o Napster Files for Ch. 11 Bankruptcy; Company Owes $101 Million

Redwood City, Calif. -- Napster, the embattled file-sharing service that
last week was acquired by Bertelsmann for $8 million, announced on Monday
that it has filed for Ch. 11 bankruptcy protection in the state of
Delaware. The Ch. 11 filing will effectively put on hold the numerous
copyright infringement claims pending against Napster from the major
record labels. Reuters reported that, according to the company's
bankruptcy court filing, Napster holds $7.9 million in assets and has
debts totaling $101 million. Bertelsmann, the German media firm that has
been funding the company's transition to a paid service and last week
acquired the company, is owed $91 million. Napster's legal representation
in defending against copyright litigation, Boies, Schiller & Flexner LLP,
is owed $2.14 million. The filing also shows that Napster has asked for
$5.125 million of "debtor-in-possession" financing from Bertelsmann.

o Sonicblue Wins Reversal of Ruling Asking for ReplayTV Viewer Data

Santa Clara, Calif. -- Sonicblue, the consumer electronics firm that
manufactures the ReplayTV personal video recorder, announced on Monday
that a U.S. District Court judge has overturned a previous magistrate
judge's ruling that would have forced the company to rewrite its software
to track the viewing habits of ReplayTV owners. A group of movie studios
and television networks sued Santa Clara, Calif.-based Sonicblue, arguing
that device features that let consumers skip through commercials in
recorded programming and send recorded shows to other ReplayTV owners over
the Internet constitute copyright infringement. The studios and networks
asked the magistrate to order Sonicblue to provide data on how consumers
use these features, an order that would have necessitated developing and
deploying new software, as Sonicblue does not collect such data on
viewers. "This is an important victory for us in the litigation, but most
importantly, it's a victory for our consumers," said Sonicblue CEO Ken
Potashner. "If the networks and studios focused on the inevitable
evolution of their business instead of attempts to stifle technology, we
believe everyone involved would benefit, consumers most of all."

o Online T-Shirt Seller Sues The Osbournes for $15 Million

New York -- An online retailer of self-described "offensive" T-shirts,
TshirtHell.com, has filed a $15 million lawsuit against Ozzy and Sharon
Osbourne, Sony Music and Epic Records, alleging a TshirtHell.com slogan
was used without the site owner's permission. According to TshirtHell.com
owner Aaron Landau Schwarz, his site began selling a shirt with the slogan
"F*** My Family, I'm Moving In With The Osbournes!" in March 2002.
Osbourne's record label, Epic Records, purchased $500 worth of the shirts
for promotional purposes. Schwarz then says that two months later, the
Osbournes began selling T-shirts both online and in retail stores bearing
the slogan, "F*** my family! I'm movin' in with. The Osbourne Family." The
lawsuit seeks to have all profits from the offending shirt turned over to
Schwarz, as well as $15 million in damages.

o Interactive TV Firm ExtendMedia Gets Investment from Liberate

Toronto -- ExtendMedia, a developer of interactive television content,
announced on Monday that it will receive an investment of up to $350,000
from San Carlos, Calif.-based Liberate Technologies, a provider of
operating system software for set-top boxes used to deliver interactive TV
services. Toronto-based ExtendMedia is currently working on several
projects for Liberate, including the development of content for cable
companies in North America. The company has created interactive
programming for networks and cable TV operators including PBS, HBO,
Showtime Networks, Discovery Communications and Cablevision.

(Washington) The Business Software Alliance, a trade association of
software developers including Adobe, Apple, Macromedia and Microsoft,
announced that it has deployed New York-based MediaForce's online
anti-piracy services. The MediaForce technology scours peer-to-peer
file-sharing services, Internet Relay Chat (IRC) channels, webites, File
Transfer Protocol (FTP) sites and newsgroups, tracking unauthorized copies
of various software programs. In the three months that the BSA has used
MediaForce's services, the group says it has sent 8,500 notices to
software infringers' ISPs -- more than the total number it sent in 2001.

publisher during the month of April, according to sales figures released
on Monday by market research firm NPDFunworld. Santa Monica-based
Activision, whose games include "Tony Hawk Pro Skater 3" and "Return to
Castle Wolfenstein," was the only company to place games in the top 5 for
every leading console for the month. The company increased its market
share in the U.S. console business to 15.3 percent for the month, as
compared to 6.1 percent for the same period last year; dollar sales also
increased 179 percent over last year's comparable period.

Monday the release of its ReplayTV 4500, the newest version in its line of
personal video recorder devices. The new model adds modem support for
standard phone line connections, a redesigned software package and a
service-based pricing model. Consumers will be asked to pay a one-time
activation fee of $250 per device; the actual price of the device ranges
from $449 for 40 hours of TV recording capacity to $1749 for 320 hours
capacity.

subscription service, announced on Monday that JamBase will become a
distribution partner for Rhapsody. Mill Valley, Calif.-based JamBase will
market the Rhapsody service, which offers on-demand music streaming for a

high-speed cable Internet subscribers who are splitting their cable modem
line and connecting it to their televisions in order to receive free cable
TV. The same line that delivers high-speed Internet from cable TV
providers also carries their television signals, and basic or analog
signals can be pirated relatively easily. To obtain premium channels, such
