o Digital TV Group Proposes "Broadcast Flag" to Stem Potential TV Piracy

Los Angeles -- A group of consumer electronics firms, TV networks and
movie studios has agreed on a proposal that would insert a digital
watermark called a "broadcast flag" into all digitally broadcast TV
programs, in an effort to prevent the pirating of digital TV signals as
has occurred in the music industry. Although the Broadcast Protection
Discussion Group (BPDG) agreed on the need for a broadcast flag, as well
as technology for consumer electronics like DVD players and personal video
recorders that would prohibit recorded shows with the flag from being
traded online, the group is still at odds on how to implement its
proposal. "The broadcast flag is defined -- we have the outlines and, in
some cases, the details of how to do it," Jim Burger, an attorney for the
PC industry's interests in BPDG, told The Washington Post. "But there are
some significant pieces that would need to be agreed upon." The motion
picture industry hailed the proposal, but said forces in Washington may
need to intervene to achieve a standard. "Ultimately some of these issues
may have to be decided by the Congress or the Federal Communications
Commission," said Motion Picture Association of America CEO Jack Valenti.
Consumer groups and digital civil liberties groups such as
DigitalConsumer.org and the Electronic Frontier Foundation derided the
proposal, arguing it will take away consumers' traditional fair use
rights. "The discussion group 'recommendations' are little more than a
litany of industry demands that protect the interests and profits of a
powerful few at the expense of long standing consumer rights," said Joe
Kraus, co-founder of DigitalConsumer.org.

o Report: Internet-based Video-on-Demand to Generate $1.9 Billion by 2006

Scottsdale, Ariz. -- Increased deployments of DSL and cable-based
broadband Internet services worldwide will spur Internet-based
video-on-demand services to generate revenue of $1.9 billion from 17
million users by 2006, according to a report released on Wednesday by
Scottsdale, Ariz.-based research firm In-Stat/MDR. The report says that
Hollywood movies will soon overtake the adult entertainment Internet
video-on-demand segment, which is predicted to $460 million worldwide in
2002, or 98 percent of the entire market. Services such as CinemaNow,
Intertainer, MovieLink, and Movies.com will expand in the U.S. and in
Asian countries like South Korea, Taiwan and Singapore, which are expected
to represent 37 percent of worldwide Internet video-on-demand revenue by
2006. "Several million movie streams per month are currently being served
up for free, but as the major movie studios enter the fray with premium
movie titles, pay-per-view and subscription services will gain traction,"
said In-Stat/MDR principal analyst Gerry Kaufhold.

o Activision Secondary Stock Offering Could Raise Up to $273 Million

Santa Monica, Calif. -- Game developer and publisher Activision announced
on Wednesday that it will commence a secondary stock offering of 7.5
million shares, with possible proceeds totaling nearly $273 million.
Underwriter Goldman Sachs is also being offered an over-allotment of
750,000 shares. Santa Monica, Calif.-based Activision, which publishes
games including "Tony Hawk Pro Skater 3" and "Spider-Man," said the
offering was initiated to take advantage of the growth opportunities that
it expects will be afforded by the rapidly growing worldwide installed
base of new console and handheld video game systems. The company will use
the proceeds from the offering for general corporate purposes, including
additions to working capital and the financing of capital expenditures,
joint ventures and strategic acquisitions. "This offering is yet another
step in our strategy to enable us to continue our role as a leading player
in the interactive entertainment industry," said Robert Kotick, Chairman
and CEO, Activision.

o Video-on-Demand Firm Intertainer Gets $9M, Launches European Venture

Culver City, Calif. -- Intertainer, a provider of Internet-based
video-on-demand programming and delivery technology, announced on
Wednesday that it will launch a joint venture in Europe with Italian new
media conglomerate Freedomland. As part of the agreement, Freedomland will
invest $14 million in the joint venture and an additional $9.4 million in
Culver City, Calif.-based Intertainer. Milan-based Freedomland will hold a
51 percent interest in Intertainer Europe and will also receive a minority
stake in Intertainer's U.S. operations. Intertainer will help in acquiring
content and provide distribution technology for Intertainer Europe, which
will be available in forty countries. The company currently provides film
and TV content using Microsoft Windows Media technology and digital rights
management from partners including Universal Pictures, Warner Bros.,
DreamWorks SKG, MGM, A&E Networks, NBC and PBS.

develop wireless entertainment that will utilize wireless technology
developer Qualcomm's BREW (Binary Runtime Environment for Wireless)
platform. San Diego-based Sony Online Entertainment, which offers games

multiplayer "EverQuest," said it will begin developing its recognized
entertainment brands for BREW, which is used by network operators

service using DSL technology. Subscribers will initially receive 12

that it has joined set-top box manufacturer Motorola's Horizon Associate

(San Francisco) Wired News on Wednesday reported on Bumfights.com, a site
set up by two young, independent filmmakers to sell their controversial,
reality-style video that depicts homeless people engaged in fistfights and
other violent acts -- a la David Fincher's film "Fight Club." Although the
video has outraged homeless advocates and others, the filmmakers claim to
have generated over $2 million from sales of 250,000 videos and t-shirts
on the site.

(Washington) The Washington Post reported Wednesday on the ongoing dispute
between webcasters, the recording industry and broadcast radio firms over
proposed rates that webcasters would pay record labels and artists to
stream music online. Jenny Toomey, of the Coalition for the Future of
Music, told The Post that a "one-size-fits-all" rate may be fine for large
corporations but is unfair for smaller webcasters, who may be forced off
the air. Recording Industry of America (RIAA) chairman and CEO Hilary
Rosen argued otherwise. "If there isn't a way to have business models that
even these things out for small labels, I don't know why they should be
evened out for the small webcasters," Rosen told The Post. "We've been
giving our stuff to webcasters for years. Now it is time to get paid for
it." After rejecting rates proposed through a Copyright Arbitration
Royalty Panel, the U.S. Copyright Office is due to set official webcasting
royalty rates on June 20.
