o MTV to Launch Own "Urge" Digital Music Store This Week

New York - MTV Networks plans to launch its own Microsoft-powered digital music download service, Urge, on Wednesday in a public beta test. The service will initially offer over 2 million tracks for 99 cents each or $9.95 per album, as well as a $14.95 per month subscription service that allows unlimited transfer of songs to portable players compatible with Microsoft Windows Media Audio -- excluding the iPod. The Urge service will be tightly integrated into Microsoft's new Windows Media Player 11. In addition to album tracks, Urge will also sell recordings of performances from MTV programs like "TRL" and "MTV Unplugged". Also available on Urge will be 130 streaming radio channels, streaming music videos, and in the future, downloadable videos for sale. "Only 5 percent of music sales happen digitally," MTV Networks Music Group president Van Toffler told the Associated Press. "Hopefully, through the TV channels we have and the dot-com sites ... we can educate people about the virtues of subscriptions. It's not about selling a million singles."

o Creative Sues Apple for Patent Infringement of iPod User Interface

Scotts Valley, Calif. - Creative Technology, a maker of portable MP3 players, announced on Monday that it has sued Apple for patent infringement of its MP3 player design. In addition, Creative has filed a complaint with the U.S. International Trade Commission, seeking a ruling on whether Apple's imported iPods and iPod Nanos infringe on the company's "Zen Patent" -- which covers the user interface on its music players. The complaint seeks an injunction against Apple importing iPods from its Asian manufacturers, or selling them once they arrive in the U.S.

o Report: Rogue Russian Download Store More Popular than Napster in U.K.

London - A Russian website that offers digital song downloads at a fraction of the price of iTunes and Napster has become the second most-popular commercial download service in the U.K., according to a report from XTN Data. Apple's iTunes commanded the largest share of the U.K. paid download market in September 2005, with 44%, followed by Moscow-based AllofMP3.com with 14%; Napster's U.K. service followed in third place. While iTunes and Napster sell songs for 99 cents, the Russian site offers them for about 10 cents each. "It offers cheap downloads, is easy to use and has no restrictions on where people can play the tracks. This is what music fans are asking for so perhaps AllOfMP3's popularity isn't that surprising," said XTN Data founder Greig Harper. The Russian site claims that Russian copyright law allows it to legally sell tracks in foreign countries at the reduced prices it offers. The International Federation of the Phonographic Industry (IFPI) made a formal complaint about the site to Russian authorities last year, but prosecutors there eventually dropped their case against the site.

o News Corp. to Sell Episodes of Fox TV's "24" on MySpace

New York - News Corporation plans to begin selling episodes of its Fox TV network's series "24" on the MySpace social networking service, which the company's Fox Interactive Media unit acquired a year ago for $580 million, the Wall Street Journal reported. The $1.99 episodes will go on sale next week alongside two free episodes sponsored by Burger King.

o TiVo Signs Multimillion Dollar Upfront Advertising Deal with Interpublic

Alviso, Calif. - TiVo announced on Monday that it has signed a multimillion dollar advertising agreement with advertising company Interpublic Media, which will provide Interpublic clients with preferred pricing and access to new advertising technologies. The "upfront" agreement with Interpublic, which oversees agencies including Initiative, Magna Global and Universal McCann, was handled by Interpublic's new Emerging Media Lab. "TiVo offers an interactive advertising solution that enables the consumer to pause television and engage in a branded advertising experience, without missing even a second of the TV show a viewer is watching," said TiVo CEO Tom Rogers. "We are excited to expand our long-standing relationship with Interpublic and look forward to capitalizing on their intellectual capital, experience and relationships in the future."

o IAB Issues Guidelines for Measuring Broadband Video Commercials

New York - The Interactive Advertising Bureau (IAB), a consortium of 250 companies that develops standards for online advertising, on Monday released new guidelines for broadband video commercials. The IAB defines a video ad as a commercial that appears before, during or after content such as streaming video, animation, games or music videos in a player environment. The group established guidelines that determine at what point a broadband video commercial is counted as having been viewed, creating an "impression". "A valid broadband ad impression may only be counted when an ad counter (logging server) receives and responds to an HTTP request for a tracking asset from a client," the IAB set forth in its guidelines. "The count must happen after the initiation of the stream, post-buffering, as opposed to the linked broadband content itself. Specifically, measurement should not occur when the buffer is initiated, rather measurement should occur when the ad itself begins to appear on the user's browser, closest to the opportunity to see."
