o Apple Countersues Creative in
Dispute Over iPod User Interface Patents
Cupertino, Calif. - Apple has filed a countersuit against
Creative Technology, a maker of MP3 players and other media players,
in a dispute over patents held by the two companies on the user
interface designs for the devices. In its suit, Apple claims that
Creative infringes on four of its iPod patents. Apple's suit was
filed on May 15, the same day that Creative filed its own patent
infringement lawsuit against Apple, also over music player patents,
in addition to petitioning the U.S. International Trade Commission
to block the import and sale of Apple's allegedly infringing iPods
from the company's Asian manufacturers. "Creative proactively held
discussions with Apple in our efforts to explore amicable
solutions," Creative spokesman Phil O'Shaughnessy said, in a
statement. "At no time during these discussions or at any other time
did Apple mention to us the patents it raised in its lawsuit."

Who Purchase Violent Games Passes Minnesota House
St. Paul, Minn. - The Minnesota State House has passed a
bill that would compel retailers to post clear signs informing
consumers of the video game ratings system, and -- in a twist not
yet seen in such state-sponsored legislation -- would impose a $25
fine on minors under 18 who try to purchase Mature- or Adults
Only-rated games. Introduced by State Rep. Jeff Johnson (R-St.
Paul), the bill passed the House in a 114-17 vote. "We were trying
to pass the narrowest bill possible just to try something different
from a constitutional challenge standpoint," Rep. Johnson told
GamePolitics.com. To date, similar laws passed in a number of states
have been routinely struck down by the courts as unconstitutional
restrictions on First Amendment free speech protections. Johnson's
bill will now move to the Minnesota Senate.

Company Leads Investment in Exclusive Social Network aSmallWorld
New York - The Weinstein Company, the film studio and
entertainment company formed by Miramax founders Bob and Harvey
Weinstein, announced on Monday that it has made a significant
investment in aSmallWorld.net, an exclusive social networking site
made up of "some of the most unique and influential people" from
over 100 countries. The undisclosed investment also included
contributions from former AOL Time Warner chief operating officer
Bob Pittman and others. Founded in 2004, aSmallWorld.net currently
claims 130,000 members. Features include a city guide generated by
its members, offering ratings and rankings for restaurants, hotels,
resorts and night clubs in 60 major cities. "Our target audience is
the '3 million people connected 3 degrees,' an existing community of
people that are accomplished, well-educated, highly mobile,
influential, and have a strong need to stay connected," said

Stretches Lead in Internet Search Market
Reston, Va. - For the ninth straight month, Google gained
in search market share in April, maintaining its status as market
leader with 43% of all U.S. searches conducted on its sites,
according to new figures from comScore Networks. Yahoo remained in
second place with 28% and MSN ranked third with 13%. All told,
Americans conducted 6.6 billion searches online in April, up 4% from
the previous month.

Ann Arbor, Mich. - All Media Guide, a provider of
informational databases on music, movies and video games, announced
on Monday that it has acquired MoodLogic, a developer of music
recommendation, organization and playlist software. Financial terms
of the transaction were not disclosed. Michigan-based All Media
Guide said that MoodLogic will maintain its current headquarters in
San Francisco. "We are pairing our expert editorial and biographical
content with community-generated analysis and reactions," said AMG
president Karl Ryser. "MoodLogic's ability to normalize, organize,

Streaming Delivery Firm VitalStream Acquires Eonstreams for $17
Million
Irvine, Calif. - VitalStream, a provider of audio and
video streaming content delivery network services, announced on
Monday that it has acquired Eonstreams, a provider of Internet ad
insertion and streaming technology, in a stock deal valued at $17
million. Irvine, Calif.-based VitalStream said it purchased
substantially all of the assets and assumed substantially all of the
liabilities of Tennessee-based Eonstreams. VitalStream said the
acquisition will enhance its services, offering its customers the
ability to insert streaming ads into live and on-demand streaming
broadcasts that target specific demographics.

Research Firm Gartner Prices Stock Offering to Raise $140 Million
Stamford, Conn. - Gartner, a technology market research
firm, has priced a secondary offering of 9.5 million shares of stock
at $14.75 million a share to raise a total of about $140 million.
All of the shares are being sold by Silver Lake Partners, a New
York-based private equity firm that is Gartner's largest
shareholder, which owns a 33% stake in the company. Silver Lake
remains the company's largest shareholder after the current sale.
