o RIAA Sues XM Satellite Radio
Over Recording Device; Stock Drops 5.7%
Washington - The Recording Industry Association of America
(RIAA), which represents the interests of the major record labels,
has filed a high-profile lawsuit against XM Satellite Radio over a
new satellite device that allows users to store songs for play
later. XM's stock dropped 5.7% on Wednesday. The device in question
-- called the Inno, and manufactured by Pioneer -- allows users to
store songs they hear through the XM radio service, similar to the
way TiVo enables recording of TV shows. In the lawsuit, the
recording industry argued that satellite radio services are only
licensed to provide their listeners with "live" songs heard on the
radio service, and such recordings constitute a "sale" of a
permanent copy of the songs. The lawsuit is asking $150,000 in
damages for each song copied by customers of XM Satellite using the
Inno. XM told Reuters the suit is also a tactic in licensing
negotiations for the device, which sources familiar with the matter
told Reuters have failed to generate an agreement.

Infinium Labs CEO in Junk Fax Scam
Washington - The Securities and Exchange Commission (SEC)
has charged the former CEO of video game developer Infinium Labs in
a fraudulent junk fax scheme that artificially inflated the
company's stock price. The SEC alleges that former Infinium CEO Tim
Roberts hired a stock promoter to send tens of thousands of faxes to
potential investors, touting the impending launch of its Phantom
game service in January 2005; the oft-delayed device has yet to
reach the market. The fax scheme inflated the company's share price,
which enabled Roberts to reap $422,500 through sales of his own
shares. Roberts then issued several large checks to the stock
promoter and provided him with company shares. The SEC has
petitioned a federal court in Florida to make Roberts return his
ill-gotten gains from the junk fax scheme, impose a penalty, and bar
him from serving as an officer or director of a publicly-traded
company.

Settles P2P Patent Infringement Suits with Overpeer, Loudeye
Los Angeles - Altnet, a file-sharing technology company
associated with Kazaa distributor Sharman Networks, announced that
it has settled some of the patent infringement claims it brought
against the music industry. In 2004, Altnet sued the Recording
Industry Association of America (RIAA), Loudeye, Overpeer, Media
Sentry and several individuals for patent infringement, claiming the
"spoof" files some of the defendants were using to seed the Kazaa
network with bogus songs infringed on Altnet's "TrueName"
technology. Altnet said that it has settled its litigation against
Overpeer and Loudeye, with Overpeer admitting its interdiction
activities infringed Altnet patents. Both companies agreed not to
engage in those activities in the future. "We welcome this
settlement as an important step toward the acknowledgement and
recognition of the TrueName patents as a prerequisite to legitimate
utilization and exploitation of P2P technology," said Altnet CEO
Kevin Bermeister. Altnet added that the case against remaining
defendants, including the RIAA, will continue with a trial likely in
2007.

$20 Million Countersuit Against Mobile Distributor
Beverly Hills, Calif. - Porn magnate Larry Flynt's LFP
announced on Wednesday that it has filed a $20 million counterclaim
against Giant Mobile, a firm the company hired to distribute its
Hustler Mobile images and videos on mobile phones. The suit claims
breach of contract and infringement against Giant Mobile, and says
LFP elected to terminate its license agreement with the company
after conducting an audit of Giant's books and records. Last month,
Santa Monica, Calif.-based Giant filed a $23 million suit against
LFP for breach of contract, claiming that LFP terminated its
agreement with Giant in order to cut a better deal with another
company. Giant's suit also claims that LFP undermined its
relationships with other adult content distributors. "We see little
merit in the claims made against LFP by Giant in the arbitration,
and look forward to the day when this matter is resolved in LFP's
favor," said LFP president Michael Klein.

Glasgow, U.K. - WeeWorld, a developer of personalization
technology for mobile and Web communications, announced on Wednesday
that it has raised $15.5 million in its second round of venture
capital financing, from Accel Partners and Benchmark Capital.
Glasgow-based WeeWorld's technology allows users to create a visual
representation of themselves, which also reflects their hobbies and
interests, that may then be attached to profiles on instant
messaging services, e-mail, blogs, social networking sites, VoIP
services and picture messaging for mobile phones. The company's
WeeMee profiles are available to users of services including MSN
Messenger, Friends Reunited and Skype.

