o Apple Computer Wins U.K. High Court Dispute with Beatles' Record Label

London - Britain's High Court has ruled that Apple Computer may use its trademark bitten-apple logo in conjunction with its iTunes Music Store in the U.K., taking the computer firm's side in a trademark dispute with the Beatles' record label, Apple Corps. Judge Edward Mann said in his ruling that Apple Computer used the fruit logo in connection with the store and not with the music sold within the store, and thus did not breach a 1991 agreement the company made with the record label not to compete in the music industry. "I think that the use of the apple logo is a fair and reasonable use of the mark in connection with the service, which does not go further and unfairly or unreasonably suggest an additional association with the creative works themselves," Judge Mann wrote in his ruling.

o Warner Music Discloses Class Action Lawsuits Over Digital Price-Fixing

New York - Warner Music Group has disclosed in an SEC filing that 14 class action lawsuits have been filed against the company, over alleged price-fixing of digital song downloads amongst the major labels. Warner Music said in the filing that it "intends to defend against these lawsuits vigorously." Several months ago, New York State Attorney General Eliot Spitzer launched a separate probe into alleged digital music price-fixing. For its most recent quarter, Warner Music said digital music sales totaled $90 million -- nearly three times higher than the same period a year ago -- and represented 11% of total revenue.

o TV Affiliate Sites to Host Streaming Episodes of "Two and a Half Men"

Los Angeles - Warner Bros. Television Group plans to make streaming reruns of its CBS sitcom "Two and a Half Men" available for viewing on the websites of local TV stations that broadcast the program on-air, according to The Hollywood Reporter. The episodes will be free to watch and supported by ads running both in streaming and on-demand versions. Local stations or cable networks hosting the episodes will share in ad revenue. "No one has ever provided this before for local stations," Dick Robertson, president of Warner Bros. Domestic Television Distribution, told THR. "Everything until now has been through the networks' websites."

o NBA to Sell Highlights, Replays of Playoffs and Finals Games on iTunes

New York - The NBA announced on Monday that it will sell downloadable game highlights from the league's 2006 playoffs and finals on Apple's iTunes store. The 15 to 20-minute game recaps of broadcasts from ABC, ESPN, TNT and NBATV will be made available within 24 hours after each game's conclusion for $1.99 each. Complete game replays of every game of the NBA finals will also be offered, for $5.99. Another feature will allow fans to pick one team and receive full game recaps of every game that team plays through the finals for $8.99. Additionally, the NBA partnered with TNT to offer every episode of TNT's "Inside the NBA" through the Conference Finals for $8.99.

o Verizon Takes Stake in Online Games Technology Firm Super Computer

New York - Verizon announced on Monday that it has acquired an equity stake in Super Computer International, a provider of equipment and services for online video games. Financial terms of the transaction were not disclosed. The companies are developing an online game browsing and messaging platform called PlayLinc, whose features will include IM and VoIP, server browsing, team management, buddy tracking and player invitations. "The platforms we are devising will reset the standards and expectations of online game players while simplifying and accelerating their ability to build highly customizable gaming communities and personalized social networks," said SCI CEO Jesper Jensen. Verizon and SCO plan a public beta test of PlayLinc this summer, and will then make the platform available to other gaming providers.

o News Corp.'s DirecTV, IGN Partner on Pro Video Game League

El Segundo, Calif. - News Corporation's DirecTV satellite TV network and IGN Entertainment video game portal have partnered to launch a professional sports league for video game players. The Championship Gaming Series will launch in 2007, preceded by three tournaments in 2006 to be broadcast on DirecTV. Other partners in the venture include Microsoft's Xbox, Fox, Best Buy and Mountain Dew, which will sponsor the "Dew Cup" that will be presented to the league's top gamer team. The Championship Gaming Series will televise its league play, consisting of an ongoing series of competitions featuring the same roster of gamer teams. "This league will be unrivaled," said IGN Entertainment executive vice president and general manager Dale Strang. "In short, the CGS will treat its players in the same manner as traditional sports: huge prize money, instant payouts and massive media coverage using traditional and new media." The News Corporation-backed video game league will compete with existing leagues such as the Cyberathlete Professional League, Global Gaming League, Major League Gaming, Video Gamers League and rapper Snoop Dogg's Hip Hop Gaming League.

