o German Court Rules ISPs Can Protect
Privacy of Alleged File-Swappers
Hamburg, Germany -- A court in the German state of Hamburg has
ruled that Internet service providers there cannot be compelled to
reveal the identities of subscribers alleged to have traded
copyrighted songs, the German newspaper Heise Online reported. The
Higher Regional Court in Hamburg ruled that current German law
protects the privacy of ISP customers, following a similar ruling in
the state of Hesse -- although new federal legislation is in the
works in Germany that might change this. A lower court had ordered
the identities of the operators of an FTP server in Hamburg that
offered free downloads of songs from the band Rammstein turned over
to the band's label, Universal. But the recent ruling from the
Higher Regional Court overturned this decision, and the alleged
file-swappers will remain anonymous for the time being.

o Tecmo Settles
With Site That Posted Volleyball Game Bikini Hacks
San Francisco -- Japanese video game publisher Tecmo has quietly
settled a copyright infringement lawsuit it brought against
individuals who published code that can strip the female characters
in its "Dead or Alive Xtreme Beach Volleyball" of their bikinis,
Wired News reported. Tecmo originally filed the suit in January
against operators of a site called NinjaHacker.net, over code posted
to the site that changes the appearance of characters in the
volleyball game as well as in Tecmo's "Ninja Gaiden" and "Dead or
Alive 3." Terms of the settlements of the suits against the site
owner and hosting provider for NinjaHacker.net were not disclosed.
"I can tell you that my client would not have been inclined to reach
any agreement that would have required him to pay money to Tecmo,"
attorney Charles Mudd, who represented NinjaHacker.net hosting
provider Will Glynn, told Wired News. However, there is speculation
Tecmo acquired information on the identities of the actual
programmers who posted the "hacks" as part of the settlement, and
additional lawsuits may follow.

Announces Titles on Display at E3
Chicago -- Midway Games on Wednesday announced the new product
line it will be offering for review at the Electronic Entertainment
Expo this week in Los Angeles. Upcoming console games in development
include "Blitz: The League," "Gauntlet: Seven Sorrows," "L.A. Rush,"
"Mortal Kombat: Shaolin Monks," "The Suffering: Ties That Bind" and
"Ed, Edd n Eddy: The Mis-Edventures." Also on display will be
"Stranglehold," a title for next-generation consoles slated for
release in the fall of 2006 that was developed in collaboration with
action film director John Woo, and will feature actor Chow Yun-Fat.
For the PC, Midway will offer "Rise & Fall: Civilizations at War"
and "Unreal Tournament 2007," while for the Sony PSP Midway will
preview "Midway Arcade Treasures," "Mortal Kombat: Deception" and
"NBA Ballers.

Los Angeles -- Japanese video game publisher Capcom on Wednesday
announced a number of upcoming titles at the Electronic
Entertainment Expo. The company will showcase new games at the
convention that include "Final Fight: Streetwise"; "Okami"; "Onimusha:
Dawn of Dreams"; "Beat Down: Fists of Vengeance"; "Devil Kings";
"Legend of Kay"; "Killer 7"; "Phoenix Wright: Ace Attorney";
"Without Warning" and "Flipnic: Ultimate Pinball." Capcom also plans
to preview new installments in existing franchises "Mega Man" and "Viewtiful
Joe."

of Consumers Spend Up to Half of Leisure Time Playing Games
Seattle -- A recent survey of 13,000 consumers in 13 countries found
that more than 20% of respondents said they spend up to half of
their leisure time playing video games. Conducted by Seattle-based
market research firm GMI, the poll found 30% of those surveyed in
India and 20% of respondents in Mexico spend up to half of their
leisure time playing games, compared with respondents from the U.S.
(24%) and Germany (24%). Eighty percent of all consumers surveyed
said they believe people will spend more time playing video games
over the next ten years. "Relatively unexploited markets in Latin
America and in Asia such as India offer new growth to the videogame
industry," said analyst Billy Pidgeon. While 58% of consumers
overall don't think games are a good form of social activity, this
thinking is reversed in India and Mexico, where 49% and 64% of those
surveyed, respectively, play games to socialize -- compared with
other nations like the Netherlands and France, where only 14% and
20% of respondents, respectively, said they played games socially.

LodgeNet, a provider of in-room broadband access and interactive
television services to hoteliers, announced on Wednesday that it has
signed an agreement with Time Warner's HBO to distribute HBO HD
programming on its systems. South Dakota-based LodgeNet said it will
offer high-definition versions of HBO programming like "Deadwood,"
"The Sopranos" and "HBO Championship Boxing" in the hotel guest
rooms it serves.

(Los Angeles) Finnish cell phone maker Nokia on Wednesday
announced that it plans to make games for its N-Gage hybrid cell
phone/mobile game deck compatible with a range of Nokia smartphones.
The company expects to sell 25 million smartphones this year. Nokia

(Los Angeles) LucasArts, the video game publishing company
launched by "Star Wars" director George Lucas, announced on
Wednesday that it plans to release a game based on the "Indiana
Jones" film property for next-generation consoles in 2007. The
company also announced plans to release a version of its "Star Wars
Battlefront II" title for Sony PSP in the fall, alongside versions
for PlayStation 2 and Xbox. Other upcoming titles announced at E3
include the PC title "Star Wars Empire at War," in development at
Las Vegas-based Petroglyph for release in the spring of 2006, and
"Star Wars Galaxies: The Total Experience," an anthology that
combines the PC titles "Star Wars Galaxies: An Empire Divided,"

(Los Angeles) Turner Broadcasting System said on Wednesday that
it has signed a three-year agreement to include AOL's Instant
Messenger and ICQ services in its new GameTap broadband

(San Diego) Video game accessories manufacturer Mad Catz
announced on Wednesday that it has signed a licensing agreement with
Warner Bros. Consumer Products, to create video game controllers and
other accessories based on "Batman Begins," the upcoming Warner
Bros. film based on the DC Comics property. The accessories will
ship at the same time as the film's debut in theaters on June 15.
San Diego-based Mad Catz also signed an agreement with Microsoft, to
manufacture accessories for its Xbox 360 to include a game
controller, steering wheel, dance pad and arcade stick.

the creation of the International Mobile Gaming Awards, which the
company has organized to recognize and encourage 3D game development
for cell phones and mobile devices. The company will accept
proposals for new game titles through September, and then provide
support to developers who must build a demo version of their games
by the end of January 2006. Then in February, four winners will be
announced for Best Art, Best Game Play, Best Technical Achievement
and Overall Winner ("Grand Prix") at the 3GSM World Congress in
Barcelona. The top game will receive a guaranteed contract with a
mobile operator as well as a publisher to market and sell the title.