Placement E-commerce Firm Delivery Agent Raises $11 Million
San Francisco - Delivery Agent, a provider of e-commerce
services for products seen on TV shows and in movies, sports and
music videos, announced on Wednesday that it has raised $11 million
in its second round of venture capital financing. Bessemer Venture
Partners led the investment round; previous investors Worldview
Technology Partners and Cardinal Venture Capital also participated.
The funds will be used to expand San Francisco-based Delivery
Agent's technology, which facilitates the sale of products seen
within entertainment content via wireless, Internet TV and
interactive television platforms. The company's customers include
NBC Universal, ABC Entertainment, Twentieth Century Fox, Sony
Pictures, The Weinstein Company and several NBA franchises.

Peer-to-Peer Developer Pando Networks Raises $7 Million
Santa Clara, Calif. - Intel Capital, the Venture arm of
chipmaker Intel, has led a new $7 million funding round for New
York-based Pando Networks, developer of a peer-to-peer distribution
network for consumers' digital media. Pando said that the investment
will support the launch of its first consumer offering, a network
for sharing personal media, such as home movies, family photos and
business presentations that are too large to send through email. The
system runs through a free, downloadable application.

European Music Video Distributor Musicbrigade Raises $4.1 Million
Stockholm, Sweden - Musicbrigade, a Sweden-based digital
distributor of music videos, announced that it has received a $4.1
million investment from IT Provider Funds. Launched in 1999,
Musicbrigade has licensed music videos and songs from the major
labels, and distributes them both online and to mobile phones in
Europe through partners including Telenor, Telewest/NTL, 3 and
Vodafone. The company said the funds will help to accelerate its
European expansion.

Blog Music Provider Sonific Gets Angel Funding
San Francisco - Sonific, a start-up that allows users to
upload free, Flash-based music onto their websites and blogs,
announced that it has raised an undisclosed amount of angel funding.
The company also said it signed an agreement with CD Baby, a
distributor of independent musicians' CDs, whose members will be
able to distribute their music through Sonific. The San
Francisco-based company was launched by Gerd Leonhard, who also
founded LicenseMusic.com and penned a book on the digital music
industry.
Sonific will use the funds to further build out its technologies and
product offerings, to expand its content library, and to build a
global partner network. The company soon plans to announce details
of a beta test.

New York - MTV on Wednesday launched a public beta test
and two-week free trial of its Microsoft-powered Urge digital music
service. Featuring 2 million tracks licensed from MusicNet, Urge
offers 99 cent a la carte downloads, a $9.95 streaming subscription
plan, and a $14.95 subscription that allows unlimited downloads to
compatible devices. Other features of the service include 130
streaming radio stations; "super playlists", which contain hundreds
of songs in a given genre; "feeds", where users can sign up for
updated playlists in certain genres and sync them to portable
players; and "auto mixes", or automatically generated playlists
built around specific artists or music styles selected by users.

Suspends XM Radio Shipments Over FCC Specifications
Hauppauge, N.Y. - Electronics maker Audiovox announced that it
has suspended shipments of one of its XM Satellite radio receivers,
after the FCC found the device does not comply with federal
operating bandwidth or emission specifications. New York-based
Audiovox said it would not resume shipments of its XMCK10 Xpress
Model radio until it can bring the device into compliance with FCC
specifications.

its technology will power a forthcoming "family locator" feature on
the Disney Mobile wireless service. The technology will allow

Lawmaker, Game Industry Launch Teen Cyber Stalking Game
Sacramento, Calif. - The video game industry's ESA
Foundation, California State Senator Liz Figueroa and nonprofit Web
Wise Kids on Wednesday introduced an online game that aims to
educate teens on how to outsmart cyber stalkers. Developed by Web
Wise Kids, "Mirror Image" is based on a real-life criminal case
involving cyber stalking, and will be distributed for free to Web
Wise Kids' partner schools and police departments. "We can tell
teens or even show them how to be safe online, but an interactive
format like 'Mirror Image' goes beyond telling teens what to do --
it gets them involved in the story. That kind of experience is much
more personal and applicable to their daily lives," said Senator
Figueroa, chair of the Select Committee on Children, Youth and
Families.
