o TiVo-BBC Promotional Gimmick Angers British TiVo Owners

San Jose, Calif. -- Some British TiVo owners were angered recently when
the company, through a deal with the BBC, commandeered the device's
recording function to record a BBC show and advertise it to users on the
device's start menu. TiVo users are able to freely choose which programs
they wish to record, which are then stored on a limited capacity hard
drive. The BBC program -- "Dossa and Joe" -- was recorded without notice
or permission of users, who were also not permitted to delete the program
from their TiVo for four days. San Jose, Calif.-based TiVo, while
defending the practice of "pushing" content to TiVo owners, has since
admitted that it should have been more upfront with the BBC promotion.
"TiVo's always been about both choice and control of the content you
want," TiVo senior vice president Brodie Keast told The Los Angeles Times.
"For some viewers in the U.K., this didn't feel consistent with that
philosophy."

o Radio Firm Entercom to Cease Streaming of All Online Stations

Bala Cynwyd, Penn. -- Entercom Communications, which operates 101 radio
stations in the U.S., has announced that due to a combination of lack of
revenue, uncertainty about royalty rates and other legal issues, it will
cease online streaming of all of its stations, Radio and Internet
Newsletter (RAIN) reported. "Given the combination of costs, legal issues,
and technology involved, streaming just isn't a smart business decision,"
Entercom director of Internet operations Amy Van Hook told RAIN.
Pennsylvania-based Entercom had only 20 stations streaming their signals
online at the time of the announcement; that number dwindled from 54 over
the course of a year due to a dispute over voice actors' royalties for
appearances in streamed commercials and a fee structure change at Tacoma,
Wash.-based StreamAudio, which provides the company's streaming services.

o Games Firm Bam Entertainment Loses Trademark Case Over Ultimate Fighting

Las Vegas -- Zuffa LLC, owner of the Ultimate Fighting Championship mixed
martial arts sporting events franchise, announced on Friday that it has
won a trademark suit against video game developer Bam Entertainment. Las
Vegas-based Zuffa argued that Bam's depiction of an octagonal-shaped
fighting ring in its title "Fire Pro Wrestling" for Game Boy Advance
closely resembled the Ultimate Fighting ring. San Jose, Calif.-based Bam
was ordered to stop using the 8-sided ring both in the game and on any
marketing materials. Zuffa added that it has already licensed the video
game rights for the Ultimate Fighting Championship to Los Angeles-based
developer Crave Entertainment, which has created games based on the sport
for PlayStation, PlayStation 2, Xbox and GameCube.

o XM Satellite Radio in Talks With Wireless Companies About Interference

Washington, DC -- XM Satellite Radio, a provider of satellite-delivered
digital radio programming, is in talks with wireless companies aimed at
resolving complaints that XM's service interferes with wireless
communications services, Reuters reported. XM rival Sirius Satellite Radio
is also participating in the talks. "The two sides have been bickering
over the satellite services using equipment to extend their digital radio
signals to hard-to-reach areas like metropolitan areas where skyscrapers
can block satellite beams," Reuters reported. "Such equipment, called
ground-based repeaters, could interfere with some wireless communications
services." The Federal Communications Commission has granted XM and Sirius
temporary permission to use the repeaters, but has asked the companies to
try to work out their differences with wireless companies.

o Courtney Love's Claims Against Vivendi Universal Going to Trial

Los Angeles -- A Los Angeles Superior Court judge has denied several
motions from Vivendi Universal Recordings, Inc., resulting in singer and
actress Courtney Love's case against the company proceeding to trial on
June 11. Love sued her former record label Geffen, now a part of Vivendi,
in a bid to challenge the accounting and contractual practices of record
companies. Judge Fumiko Wasserman, however, did throw out one of Love's
claims, which argued that a California labor code section allowing record
companies to sue artists for damages was invalid and unconstitutional.
"When we first filed this case, many prognosticators in the music industry
said Courtney's suit was frivolous and shrugged it off," said A. Barry
Cappello, Love's attorney. "I doubt they feel the same way now." Love has
appeared in films including "The People Vs. Larry Flynt," leads the band
Bastard and is the widow of the late Nirvana singer Kurt Cobain.
