o Judge Denies Elcomsoft's Motions to Dismiss in E-Book Copyright Case

San Jose, Calif. -- A federal judge has denied Russian software firm
Elcomsoft's motions to dismiss the government's case against it for
criminal violation of the Digital Millennium Copyright Act (DMCA).
Elcomsoft distributes software that has the ability to circumvent the
copyright protections on Adobe's eBook Reader, allowing e-books in the
format to be converted to other formats, such as PDF, which can be readily
transferred without copyright owners' permission. Judge Ronald Whyte of
the Federal District Court for the Northern District of California ruled
against Elcomsoft's arguments that the DMCA is unconstitutional and that
it violates free speech rights guaranteed by the First Amendment. Judge
Whyte did, however, maintain that software is in fact speech that deserves
protection -- just not in this case. A hearing will take place on May 20
to determine a trial date.

o Microsoft to Shelve High-End Interactive TV Software

Amsterdam -- Microsoft will refocus its digital television efforts on
software for less-advanced set-top boxes, putting its more advanced
software for high-end set-tops "on ice," Reuters reported. The company
sunk millions into research and development for its Microsoft TV Advanced
software, but few hardware firms have adopted it. "We are putting
considerably more resources behind a more basic broadcast-centric
solution," Microsoft TV's European marketing manager Mark Le Goy told
Reuters. "There's clearly market demand for it. The way we are now
approaching the market is to add incremental, but significant, value to
what (cable) network operators are doing already." The company's new
digital TV efforts include a recently announced interactive program guide
for set-tops that sell in the $100 range, rather than its advanced
software that targeted set-tops that sell for between $300 and $500, which
have not shown profits for cable operators.

o Developers Namco, 3DO to Create Games for Nintendo GameCube Console

Tokyo -- Video game company Nintendo announced on Thursday that two
additional game developers -- Namco and 3DO -- will create titles for its
GameCube console. Kyoto, Japan-based Namco will create six games for
GameCube, in addition to eight games for Nintendo's Game Boy Advance
handheld. Redwood City, Calif.-based 3DO will develop GameCube versions of
several of its titles, including "Army Men," "Cubix," "Robots for Everyone," "High Heat," "Major League Baseball" and "Jonny Moseley Mad Trix."

o Interactive TV Hardware Firm EnerNow Acquires Unit of Parent, Gets $6.7M

Fort Lauderdale, Fla. -- EnerNow, a developer of set-top boxes and other
devices that provide video, movies, and music on demand, Web access,
email, and interactive TV services delivered through the television,
announced on Thursday that it will acquire a unit of its parent company
and receive an investment of $6.7 million. EnerNow will acquire the
advanced lithium-metal battery business of parent company Ener1 Holdings;
the new combined company will be called Ener1. Upon approval and
completion of the merger, the interactive TV business will receive an
investment of $2 million from Ener 1 Holdings, which will also contribute
$4.7 million to the battery business. Despite the new funding, "the
management of both companies noted that additional financing will be
required in order to implement their business plans," Ener1 said, in a
statement. Companies including LodgeNet, National Semiconductor and Sprint
use Ener1's interactive TV hardware and software.

(Los Angeles) Global Film School, an online film school founded by UCLA's

partnered with cable sports network ESPN to include elements of ESPN
sports telecasts into its line of sports titles. Under the multi-year
deal, ESPN-branded intros, replays, camera angles, stats and scores will

"World Series Baseball 2K3" and "NBA 2K3." San Francisco-based Sega will

technology, announced on Thursday that it has partnered with IBM to
develop a commercial grid for the online games market. The grid could
enable online video game providers to support a massive number of players
within the same game by allocating computing resources to the most

(New York) Arbitron, an international media and marketing research firm
for radio broadcasters, cable companies and advertisers, announced that it
will collaborate with Reston, Va.-based ComScore Networks to develop
Internet measurement services for local media. New York-based Arbitron
will meet with management of local media outlets, including radio, TV,
cable, newspapers, Internet content providers and advertising agencies to
enlist support for these jointly-developed metrics. "Our intent is to
provide advertisers, agencies and sellers of advertising on local media
Web sites with information needed to place the appropriate value on

creation software for Pressplay, a digital music subscription service

(Los Angeles) Boeing Digital Cinema, a provider of digital cinema
projection systems for movie theaters, told Reuters on Thursday that it
expects to have 23 U.S. theaters equipped to screen "Star Wars Episode II"
digitally when the film premieres on May 16. Boeing Digital Cinema
executive director Frank Stirling said the company expects to install as
many as 40 of the costly systems in theaters by the summer's end and
possibly 100 by year's end. Stirling also said that some Hollywood studios
have agreed to pay a "digital distribution fee" to help Boeing and
struggling theater chains offset installation costs.
