o Judge Approves Terms of Sony BMG
"Rootkit" CD Settlement
New York - A U.S. District Court judge has given final
approval to a settlement for consumers who purchased Sony BMG music
CDs that featured a "rootkit" security measure that put their
computers at risk. The Electronic Frontier Foundation (EFF), a
digital civil liberties group that helped represent consumers, said
the settlement will provide consumers who purchased CDs containing
flawed security software from First4Internet and SunnComm with
replacement CDs free of the software, as well as free music
downloads and small cash settlements in some cases. "This settlement
gets music fans what they thought they were buying in the first
place: music that will play on all their electronic devices without
installing sneaky software," said EFF legal director Cindy Cohn. The
settlement also compels Sony BMG to cease manufacture of CDs using
the offending technologies; binds the label to submit future digital
rights management technologies to an independent security review;
and requires it to place warning labels on future CDs containing
such technology.

eBay, Others for $4.1 Billion Over Rights to Skype
Los Angeles - StreamCast Networks, distributors of the
Morpheus peer-to-peer file-sharing software, has filed a lawsuit
against Skype parent company eBay and 21 other defendants, claiming
it had first rights to the Internet telephone technology and seeking
over $4.1 billion in damages. The FastTrack technology on which
Skype is based was developed by the original creators of rival
file-swapping software Kazaa, who are also named as defendants. The
technology behind Skype, along with the company and its nearly 100
million users, was acquired by eBay in 2005 for $2.6 billion. "Many
of the defendants engaged in a conspiracy and shut Morpheus out of
the FastTrack P2P market and failed to honor an agreement with
StreamCast that it had the right to acquire the FastTrack technology
and other assets," said StreamCast general counsel Matthew A. Neco.
The suit was originally filed in January; an amended version adding
eBay to the list of defendants was filed this week.

Price of Internet Telephone Firm Vonage Drops 12% After IPO
Edison, N.J. - Shares in Vonage, the New Jersey-based
provider of Internet-based telephone services, dropped more than 12%
in the company's first day of trading as a public company on
Wednesday. The company raised about $531 million in its initial
public offering, pricing 31.25 million shares at $17 per share.
Vonage's share price closed at $14.85.

Radio Lowers Subscriber Forecast; Shares Tumble
Washington - Citing a softer than expected market, along
with its legal troubles, XM Satellite Radio on Wednesday lowered its
subscriber forecast from 9 million to 8.5 million by the end of the
year. The news sent company shares down 11% on Wednesday. In a
statement, the company said that it is "currently working through
regulatory and legal challenges, the resolution of which could
affect future product availability and operating results, and
require us to review this revised guidance." A week ago, members of
the Recording Industry Association of America (RIAA) filed suit
against XM over a new device that allows users to store songs for
play later. The company also is facing a class-action suit from
shareholders over the high price the company had to pay to reach its
goal of 6 million subscribers last year. Hugh Panero, the president
and CEO of XM, also said that the satellite radio category has seen
an "overall softness" during the second quarter.

EchoStar Continue Battle Over Digital Video Recorder Patents
Alviso, Calif. - Both TiVo and satellite TV firm EchoStar
Communications say they have benefited from a federal patent office
ruling that relates to a patent infringement lawsuit TiVo won
against EchoStar over digital video recorders. While EchoStar noted
that the ruling "rejected many of TiVo's patent claims as invalid,"
TiVo said in a statement that the ruling "should in no way impact
the jury verdict," referring to the $73 million patent infringement
judgment awarded to TiVo by a jury that found EchoStar had infringed
its patents. TiVo added that the patent office ruling confirmed the
validity of most of its 61 patent claims, while rejecting others.
Following the jury verdict, TiVo has asked the U.S. District Court
for the Eastern District of Texas to issue an injunction against the
sale of EchoStar digital video recorders that infringe on TiVo
patents; begin a recall on existing infringing models from retail;
and disable the infringing digital video recorder functionality in
set-tops already in DISH Network subscribers' homes.

