o WSJ: New MPAA Study Puts Studio Piracy Losses 75% Higher

New York - The Wall Street Journal reported on Wednesday that new piracy figures from a study commissioned by the Motion Picture Association of America (MPAA) show studio losses from piracy to be 75% greater than previous estimates. Conducted by LEK Consulting, the study used more consistent methodologies in determining studio losses from piracy, citing annual losses of $6.1 billion, compared with earlier estimates of $3.5 billion. The Journal reported that infighting between MPAA member studios postponed the release of the report, as some felt the new numbers would negatively affect their stock prices and cast doubt on their anti-piracy efforts. The study also ranked Mexico higher than the claimed piracy havens of China and Russia, causing some skepticism about the results. The study blamed Internet-based piracy for $447 million in U.S. studio losses during 2005, compared with $335 million from professional bootleggers and $529 million resulting from consumers making copies of legitimate films on DVD or VHS.

o French Govt. Backtracks on Bill Forcing Apple to Open iTunes

San Francisco - The French government has backtracked on its position that Apple, Sony and other companies using closed digital rights management technologies must open them to other companies to ensure competition, CNET News.com reported. Some speculated this would compel Apple to shut down iTunes in France rather than reveal its FairPlay security technology to competitors. The French Senate had floated a bill that would have required Apple to open its iTunes store so that songs could be downloaded to other MP3 players; the law would have also applied to Sony's Connect online store and others that set up exclusive relationships between online services and electronics devices. This wording within the proposed legislation has since been removed, The Inquirer reported. The French Senate is due to begin debate on the bill Thursday.

o Another Video Game With Hidden Sex Content Given Stricter Rating

New York - Another video game has been given a more strict rating after it was discovered that players could unlock sexually explicit and more violent content hidden in its source code. The Entertainment Software Ratings Board (ESRB) said that the PC version of developer Bethesda Softworks' "The Elder Scrolls IV: Oblivion" will be raised from T (Teen 13+) to M (Mature 17+), following the revelation that a locked "skin" in the game's code can be unlocked by downloading a patch on the Internet. The skin introduces more detailed depictions of blood and gore than were considered in the original rating, and also allows users to play with topless versions of female characters. "Rating changes are extraordinarily rare, but if ever one does occur, ESRB recognizes that parents must be made aware of the change as quickly as possible so they are certain to have the most current and accurate information," said ESRB president Patricia Vance. The PC version of "Elder Scrolls" will now carry an additional content descriptor for "Nudity" until it can be re-mastered and released with the skin removed. A similar incident where a downloadable patch unlocked a hidden sexual mini-game within Take-Two Interactive's "Grand Theft Auto: San Andreas" caused the top-selling game to be removed from shelves and given an "Adults Only" rating -- the equivalent of an X-rated movie.

o Microsoft, TV Producer in Multimillion-Dollar Deal to Produce Web Pilots

New York - Microsoft has partnered with Hollywood producer Ben Silverman to create 10 Web pilot shows for MSN as part of its MSN Originals initiative, The New York Times reported. The multimillion-dollar deal with Silverman ("The Office," "The Biggest Loser") has already borne four original shows -- "Under the Influence," "Face Off," "Airplane" and "Chef to the Rescue -- that will feature product placements, and various e-commerce opportunities within online communities created around the shows. Under the deal, Silverman's production company Reveille will retain the right to develop any of the Web series into a television program, in which Microsoft will share revenues.

o Activision Faces Class Action Suit on Overtime Pay

Santa Monica, Calif. - Video game publisher Activision faces a class action lawsuit filed by employees who claim they are owed overtime pay. Filed by the Boston law firm of Shapiro Haber & Urmy, the suit follows the announcement of a $14.9 million settlement of a similar class action suit between Electronic Arts and its employees. That case brought to light the often endless weeks of long hours that employees who work on video games face, and differences in their classifications that deprive some of receiving overtime pay. The law firm handling the Activision class action also filed a similar suit against Sony Computer Entertainment America in early 2005. "Excessive overtime is endemic in the videogame industry, but we hope that this and other lawsuits will spur major changes in the way employers treat their employees," said partner Thomas Urmy.

o Class Action Suit Filed Against XM Satellite Radio

Washington - A group of shareholders is alleging that XM Satellite Radio misled investors about the price the company paid to reach its goal of 6 million subscribers last year. The news helped to drive the company's stock price down more than 5% on Wednesday to close at $17.50. According to the lawsuit, filed in U.S. District Court in DC, XM allegedly made "misrepresentations" about its ability to reduce the costs of new subscribers as it reached last year's goal. It further alleges that the company failed to disclose that those costs would rise, leading to large increases in the company's net losses.

o AOL Sees Drop in Revenue, Subscribers; Ad Revenue Rises

Dulles, Va. - As the company continues to tweak its business model, AOL on Wednesday said that its revenue last quarter dropped 7% to $1.98 billion, and that it lost 835,000 subscribers from the year before. AOL is in the process of de-emphasizing its dial-up Internet service while attempting to ramp up advertising revenue on its free AOL.com portal. Though subscription revenue dropped 13%, ad revenue on AOL.com rose 26%. That figure is only expected to rise as AOL's advertising partnership with Google kicks in. Google is investing $1 billion to acquire a 5% stake in AOL. As part of that deal, AOL will get $300 million worth of ads on Google's network.

o Ubisoft Announced Roster of Upcoming Titles on Display at E3

San Francisco - France-based video game publisher Ubisoft on Wednesday announced the roster of upcoming games it will preview at the industry's Electronic Entertainment Expo next week in Los Angeles. The company plans to show 10 titles for next-generation consoles, including "Assassin's Creed"; Gearbox Software's "Brothers In Arms: Hell's Highway"; "Dark Messiah of Might & Magic;" Japan-based FromSoftware's "Enchanted in Arms" for the Xbox 360; "Open Season," based on the animated film from Sony Pictures; "Rayman Raving Rabbids"; and "Red Steel" for Nintendo Wii. Santa Monica, Calif. - Video game publisher Activision announced on Wednesday that it has been awarded a license from MGM and EON Productions to develop and publish video games based on the James Bond film franchise through the year 2014. The license was previously held by rival Electronic Arts, which has generated sales of 30 million units of its James Bond 007 titles. World Wrestling Entertainment announced on Wednesday that it has developed a slate of original mobile entertainment content, including news, trivia, highlights and commentary on pro wrestling. San Diego - The makers of "Naughty America: The Game," a massively multiplayer online game that includes adult entertainment elements, said on Wednesday that they have been prohibited from exhibiting the title at next week's Electronic Entertainment Expo due to the game's "adult content." "We were very disappointed to learn of E3's stance toward Naughty America: The Game," said Noah Dudley, president of Eight Legs, the company overseeing the design and development of the title. "It's the next step in social networking and online matchmaking. It's certainly not intended for everyone, but then again neither are a number of the titles featured at the show." The title is slated for release this summer.
