o Snocap Signs Major Label EMI to
Legal Peer-to-Peer Song-Swap Database
San Francisco -- Snocap, the provider of song identification and
copyright management on peer-to-peer networks founded by Napster
creator Shawn Fanning, announced on Thursday that it has signed an
agreement major record label EMI Music. Under the deal, EMI will
register its songs in the Snocap database, which will then serve as
a rights clearance service for legal peer-to-peer file-sharing
networks and other digital retailers. "This sends a signal to music
industry critics who claim we are technophobic," said EMI chairman
and CEO David Munns. "If anything, we are embracing technologies
like Snocap, which allow the P2P community to share music legally.
It's a big step forward for fans, artists and copyright owners."
Fellow major labels Universal Music and Sony BMG have already signed
agreements with Snocap, which will provide songs to services like
Mashboxx -- a peer-to-peer start-up created by former Grokster head
Wayne Rosso slated to launch later this month.

Violent Game Sales to Minors Fail in California, Advance in Illinois
Los Angeles -- A bill that would have fined retailers for selling
M-rated video games to minors has failed in the California State
Assembly, while a similar bill has passed in the Illinois state
Senate's Housing and Community Affairs Committee. "It is evident
that most of the committee members recognized the obvious flaw with
the legislation -- that it is wholly unconstitutional," said Marie
Sylla, director of government relations for the Interactive
Entertainment Merchants Association, in commenting on the California
state bill. The approval of the Safe Games Illinois Act, which would
empower the state to create its own game ratings system, will now
move on to a vote in the full Illinois state Senate. State Sen.
Deanna Demuzio (D) told CNET News.com that the bill will not come to
a vote until the state clarifies how it plans to arrive on its
ratings, and determines fines for retailers who sell objectionable
games to minors. Court challenges to similar laws have consistently
resulted in their being overturned on First Amendment free speech
grounds.

TiVo, Humax for Infringing Digital Video Recorder Patents
Littleton, Colo. -- EchoStar Communications, which operates the
DISH Network satellite TV service, has filed patent infringement
claims against TiVo and Humax, two makers of digital video recorders
that let viewers pause and record live TV. The suit comes after TiVo
filed its own lawsuit against EchoStar in early 2004, claiming the
company is infringing on its digital video recording patent; that
case is headed for jury selection on Oct. 4. Littleton,
Colorado-based EchoStar's suit, filed on April 29 in a Texas
District Court, alleges that TiVo and Humax are infringing on four
of its patents.

Launches Video Search Feature, Adds Content Providers
Sunnyvale, Calif. -- Yahoo on Thursday officially launched its
free Video Search feature, concluding a beta test that began in
December, and announced the addition of new content from Buena Vista
Pictures, CBS News, MTV, Reuters, Scripps Networks and others. The
service indexes streaming and downloadable video content available
on the Internet, allowing users to locate clips containing keywords
they enter into the search engine. In addition to content from
outside providers, the Video Search includes movie trailers from
Yahoo Movies and music videos from Yahoo Music. Meanwhile, rival
Google's video search service is still undergoing beta testing,
which began in January.

o Survey: Majority of Parents Limits
Kids' Access to Mature Video Games
New York -- A survey of parents with children ages 3-17 found
that 78% overall said they are aware of the video game industry's
ratings system, and 53% "never" let their kids play video games
rated "M" for mature language, violence or sexual content.
Commissioned by the industry's own Entertainment Software Rating
Board (ESRB) and conducted by Peter D. Hart Research Associates, the
survey of 500 parents also found that 70% check the ratings before
buying games for their kids, even though 37% said they "sometimes
allow" their kids to play M-rated games; 54% of parents said they
additionally check the content descriptors on game packaging for
details on why each game is given its particular rating, in making
their decisions on whether to buy a game. "We believe that the
increase in awareness and resulting use of the content descriptors
is directly related to the more prominent display of content
descriptors on game packaging since 2003, and to the power and broad
exposure of a new consumer education campaign launched by the ESRB
illustrating both parts of the rating system in PSA advertisements,
retail signage and print circulars," said ESRB president Patricia
Vance.

o Australia's SkyNetGlobal Acquires
U.K.-Based Home Media Networks
Edinburgh, Scotland -- Home Media Networks, a developer of home
media center software under the ShowShifter brand, announced on
Thursday that it has been acquired by Australia's SkyNetGlobal, a
provider of wireless broadband access and home networking systems.
Financial terms of the deal were not disclosed. Scotland-based Home
Media Networks' software lets users play and record TV, and play
CDs, DVDs and MP3 files from a single interface for all home
entertainment devices; the company said the ShowShifter application
now counts over 1 million users. "Combining our software with
SkyNetGlobal's home automation hardware takes us another step closer
to our original vision for ShowShifter -- a one-stop-shop for all
your digital entertainment, wherever you are in the home," said Home
Media Networks chief technical officer Colin Tinto.

Calif.) PC maker Gateway on Thursday introduced the Gateway MP3
Photo Jukebox, a 6GB digital music player with a color display
capable of storing up to 1,500 songs, or 2,000 digital pictures.
About the size of a deck of cards, the player features a replaceable
rechargeable battery and supports Microsoft Windows Media Player 10
and the Napster To Go service -- which allows subscribers to
download unlimited songs to the device for $14.95 per month. Gateway
will sell the $249 MP3 Photo Jukebox from its website and at
electronics retailers.

(London) Loudeye, a provider of branded digital music download
stores and other digital media services, said on Thursday that it
has built a digital song download store for CD WOW, a U.K.-based
retailer of CDs, DVDs and other media. The site will offer downloads

launch of Nick Mobile, a cell phone TV channel featuring content
from Viacom's Nickelodeon children's cable TV network. Music videos

(New York) Major League Baseball Advanced Media said on Thursday
that it has suspended its Nationals.TV service, which promised live
in-market video webcasts of Washington Nationals games. The league
cited a potential conflict from a deal announced last week, that
will see Nationals games broadcast by DirecTV on the MidAtlantic
Sports Network. MLBAM said the Nationals.TV service has been
suspended "until further notice," while it examines whether the
games will have to be blacked out within the home market.

(New York) Heavy.com, a broadband entertainment network targeting
18-34 year-old men with an audience of 5 million monthly viewers,
announced on Thursday that Sony will offer thousands of hours of

it has signed Vincent Lecavalier, All-Star center for the NHL's
Tampa Bay Lightning, to serve as the cover athlete and spokesman for

season -- due to failed contract negotiations between players and
the league -- EA Canada developed the title for release on

release "EverQuest II Desert of Flames," the first expansion pack
for its massively multiplayer online roleplaying game, on Sept. 12.

(Beijing) USA Today on Thursday reported on the rampant state of
music piracy in China, where pirated CDs regularly sell alongside
authentic copies at legitimate music retailers and most artists
don't expect to receive any profits from album sales. The
International Federation of the Phonographic Industry (IFPI)
estimates that 95% of music sales in China are derived from pirated
CDs.

(San Francisco) PC World Magazine recently published an article
examining how electronics manufacturers are implementing the
"broadcast flag," which by federal mandate in July must be included
in all devices so that networks can block recording of video content
if so desired. Dennis Wharton, senior vice president of
communications for the National Association of Broadcasters, said
broadcasters are likely to begin transmitting "flagged" content in
July. "The networks have a long-standing interest in protecting
programming from mass distribution on the Internet," Wharton told PC
World. Devices that must adhere to usage rules contained in the
flags include DVD recorders, digital video recorders, PCs and HDTV
sets.
