, and consumer access will be achieved, such
that software based Internet VCRs will become a regular part of everyday
life."

o Yahoo Names Former Warner Bros. Executive as New CEO

Santa Clara, Calif. -- Web portal Yahoo announced on Tuesday that former
Warner Bros. chairman and co-CEO Terry S. Semel has been named as the
company's new chairman and CEO. Semel will take over for current CEO Tim
Koogle in May, when Koogle will temporarily become vice-chairman and then
sit on the company's board. Yahoo also said that Semel has purchased one
million shares of the company's stock. "[Semel] helped build one of the
world's largest and most successful media enterprises and has established
and operated diverse global businesses at large scale," said Yahoo
co-founder Jerry Yang. "His marketing expertise, brand building strengths,
creativity, passion for our business, and reputation for setting and
achieving high standards and goals while driving winning strategies, makes
Terry the clear choice for this role." Santa Clara-based Yahoo announced
last week that its earnings would narrowly beat analysts' forecasts; it
also said that it would lay off 12 percent of its staff.

o RIAA Labels License Songs to Kickworks for Web Radio

New York -- The Recording Industry Association of America (RIAA) announced
on Tuesday that the major labels it represents have licensed their songs
to San Francisco-based Kickworks, which is creating an online radio
network scheduled to launch late this year. The license will allow
Kickworks to play songs from the major labels' catalogues, keeping to the
terms of the Digital Millennium Copyright Act -- meaning users can not
choose which songs they want to hear other than by choosing a particular
station's format. Kickworks users will be able, however, to create
"DJ-styled programs," and include "their own radio programming, including
music, speech, jingles and other program content." Kickworks was founded
in May 2000 by radio industry professionals Matt Hackett and Fred Goforth.

o Listen.com Launches Search Service Compatible with Napster

San Francisco -- Digital music site Listen.com announced on Tuesday the
availability of its Listen Seeker software, which can be used in
conjunction with Napster to coordinate searches using both services'
indices of songs at the same time. San Francisco-based Listen.com has
received funding from all of the major labels, and the company makes clear
that its new software does not run the Napster search or distribute any
files -- which would contradict the labels' current lawsuits against
Napster. When a user searches using Listen Seeker, the program returns
recommended similar artists, bios, reviews, tour date information,
hyperlinks to radio stations and discographies. It also provides links to
downloads and videos by 200,000 artists through a connection to the
Listen.com site.

o TV Producers Carsey-Werner-Mandabach Launch Venture Unit

Studio City, Calif. -- Carsey-Werner-Mandabach, a TV production and
distribution company that has created shows like "The Cosby Show" and
"That 70's Show," announced on Tuesday that it has formed CWM Ventures.
The unit will invest in "the exploitation of new technologies" associated
with digital advances in television, the company said. Studio City-based
CWM Ventures has already invested in and holds an equity stake in on-air
and online women's network Oxygen Media.

(San Francisco) RedHerring.com is currently featuring an article that
examines the major labels and studios recent announcements that they have
taken steps to launch subscription-based services to distribute movies and
music online. The article calls MusicNet's plan to launch this summer
"ambitious," due to such undetermined factors as songwriter royalties,
pricing and the ability to transfer content to portable devices. It also
points out that consumers are not likely to subscribe to multiple services
offered by a few studios or labels working together, but are more likely
to pay for a service like the pre-litigation Napster, which offered
content from all labels.
