o Senate Commerce Committee to
Revise Proposed Net Neutrality Bill
Washington - The chairman of the Senate Commerce Committee
said on Wednesday that he plans to release a revised version of net
neutrality provisions that have been widely criticized by Internet
content providers, CNET News.com reported. Sen. Ted Stevens
(R-Alaska) said that the move is necessary because "many members do
not believe that the provision in the existing bill goes far
enough." Net neutrality is the notion that network operators should
not be allowed to charge content providers to deliver their content
to consumers more quickly, a concept that would essentially divide
the Internet into a "fast lane" and "slow lane." Current language in
the Senate's communications bill calls for the FCC to oversee the
situation, and report any violations to Congress. Several Democrats
and at least one Republican, however, want language that would
strictly prohibit operators from prioritizing content. The new
language is expected to be released later this week, with a hearing
scheduled for next Tuesday.

Trade Group to Sue Russian Download Store AllofMP3
London - The major record label trade group in the U.K.
has announced plans to sue rogue Russian download store AllofMP3.com
for copyright infringement in the U.K. courts. The site was recently
revealed to be the second-most-popular music download store in the
U.K., behind Apple's iTunes Store. While AllofMP3.com claims to
operate within Russian laws and compensate artists through local
collection societies, the British Phonographic Institute (BPI) said
these claims are false and neither artists nor record companies
receive payments from the site. "We are going to sue AllofMP3.com in
the UK courts -- we are going to seek a judgment not against the
users of the site, but against the site itself," said BPI general
counsel Roz Groome. BPI's counterparts, the Recording Industry
Association of America (RIAA) and International Federation of the
Phonographic Industry (IFPI), last year urged Russian police to
investigate the site. Although Moscow police recommended copyright
infringement charges, Russian prosecutors declined to take up the
case.

Files Second Countersuit Against Creative Over MP3 Player Patents
Singapore - Apple Computer has filed a second patent
infringement countersuit against MP3 player maker Creative
Technology, Reuters reported. Last month, Creative sued Apple and
filed a complaint with the U.S. Trade Representative, alleging the
company's iPods infringed on the user interface design patent on its
own Nomad and Zen MP3 players. Creative asked for damages as well as
an injunction against further iPod sales and import of the devices
from Apple's Asian manufacturers. Apple then filed its first
countersuit against Creative, claiming damages and infringement of
four of its own patents. The second countersuit from Apple was filed
last Thursday in federal court in Texas. It claims Creative
infringes on three additional Apple patents, related to displaying
data on a computer; editing data on a portable device; and the use
of icons in file organization. Court documents seen by Reuters show
Apple is seeking unspecified cash damages and an injunction to
prevent further infringements.

Streaming Music Subscription Revenue to Hit $340 Million in 2006
Dublin - Revenue from subscription-based streaming music
services rose from $49 million in 2003 to $237 million in 2005, and
is projected to surpass $340 million in 2006, according to a report
from Research and Markets. The firm's report chronicling the
emergence and growth of Internet radio also found that there were
about 2.4 million subscribers to Internet music radio services at
the beginning of 2006, which include offerings from RealNetworks,
AOL, Yahoo, MSN, Radioio, Live365.com and Virgin Radio. Tuning hours
for the top ten sites are forecast to reach 360 million hours in
2006, and there are currently over 700,000 average quarterly hour
listeners to online stations, the firm said, citing Arbitron and
Webcast Metrics data. "The pace of Internet music radio growth has
been steady since 2002 when the market retreated in the face of
uncertainty over royalty rights payments, the ad recession, the
general market recession and lack of venture or speculative
capital," Research and Markets said in the report.

Launches Free Broadband Video Content from NBA, N.Y. Times
Alviso, Calif. - TiVo on Wednesday introduced a new
service that allows owners of its digital video recorders to access
broadband video content from the Internet on their televisions. The
TiVoCast service will be available for free to anyone with a TiVo
Series2 box connected to a broadband connection over a home network.
The company signed agreements to offer broadband content from
providers including the NBA and WNBA, The New York Times, Heavy.com,
iVillage, CNET and Here. NBA broadband content will include video
showcases like a highlight reel of the greatest moments in the
history of the NBA finals, while The New York Times will offer A.O.
Scott's film reviews and David Pogue's technology product reviews.
The service will be free for TiVo subscribers, although the company
has included the ability for broadband video providers to integrate
advertising within their content.

Radio Picks Vibes Media for Mobile Marketing Services
Chicago - CBS Radio announced on Wednesday that it has
partnered with mobile marketing firm Vibes Media to launch its
text-message and mobile content marketing programs at 25 CBS Radio
stations in New York, Los Angeles and 16 other U.S. markets.
Chicago-based Vibe's iRadio platform allows listeners to participate
in radio contests and promotions via cell phone text messages, send
text-message song requests, and join mobile radio station clubs that
offer ringtone and wallpaper downloads. CBS Radio stations that will
offer Vibes iRadio include WNEW and WFNY in New York and KROQ in Los
Angeles.

Dulles, Va. - AOL on Wednesday unveiled a new partnership
with drugstore chain Walgreens that will allow users of its free
online photo service to order prints online, then pick them up at
any or more than 5,000 Walgreens locations in the U.S. The service,
known as AOL Pictures, will initially allow users to purchase 4x6,
5x7 and 8x10 prints, and pick them up in as little as an hour. AOL
Pictures also gives users the option of printing photos from home
and ordering prints and other photo products that are delivered by
mail.

label music. Under the terms, New York-based The Orchard is

"What Netflix Could Teach Hollywood"
New York - The New York Times on Wednesday reported on
Netflix, the online DVD rental service that sends and receives 700
million DVDs through the U.S. mail each year. The company stocks
most of the 60,000 total DVD movie and TV titles available, and
surprisingly, rents between 35,000 and 40,000 of these individual
titles each day. While this selection handily beats what is
available from both cable and Internet video-on-demand services,
Netflix CEO Reed Hastings admitted to The Times he expects the
exclusive rights deals that prevent services like Movielink from
offering more than 1,500 titles will eventually disappear, and
provide the company with more competition.
