o ReplayTV Video Recorder Owners Sue Hollywood For Right to Skip Over Ads

Los Angeles -- The Electronic Frontier Foundation, a digital civil
liberties group, on Thursday filed suit on behalf of ReplayTV personal
video recorder owners against the major television networks and film
studios, asking for the devices' features that allow them to skip through
commercials and record TV shows to be declared legal. The studios and
networks previously sued ReplayTV manufacturer Sonicblue for copyright
infringement over these features, and have stated publicly that ReplayTV
owners who use such features are "stealing" from them. "These Hollywood
guys want to stop me from using my digital video recorder like I use my
VCR, like for watching shows when I want or zipping through commercials,"
said Craig Newmark, craigslist.com community founder and plaintiff in the
case. "I want to give my nephews and nieces a break from the rampant
consumerism on TV by using ReplayTV's commercial skipping feature."

o Report: Online Gamers Worldwide to Number 114 Million by 2006

San Diego -- The number of online gamers worldwide is expected to grow to
114 million by the year 2006, according to a report released on Thursday
by market research firm DFC Intelligence. Online game usage is expected to
increase six-fold during the period as well. The firm also forecasts that
23 million will be playing console games online by 2006 -- on services
like Microsoft's Xbox Live and other offerings from Sony and Nintendo.
"Microsoft's Xbox Live service is probably the biggest investment in
online games yet. It is likely to be a major indicator of the future of
console online gaming," said DFC Intelligence president David Cole.

interest in Visionik, a provider of interactive television software.
Financial terms of the transaction were not disclosed. Denmark-based
Visionik has designed features including enhanced games, interactive

o File-Sharing Network Grokster Launches Content Direct Marketing Service

Nevis, West Indies -- Grokster, a file-sharing service that uses the same
FastTrack network utilized by Kazaa, announced on Thursday a new direct
marketing service for copyright owners wishing to target their songs or
other content to specific demographics of Grokster users. West
Indies-based Grokster partnered with Virginia-based FileFreedom, a
provider of direct marketing and advertising software for peer-to-peer
networks, to develop the service. Musicians, authors, filmmakers,
photographers and software and game developers can register their content
"for as little as $10" through Grokster, and then use online wizards to
create demographic profiles according to age, gender, postal code and user
tastes. Their content will then be which will then be "pushed" to the
appropriate Grokster users via their Grokster homepage and at the point of
download.

o Nintendo Sets GameCube Sales Goal of 50 Million by 2005

Tokyo -- Video game company Nintendo on Thursday announced a goal to sell
50 million of its GameCube video game consoles by 2005, Reuters reported.
By comparison, Sony's rival PlayStation 2 console has sold 30 million
units since its release in March 2000. The GameCube went on sale in
September 2001. Nintendo also restated its dedication to creating
innovative games, rather than battling with Sony and Microsoft to develop
the most technologically advanced game console. "We're reaching the limits
of how far we can appeal to consumers by boosting the machines'
performance or providing more compelling graphics and sound," said
Nintendo president Satoru Iwata. "For the past few years, we've been
looking for new ways to surprise people, new ways for them to have fun."

30 Reasons to Attend Jupiter Plug.IN -- July 8-9 - NYC

Reason #13: Portability is a long way from Secure Portability.
In the absence of rental-ready digital music devices, portability remains
the Achilles' heel for paid subscription services attempting to compete
with MP3. Non-secure devices will continue to proliferate, with 41 million
users and 70 million devices in 2007. What is the line Subscription
Services must toe between satisfying consumer demand for portability, and
label demand for security? Find out at Plug.IN.

(Redmond, Wash.) Microsoft said on Thursday that a number of audio chip
makers have licensed its Windows Media Audio technology, and will include
support for the technology on their chips used in CD players, car stereos,
portable audio players and wireless handsets. The partnership means that

(London) U.K. news site TheRegister reported on Thursday that the British
Independent Television Council has asked Microsoft to discontinue airing
an ad for its Xbox video game console that was deemed "offensive, shocking
and in bad taste." The ad depicts the life of a man, fast-forwarded from
birth to a scene where the now old man crashes screaming into his own
grave, accompanied by the tagline, "Life is short. Play more." "We have
been asked by the ITC to remove [the ad] from television in the UK only
due to a minority of viewers who complained about the commercial. We did
not set out to offend any viewers, and apologize if we have done so,"
Microsoft said in a statement.

(San Francisco) Online magazine Salon.com on Thursday featured an article
comparing the success of online subscription service Netflix, which allows
consumers to rent DVDs that are then mailed to them from the company, to
the relative lack of success among online music subscription services like
EMusic, Pressplay, MusicMatch and RealNetworks' RealOne. Netflix recently
had an $80 million IPO and counts 600,000 paying subscribers, while the
unprofitable music services have just small fractions of these numbers of
paying subscribers.
