o RIAA, Music Publishers Add Audiogalaxy to List of File-Sharing Lawsuits

New York -- The Recording Industry Association of America (RIAA), a trade
group that represents the interests of the major record labels, and the
National Music Publishers Association (NMPA), which represents songwriters
and music publishers, announced that they have filed copyright
infringement claims against Audiogalaxy, a Napster-like file-sharing
service. The suit accuses Austin, Texas-based Audiogalaxy and company head
Michael Merhej of "willfully and intentionally" encouraging and
facilitating "millions of individual, anonymous users to copy and
distribute infringing copyrighted works by the millions, if not billions."
"Audiogalaxy and Napster are cut from the same cloth," said Matt
Oppenheim, senior vice president of business and legal affairs for the
RIAA.

o Despite Setbacks, Digital TV Expected in 73% of European Homes by 2008

London, England -- Despite recent setbacks such as the closing of European
digital TV providers ITV Digital and Quiero TV, digital television is
expected to be in 73 percent of European homes by 2008, according to a
report released on Tuesday by Boston-based market research firm Strategy
Analytics. The closure of the two digital terrestrial TV providers will
likely serve as a boon to other delivery methods, such as cable and
satellite. Strategy Analytics predicts that 58 percent of new European
digital TV customers in 2002 will choose a satellite service, while 36
percent will opt for cable. As for digital terrestrial TV, the firm says,
"Consumer confidence in this technology is likely to have been severely
eroded." Overall, the report forecasts that 11 percent of European homes
will have digital TV via terrestrial by 2008, compared to 32 percent via
cable and 29 percent via satellite.

o Wired News: Against FBI Wishes, Pearl Execution Video Reposted Online

Washington -- Wired News reported on Tuesday that, despite a request from
the FBI to have it removed, an ISP and the website Ogrish.com will replace
a previously deleted copy of a four-minute video that displays the
execution of Wall Street Journal reporter Daniel Pearl by a radical Muslim
group in Pakistan. Virginia-based hosting company Pro Hosters said that
its decision was influenced by legal support offered by the American Civil
Liberties Union. "We have decided to take the hot seat in this position,
mainly because we and ogrish.com believe strongly in freedom of speech and
freedom of press and the First Amendment," Pro Hosters owner Ted Hickman
told Wired News.

o Court Dismisses ACTV's Interactive TV Patent Suit Against Disney

New York -- ACTV, a provider of interactive TV technology, announced that
the United States District Court for the Southern District of New York has
granted summary judgment for Disney in a lawsuit that ACTV filed against
the company for patent infringement. In its suit, New York-based ACTV
alleged that Disney used its enhanced TV programming technology to offer
interactive features on programs such as "Who Wants to be a Millionaire"
and "Sunday Night Football," which air on networks owned by Disney -- ABC
and ESPN. ACTV said in a statement that it "disagrees strongly with the
Court's decision, and it is currently evaluating its options, including an
appeal."

(Tel Aviv, Israel) Midbar Tech, a provider of CD copy-protection
technology, said on Tuesday that its Cactus Data Shield copy control
system has been installed in seven manufacturing plants in Asia. Included
are Utech and Infodisc in Taiwan and Japan's Toemi (Toshiba EMI), Nippon
Columbia, Memory-Tech and PVC (Pioneer Video Corporation). "The Asian
market is moving ahead very quickly in adopting copy control technology as
a means of combating music piracy," said Midbar CEO Ran Alcalay. "Midbar
has millions of CDS protected CDs in the Asian market. To date, the
releases have gone smoothly and we are pleased with the results."

(Beverly, Mass.) Video game publisher Infogrames said on Tuesday that it
has partnered with Six Flags, an international theme park operator, to
incorporate designs of Six Flags roller coasters into its upcoming
"RollerCoaster Tycoon 2" simulation game for the PC. The simulation game
allows players to create their own theme parks and observe how their
designs work out as simulated crowds patronize their creations. The deal

(Emeryville, Calif.) Search engine Teoma.com saw its visitor growth rise
2100 percent in the month of April 2002, according to figures reported by
Internet measurement firm Nielsen//NetRatings. The new service, which was
taken out of beta on April 2, saw an increase from 25,000 visitors to
nearly one million total in April.

(New York) The New York Times on Sunday featured an article on the current
state of Jupiter Media Metrix, a New York-based Internet audience
measurement and analysis firm. The Times reported that Jupiter is looking
to sell both its Media Metrix Internet audience measurement service and
its Jupiter Research unit within the next 60 days. The company previously
has stated that it would look to sell off certain of its assets in order
to be able to maintain operations, but that it had enough cash on hand to
continue operations for another year. Since a failed merger with rival
NetRatings that was blocked by the Federal Trade Commission over antitrust
issues, the company has sold off its AdRelevance unit as well as its
European customer contracts.
