o TiVo Wins $74 Million Patent Case Against EchoStar's DISH Network

Alviso, Calif. - TiVo announced that a federal jury has awarded the company $74 million in damages, ruling in its favor in a patent infringement lawsuit the company brought against EchoStar Communications, operator of the DISH Network satellite TV service. The jury found that EchoStar willfully infringed TiVo's patent on a "multimedia time warping system" used in its digital video recorder set-tops and corresponding service. The judge may choose to triple the damages EchoStar must pay as a result of the "willful" infringement finding, although EchoStar plans to appeal. "We believe the decision will be reversed either through post-trial motions or on appeal. Additionally, the Patent Office is in the process of re-examining TiVo's patent, having determined there is a substantial question concerning the validity of the patent," EchoStar said in a statement. TiVo plans to seek a permanent injunction against EchoStar's digital video recorders; the company's shares hit a 52-week high of $8.65 on Monday, riding news of the patent case win.

o Fox to Stream TV Reruns on Local Affiliate Station Websites

New York - Fox has signed a six-year agreement that will bring streaming reruns of Fox series to the websites of its local affiliates, the Wall Street Journal reported. Under the deal, the 187 local affiliate TV stations will receive 12.5% of revenues from the venture, which will offer Fox shows online on the morning after they are first broadcast on TV. The announcement comes shortly after Disney's ABC said it will soon offer free, ad-supported streams of some of its TV shows on ABC.com.

o Report: In-Game Ad Market to Reach $732 Million by 2010

Boston - The in-game advertising market is projected to reach $732 million by 2010, up from $56 million in 2005 and $34 million in 2004, according to a report from Boston-based market research firm Yankee Group. The number of video game titles that feature in-game ads is expected to double, to around 200, by the end of 2006. Currently, third parties such as Massive Incorporated, Double Fusion and IGN Entertainment provide the technology to deliver in-game ads in titles from game publishers including Activision, Ubisoft and Electronic Arts. Yankee Group predicts that Microsoft, Sony and Electronic Arts will eventually serve their own in-game ads. "Although the in-game advertising market is still relatively untapped, its promising business model will lead to swift market development," said Yankee Group senior analyst Michael Goodman. "Effectively competing in the interactive gaming market for the video game and advertising communities requires careful attention to the intricacies of the industry."

o Major League Gaming Signs Sponsors; Competitions to Air on USA Network

New York - Major League Gaming, a league for professional video game players, announced on Monday that it has signed Scion and Boost Mobile as sponsors, and will air its entire 2006 season on USA Network. Boost Mobile, a mobile virtual network operator, will offer its 2.6 million subscribers access to pro player profiles, video diaries and match play highlights. Major League Gaming will hold competitions in seven cities in 2006, including Dallas, Atlanta, Los Angeles, Philadelphia, Chicago and Las Vegas, with seven one-hour tournament specials to be broadcast on USA Network. The league will award winning teams and players over $800,000 in cash and prizes during the 2006 season.

o XM Satellite Radio to Raise $600 Million Through Debt Offering

Washington - XM Satellite Radio, a provider of satellite radio services with more than 6.5 million subscribers, said on Monday that it plans to raise $600 million in debt. Specifically the company is planning to sell senior notes due in 2013 and 2014 to institutional buyers, using the proceeds to retire debt scheduled to mature in 2009 and 2010. XM said that the moves will simplify its capital structure, as well as lower its ongoing interest costs and extend the maturity dates of its debt portfolio.

o AOL to Carry Chinese-Language News Programs

Dulles, Va. - Three years after abandoning its initial Chinese venture, AOL will begin carrying Chinese language news programs through a deal with Shanghai Media Group, Reuters reported on Monday. The companies said that AOL will carry more than three hours of free programming a day on its Chinese site. Norman Koo, a web strategy executive with AOL, said that the move will allow his company to "better serve the millions of people in the United States who want access to critical features and communications tools, especially the latest news and entertainment video, in Chinese." The companies said that they plan to eventually launch fee-based services in Chinese, as well. AOL initially targeted China in 2001 through a partnership with Lenovo Group, but was forced to scrap the project in 2003.

o CNET to Launch Video-on-Demand Service

San Francisco - CNET, the San Francisco-based technology media company, on Monday announced plans to launch a new video-on-demand service packaging a selection of the network's video content for distribution on television and online. The service, to be known as "CNET TV," will launch initially with partners Cox Communications, TiVo and TVN Entertainment, as well as on CNET, in the second half of this year. CNET said that it has seen more than a 100% increase in the number of its videos downloaded from its various sites over the past year. The partnerships follow a successful trial run with TiVo.

Beverly Hills, Calif. - iOnline DVD rental firm Netflix announced on Monday that it has appointed Bahman Naraghi as vice president and head of original content, who will oversee the company's push into acquiring independent film and TV properties. Previously, Naraghi was chief operating officer Intermedia Film, and before that was executive vice president of finance and operations at Miramax Films. Los Gatos, Calif.-based Netflix plans to acquire and distribute independent films directly to its 4.2 million subscribers; last week, the company acquired the documentary "The Bituminous Coal Queens of Pennsylvania" from FourBoys Films.

o CNET News.com: Little-used V-chip Updated for Digital TV

San Francisco - CNET News.com on Monday reported on the V-chip, the TV filtering technology parents can use to control what programs their children watch, which Congress in 1996 mandated that all TV makers must install. A 2004 Kaiser Family Foundation study found that only 15% of parents have ever used the V-chip, while the Ad Council estimates only 8% use the technology. A new version of the V-chip, which must also be installed in set-top boxes and DVD players that can receive a digital TV signal, will be required next year.
