Maintain 99 Cent Song Downloads
New York - Apple Computer has succeeded after months of
negotiations with the major record labels in keeping the price of
digital song downloads at 99 cents for the time being, the Financial
Times reported. Details on the term length of the new agreements
have not been made public. Several label executives at Warner, EMI
and Sony have called for variable pricing that would discount
catalog releases, and allow the labels to charge higher prices for
new digital releases, prompting Apple CEO Steve Jobs to publicly
label the industry as "greedy". Some label executives privately
acknowledged to FT that they "have little leverage over Mr. Jobs."
Apple's iTunes Store accounts for around 80% of U.S. digital music
sales.

Covers Satellite Radio Recording, "Fair Use" of Video
San Francisco - CNET News.com reported on Tuesday that a
draft of a comprehensive Senate telecommunications bill released on
Monday includes a ban on satellite radios that permit unfettered
recording of music, in addition to some "fair use" provisions that
would allow sharing of digital video. Under the bill, proposed by
Senate Commerce Committee chairman Ted Stevens (R-Alaska), the FCC
would be granted the power to outlaw digital radios available today
that can record content without respecting content owners'
copy-protection rules. However, the bill makes concessions to
traditional "fair use" rights consumers have enjoyed with video,
allowing programs to be shared over home networks, and "short
excerpts" to be posted online. A source close to Hollywood told
News.com that "the movie industry has real problems with the
broadcast flag language as it appears in the bill." The telecom bill
is not likely to be taken up this year, with elections looming in
November.

Issues Final Settlement in Netflix "Throttling" Class Action Suit
San Francisco - A federal judge has approved a settlement
agreement in a class-action lawsuit brought by subscribers of online
DVD rental service Netflix, that will award a free month of rentals
to 5.5 million current and former subscribers, the Associated Press
reported. Filed in 2004, the suit accused Netflix of misleading
customers with regard to its delivery policies. The company was
found to give preferential treatment to less frequent renters, as
compared with those who quickly return their movies and thereby
increase the company's costs -- in a practice dubbed "throttling".
An earlier version of the settlement was criticized by the FTC
because customers who accepted the free month of service were
automatically billed for additional months after the free period.
The final settlement was delayed while the judge determined payments
to lawyers for the plaintiffs, whose request for $2.5 million was
reduced to $1.3 million for the original team that filed the suit
and $60,000 for various other litigators. "We settled the case in
the best interest of all parties," Netflix spokesman Steve Swasey
told the Associated Press.

Youth-Focused Mobile Phone Service with MySpace Link
Los Angeles - Helio on Tuesday announced the launch of its
mobile virtual network, offering 3G cell phone service targeting
young consumers with multimedia features. Among other multimedia
features, Helio subscribers will be able to post photos and messages
directly from their phones to their accounts on the MySpace social
networking service; program live content feeds to be sent to their
phones from partners including MTV and The Onion; and purchase and
download mobile games for $5.99 each. The service runs on two
handsets, the $275 Hero and $250 Kickflip, with calling plans
ranging from $40 to $135 a month. "Helio is custom-built for the
lifestyle of young people who have their mobile device at the center
of their universe," said Sky Dayton, CEO of Helio and founder of
EarthLink. "With Helio, mobile is about staying connected in
innovative ways where sharing your world includes content like
videos and games, or unique personalization that you know your
friends will love." Los Angeles-based Helio said its service will be
available at 1,000 retail locations by the end of May.

Compensation
New York - Sirius Satellite Radio announced on Tuesday
that it added 761,000 subscribers during the first quarter and now
counts a total of 4.1 million customers for its subscription radio
service. The company now expects to have 6.2 million subscribers by
the end of the year. New York-based Sirius also said its quarterly
loss more than doubled, mainly due to $225 million in stock
compensation the company paid to host Howard Stern as part of his
deal that brought him to Sirius from terrestrial radio.

Nextel Launches Wireless "MyFoodPhone" Service
Reston, Va. - Hoping to appeal to diet-crazed Americans,
Sprint Nextel on Tuesday launched a new service that lets Sprint
subscribers with camera phones track their food consumption and
remotely access nutritional counseling. The service, known as
MyFoodPhone, prompts uses to take pictures of the food they eat at
each meal or snack and send them in for review by a nutritional
advisor. Customers, who pay $9.99 a month, then receive video
feedback on their eating habits biweekly. Clients also can log data
such as weight, exercise and calories burned on a special website to
track their progress through their phones

IPTV to Drive New Investment in Home Networking Technologies
New York - Telecom carriers are poised to invest heavily
in technologies that will distribute Internet protocol television (IPTV)
and other multimedia services throughout customer homes, according
to a major new report from Heavy Reading, the market research
division of Light Reading Inc. The emergence of IPTV is
"reinvigorating the home networking sector," which now includes
technology suppliers such as Alcatel, Cisco Systems, Microsoft,
Motorola, and Siemens, according to the report. Some of the
variables that will dictate the technology of choice for multimedia
whole-home networking products include factors such as existing
wiring, building materials, construction details, range and
throughput requirements, and sources of signal interference, Heavy
Reading said. Its report is based on direct interviews with more
than 30 service providers and technology suppliers.

Search Engine Firm Sphere Raises $3.75 Million in First Round
San Francisco - Sphere, a San Francisco-based developer of
a blog search engine, said on Tuesday that it has raised $3.75
million in its first round of venture capital, led by Trident
Capital. Sphere, whose website officially launched on Tuesday, said
that it plans to use the funds to scale its technology and business.
The company has developed a search tool that allows users to find
timely blog posts, which can be displayed by time or relevance.

San Diego - Movie theater chain UltraStar Cinemas
announced on Tuesday that its TownGate 8 theater in Moreno Valley,
Calif. will this week become the first in the world to have all
screens showing films in digital format. Beginning on Friday, the
theater will screen "Mission Impossible III," "Scary Movie 4," "Ice
Age 2," "Stick It," "Silent Hill," "RV" and "The Sentinel" in the
Pure Digital Cinema format. "It will be a very different experience
to be in our TownGate projection rooms with all the 35mm projectors

Santa Clara, Calif. - The High-Definition Audio-Video Network
Alliance (HANA), a cross-industry trade group developing standards
for home networks and HD content, said on Tuesday it will
demonstrate forthcoming technologies at the Connections Digital Home
Conference this week in Santa Clara, Calif. They include the ability
to view and record five or more HD channels simultaneously without
signal degradation; view stored HD content from anywhere in the
home; share HD content securely between PCs and consumer

Online Game "Entropia Universe" Launches Real-World ATM Cards
New York - The New York Times on Tuesday reported on a
new feature in the online game "Entropia Universe" that will let
players withdraw cash from real-world ATM machines, which will draw
on virtual currency stored in their online game accounts. Launched
in 2003 by Sweden-based developer MindArk, the game counts 250,000
players who generated an estimated $165 million in total economic
activity within the game last year. "We want this game to be a full
second reality," MindArk CEO Jan Welter told The Times. "We want you
to be able to have fun, make friends, make a business, enjoy music
and art and do it in our game. The ATM card is a big step toward
bringing people into our world because they can have comfort that
they can access their virtual funds immediately."