Launches Probe into CNET's Stock Option Grants
San Francisco - CNET Networks, the San Francisco-based
technology media company, said on Wednesday that the Securities and
Exchange Commission (SEC) has launched an informal probe into its
stock option grants. CNET said that it plans to cooperate fully with
the investigation. Last week, the Center for Financial Research and
Analysis issued an analysis of stock option exercise prices relative
to stock price ranges for a number of companies during the period
from 1997 to 2002. The report identified CNET Networks as having
granted stock options on four occasions between 1998 and 2001, with
exercise prices that matched or were close to a 40-day low for its
stock price. The company said that it will launch an internal
investigation, as well.

New York - Martha Stewart's online company is planning to
launch a social networking site similar to MySpace, but that will
cater to women ages 25-45, Reuters reported. "There is no place like
MySpace, like Friendster, for that demographic," Martha Stewart
Living Omnimedia CEO Susan Lyne said at a financial conference. This
site will be housed at MarthaStewart.com, and allow users to share
things like recipes, photos and scrapbooks.

Corp. to Acquire Aastra Digital Video for $35 Million
Melbourne, Fla. - Harris Corp., a major communications and
defense technology company, has agreed to acquire Aastra Digital
Video, a New Jersey-based unit of Aastra Technologies that develops
video networking, encoding, decoding, and multiplexing technologies
used by television broadcasters, telecommunications providers and
satellite networks. The deal is valued at $35 million in cash. "This
acquisition adds to our Total Content Delivery solutions for the
broadcast industry and will enable Harris to offer networking
products that transport media content over a variety of broadcast,
cable, satellite, and telco networks, including those supporting new
services such as IPTV and Mobile TV," said Tim Thorsteinson,
president of Harris Broadcast Communications Division. Aastra
Digital Video employs about 35 people and had revenue of about $18
million and a profit of about $5.7 million last year.

Content Printing Firm Presto Services Raises $10 Million
Mountain View, Calif. - Presto Services, a developer of
technology that will let consumers without computers or Internet
access share digital content, announced on Wednesday that it has
raised $10 million in its first round of venture capital financing.
The investment round was led by Kleiner Perkins Caufield & Byers and
Clearstone Venture Partners. Mountain View, Calif.-based Presto has
partnered with HP to create a device and complementary service that
lets non-tech-savvy consumers receive photos, e-mail and other
digital content without a computer. The company said the HP
"printing mailbox" is designed for the country's 78 million baby
boomers and their parents, and the 50 million American adults who
don't use computers or have access to the Internet. Presto expects
to introduce its debut offering in the fall of 2006.

Research Firm Telephia Launches Mobile TV User Panel
San Francisco - Telephia, a provider of performance
measurement information to the mobile industry, said on Wednesday
that it has launched the industry's first mobile television user
panel, designed to measure the attitudes and behaviors of mobile TV
users. San Francisco-based Telephia said that it will initially
focus on the MobiTV-based offerings on Sprint and Cingular Wireless,
and Verizon's V CAST service. The panel will then expand to include
subscribers of multicast mobile TV networks when they launch in late

Sprint Introduces Music-Focused FUSIC Phone from LG
Overland Park, Kan. - Sprint on Wednesday introduced the
LG Electronics FUSIC mobile phone handset, a music-focused model
that will feature tight integration with its Sprint Music Store. The
$329 phone ($179 after rebate and 2-year contract) will offer up to
1GB of storage, and feature a ringtone composer, FM transmitter and
Bluetooth Stereo support. In addition to over-the-air song
downloads, the phone supports streaming mobile music stations from
Rhapsody, Music Choice, MTV and VH1. The FUSIC is expected to ship
to retailers on May 28.

Wednesday announced the launch of the Bside Roadshow, a touring
independent film and music festival that will feature nine stops
during the month of June. The company teamed with Bside
Entertainment and Right Angle Studios on the tour, which kicks off
June 4 in downtown Austin and will include performances from popular
local MySpace bands in Ann Arbor, Minneapolis, Madison,
Philadelphia, Boulder, Portland and Boston. Santa Monica,

London - Swopex, an online peer-to-peer swapping network
for DVDs and video games in the U.K., announced on Wednesday the
launch of new trading community that lets users buy and sell media
with no listing fees or commissions. The swapping function on Swopex
charges users 99 pence (about $1.85) per item to trade their
physical media with one another through the mail. The site now also
lets users place items for sale, with sellers receiving payment only
after the buyer confirms satisfactory receipt of the item.
