o Lawmakers Introduce Bill to
Streamline Digital Music Licensing
Washington - Lawmakers on Thursday introduced a bill that
would create a streamlined blanket licensing system for digital
music services. The Section 115 Reform Act of 2006 (SIRA),
introduced by Reps. Lamar Smith (R-TX) and Howard Berman (D-CA), has
the support of the Recording Industry Association of America (RIAA),
National Music Publishers Association (NMPA) and Digital Music
Association (DiMA) -- which represents big webcasters like AOL,
RealNetworks, Live365 and Yahoo. "Our member companies -- digital
music providers, music publishers and recording companies -- stand
much to gain from legislation that will bring music licensing into
the digital era," the trade groups said in a joint statement. The
Electronic Frontier Foundation, a digital civil liberties group,
strongly criticized the bill as potentially eliminating consumers'
traditional "fair use" rights of music, in part because it treats as
license-able "incidental reproductions…including cached, network,
and RAM buffer reproductions." The EFF also warned that the bill
would change classifications of digital transmissions to potentially
outlaw some devices that can make copies of songs, such as the XM
Radio receivers under fire from the RIAA.

o FTC Settles With
Take-Two Over Hidden Sex Content in "Grand Theft Auto"
Washington - Video game publisher Take-Two Interactive and
its Rockstar Games unit on Thursday settled charges brought by the
Federal Trade Commission (FTC) that they failed to disclose
information about sexually explicit content in their "Grand Theft
Auto: San Andreas" video game to consumers. The FTC said the hidden
sexually explicit content in the game should have been reflected in
its original rating. An "M" for Mature rating for the game was
elevated to "AO" for Adults Only -- and removed from many store
shelves at a cost of $24.5 million to Take-Two -- when the hidden
content was discovered. Under the terms of the settlement with the
FTC, Take-Two and Rockstar agreed not to misrepresent game ratings
in the future, and will report to the FTC on efforts to establish a
system to ensure that all game content is considered and reviewed
before submission to the Entertainment Software Ratings Board (ESRB).
Should the companies violate the agreement, they will be subject to
a fine of up to $11,000 per violation.

Online Outpaces Print Ad Growth for Newspapers
Vienna, Va. - Advertising on newspaper websites increased
34.9% in the first quarter of 2006 to $613 million, compared with
print ad growth of 0.3% to $10.5 billion, according to a report from
the Newspaper Association of America (NAA). Overall, newspaper
advertising totaled $11.1 billion in the first quarter, an increase
of 1.8% over the same period last year. "Newspaper publishers are
winning on the Web and their efforts to attract visitors, build
leading Internet properties and monetize their online investments
are being recognized by advertisers and consumers -- as shown by a
full two years worth of outstanding consecutive gains," said NAA
president and CEO John F. Sturm. "Internet revenues are consistent
with our expectations of continued, strong double-digit growth; at
roughly 5.5% of total newspaper advertising revenues for the quarter
are beginning to gain more critical mass." The report also found
that, despite competition from online services like Craigslist,
print classified advertising was up 4.7%, fueled by a 26.3% increase
in real estate ads. "Meanwhile, newspaper print advertising
continues to hold its own in the face of overall ad softness,
reflecting our industry's ongoing dialogue with the advertising
community to demonstrate the enduring value of newspapers' reach and
engagement with consumer audiences," added Sturm.

Launches CD Trading Site That Will Compensate Artists
Palo Alto, Calif. - Lala.com, a site that facilitates CD
trading between members through the mail, on Thursday announced the
official launch of its service. The site claims a catalog of 1.8
million album titles available from its members, who pay Lala.com
$1.49 for each CD they receive from another member. Palo Alto,
Calif.-based Lala.com said it has established a charitable
foundation for musicians -- the Z Foundation -- to which it will
voluntarily contribute 20% of its CD trading revenue to compensate
artists. The company estimates monthly contributions of between
$10,000 and $50,000 to the foundation, which will focus on providing
health and dental care to working musicians. To qualify, a musician
is defined as any individual who has performed live or on a recorded
release in the last year, and whose music-related income accounts
for more than half of total income. Lala.com founder Bill Nguyen
told Reuters that record labels have had mixed reactions to the
service. "One label thought it would help them to know their
customers for the first time," Nguyen told Reuters. "But others'
view of us is as the devil, more like peer-to-peer services."

York Public Library Website Adds Free Movie Download Service
New York - The New York Public Library has added the
ability for its cardholders to download free movies through its
eCollection online service, which is powered by technology from
OverDrive and also offers music, audiobooks and e-books. The movies
may be downloaded to a PC or laptop, and also transferred to certain
portable devices. The online video library includes foreign films
like "The Bicycle Thief" and Fellini's "8 1/2", documentaries,
children's titles, IMAX films and various live performances of stage
productions. Cleveland-based OverDrive said in March it is in
negotiations with providers such as A&E Home Video to add content to
its library movie download service, which is also available from the
website of the Denver Public Library.

Musicrypt Raises $1.5 Million; Patent Dispute With Rival Escalates
Toronto - Musicrypt, a provider of secure digital
distribution of songs at record labels, and between labels and radio
stations, announced on Thursday that it has raised $1.5 million
through the private placement of 7.5 million shares. The company
recently filed patent infringement claims in Canada against rival
Destiny Media Technologies, whose Promo Only system provides
essentially the same service as Musicrypt. For its part, Destiny on
Thursday filed for a declaration stating that Musicrpyt's patent is
invalid and that its Promo Only system does not infringe. "We are
confident in our position and are anxious to have a judge make an
expeditious ruling on this matter as we expect Canada to be an
important market as demand continues to grow," said Destiny CEO

on Thursday that it will ship the industry's first recordable 15GB
HD DVD discs to Japanese retailers in early July. Shipments to other