o TiVo Launches "Product Watch" Opt-In Video Advertising Service

Alviso, Calif. - TiVo on Monday launched "TiVo Product Watch," a new advertising search product that lets users opt-in to receive video content directly from various companies, and set up searches for their favorite brands. "TiVo Product Watch will, for the first time, enable TV viewers to get commercial information about a product they are interested, when they want it, rather than through traditional TV advertising, where a viewer has no control of what ad comes on when they are watching a program," said TiVo president and CEO Tom Rogers. Initially, more than 70 advertisers and 100 brands -- such as General Motors, Sony Pictures and Kraft Foods -- will contribute content to TiVo Product Watch, which is separated into five product categories: Automotive, Entertainment, Financial, Lifestyles, and Travel and Leisure.

o In-Game Ad Firm Double Fusion Acquires Eiko Media

San Francisco - Double Fusion, a San Francisco-based developer of in-game advertising technology, said on Monday that it has acquired Detroit-based new media agency Eiko Media, which specializes in integrating branded products into retail video games. Ashley Swartz, the president and co-founder of Eiko, will become Double Fusion's senior director of creative strategy. Financial terms of the deal were not disclosed. Eiko has worked with some of the country's largest automotive manufacturers, integrating their vehicles into games.

o Activision Unveils Roster of Games on Display at E3

Santa Monica, Calif. - Video game publisher Activision on Monday announced the new game titles it plans to preview at the Electronic Entertainment Expo this week. In addition to three launch titles for the PlayStation 3 and Nintendo Wii -- "Call of Duty 3," "Marvel: Ultimate Alliance" and "Tony Hawk's Project 8" -- the company will offer a total of 10 games for next-generation consoles. Los Angeles - Vivendi Games, the media conglomerate's video game publishing unit, announced on Monday the roster of upcoming titles it will showcase at this week's Electronic Entertainment Expo in Los Angeles. They include "World of Warcraft: The Burning Crusade," an expansion pack to its online game with 6.5 million subscribers; "Scarface: The World Is Yours," based on the classic gangster film; "Eragon," based on the fantasy novel series and upcoming 20th Century Fox Film; and "Miami Vice: The Game," based on the '80's TV show and summer film from Universal Pictures. Other Vivendi titles to be previewed at E3 include "World in Conflict"; "F.E.A.R. 360"; "Timeshift"; "Caesar IV"; "FreeStyle Street Basketball"; and "50 Cent: Bulletproof G Unit Edition," a portable version of the game for Sony PSP. o User-Created Ad Technology Developer Vitrue Raises $2.2 Million

Atlanta - Vitrue, a developer of user-created online advertising technology, announced on Monday that it has raised $2.2 million in its first round of venture capital financing. Investors included General Catalyst Partners and Vitrue founder Reggie Bradford, the former president of Tandberg Television and CEO of N2 Broadband. The company also said it has acquired Sharkle.com, an online video-sharing community that claims 100,000 registered users. Atlanta-based Vitrue's applications and services allow consumers to create their own video advertisements for free and manage their brand assets; an ad rating system will also allow users to vote for the most compelling ads on the site.

o Photo, Video Sharing Provider DotPhoto Raises $3.5 Million

West Trenton, N.J. - DotPhoto, a provider of photo, video and multimedia sharing and storage applications and services, announced that it has raised $3.5 million in a second round of venture capital financing from Edison Venture Fund and Sycamore Ventures. New Jersey-based dotPhoto provides hosting and sharing of user photos and video files, including access from camera phones. o Real D to Install Digital 3D Projectors in Rave Motion Pictures Theaters

Los Angeles - Real D, a developer of digital 3D cinema projection technology, announced on Monday that it has signed an agreement to install 20 if its systems in theaters owned by Dallas-based Rave Motion Pictures Theaters. With the addition, a total of 29 Rave screens will feature Real D Cinema systems that will screen digital 3D format films like Columbia Pictures' "Monster House" and Disney's "Chicken Little". Los Angeles-based Real D said its digital 3D systems are now installed in 124 theaters worldwide.

Paramount Pictures said on Monday that it partnered with Kodak Digital Cinema to handle the preparation and distribution of its "Mission Impossible: III" to more than 170 digital cinema screens in North America. Paramount said the film is now playing on more than a third of all digital-equipped screens in North America.

Los Angeles - Digital Interactive Streams (DiStream) on Monday announced the launch of a broadband entertainment streaming service for PC games.
