o Los Angeles Man Pleads Guilty to
Selling Modified Xbox Consoles
Los Angeles - The co-owner of a video game store on
Melrose Avenue in Los Angeles has pleaded guilty to felony copyright
crimes, for selling Xbox video game consoles modified so they could
play pirated games, Reuters reported. ACME Game Store co-owner Jason
Jones faces up to five years in prison and $250,000 in fines. Jones
told Reuters he pleaded guilty to reach an agreement with
prosecutors. "I don't know how to modify a (expletive) Xbox," Jones
said, when reached at the Electronic Entertainment Expo. The store's
other co-owner, Jonathan Bryant, signed a plea agreement and is also
expected to plead guilty to similar charges. A third defendant, Pei
"Patrick" Cai -- who allegedly made the modifications to the video
game consoles -- is charged with two felonies under the Digital
Millennium Copyright Act, and is now considered a fugitive, after
missing several court appearances.

o FCC to Auction
Spectrum for In-Flight Wireless Internet, VoIP
New York - The FCC plans to auction frequencies that will
be used to provide in-flight Internet services, The New York Times
reported. Some foreign airlines, including Lufthansa and Japan
Airlines, already offer flights with broadband for laptop-toting
passengers, through a satellite-based service called Connexion from
Boeing. Verizon Airfone, AirCell and LiveTV are among nine companies
expected to bid on two available licenses, The Times reported, for
spectrum borrowed from the seldom-used in-flight phone services
available on many planes. The FCC licenses would allow equipment on
planes to connect directly with receivers on the ground, with
passengers paying a flat fee to both connect to the Internet via
Wi-Fi, and potentially place phone calls using Voice over Internet
Protocol (VoIP) technology. "Airlines will have to be careful how
they roll it out," Jonathan Schildkraut, a telecommunications
analyst at Jefferies & Company, told The Times. "I don't trust
people to observe the laws of propriety," he added, referring to the
prospect of passengers being allowed to talk on the phone in an
airplane's cramped quarters.

o Nintendo
May Discontinue Game Boy Advance Handheld
Los Angeles - Nintendo may not develop any future versions
of its popular Game Boy Advance handheld device, the company's
president remarked in an interview with Reuters, citing the success
of the company's new DS handheld. The company's Game Boy Advance
line has sold over 74 million units worldwide since December 2005.
"I would have a second thought about using our resources on what
would be the next generation of Game Boy Advance, considering the
strong support DS is now enjoying," Nintendo president Satoru Iwata
told Reuters. The DS has so far sold 16 million units in the U.S.
"The Japanese game market is now evolving around DS. We don't need
to do something that will pour cold water on the situation," Iwata
added. Nintendo plans to integrate the DS with its next-generation
Wii console, enabling content to be shuttled back and forth between
the handheld and the console, which is slated to ship in the fourth
quarter.

o French
Parliament Alters iTunes Bill; License Fee, DRM Assurances Added
Paris - The French Senate has altered a controversial bill
that aims to ensure competition in the country's digital music
market by forcing companies like Apple to open their online stores
to players besides the iPod, Reuters reported. Responding to
opposition from Apple, the Senate bill now includes a license fee
for companies who provide interoperability of their services, as
well as an assurance that copyright protection will be upheld by
third parties, through the creation of an independent authority to
regulate digital rights management transfers. Both houses of
France's parliament will have to agree on the language of the bill,
which could be enacted as early as next month. It's unclear whether
Apple would comply with the proposed French law or instead simply
choose to shutter its iTunes Store in France.

o William
Morris Agency Launches Digital Media Group
Beverly Hills, Calif. - The William Morris Agency
announced this week the launch of a digital media group, which will
work to create opportunities for its clients across digital
platforms including video-on-demand, broadband and mobile, and also
represent technology firms looking to connect with the entertainment
industry. The talent and literary agency named Lewis Henderson to
lead the group, who will head a team of agents from WMA offices
worldwide. "We created this important division to further maximize
new digital opportunities for our clients, said WMA CEO Jim Wiatt.
"Lewis has extensive relationships and an incomparable knowledge of
these markets and we know that in this new role he will play a
crucial role not only for WMA and our clients, but for the
entertainment industry as a whole." Several of the major talent
agencies have set up similar divisions in recent years, to take
advantage of, for instance, the market for video games based on
movie and TV properties, and movies spun-off from video games.
