o Actors' Unions Avoid Strike, Reach
Deal With Video Game Publishers
Los Angeles -- Averting a potential strike by actors who lend
their voices to video games, the Screen Actors Guild (SAG) and
American Federation of Television and Radio Artists (AFTRA) have
announced a contract settlement with video game publishers, that
increases actors' pay for video game appearances, but stops short of
providing them "residual" payments. The new 3.5-year agreement was
reached on Wednesday, after SAG and AFRTA members failed to vote in
large enough numbers to authorize a strike. The settlement includes
a 36% increase in minimum actor pay over the term, with a 25% raise
to be implemented immediately, in addition to increased benefits for
actors. Video game publishers had argued that residual payments,
which are the standard in TV and movies and pay actors a cut of all
sales, are not warranted for video games. "Our members clearly
support the inclusion of residuals in our Interactive contracts,"
said SAG president Melissa Gilbert. "However, with great reluctance,
our negotiating committee concluded that it is in the interests of
the members who work these contracts to make this deal." AFTRA
national president John Connolly concurred: "We are proud that this
deal significantly enhances wages and increases benefits for
performers in interactive games. While we did not get all that we
want...and deserve… this contract is another important step in
building artists' power in this growing sector of the media
industry."

o FCC Votes to
Accelerate Transition to Digital TV
Washington -- The Federal Communications Commission (FCC) has
voted unanimously to accelerate the transition to digital TV
broadcasting, by moving up the deadline by which manufacturers of
mid-sized TV sets must include a digital tuner. The previous
deadline of July 1, 2006, for mid-sized TVs to include a digital
tuner, has been advanced to March 1, 2006. Additionally, the FCC
proposed to move up the date by which all TVs 13" or larger must
include a digital TV tuner, from July 1, 2007 to no later than Dec.
31, 2006. The FCC asked for public comment both on this issue as
well as whether the digital tuner requirement should be extended to
include televisions with smaller than 13" screens.

Game Retailers GameStop, Electronics Boutique Given OK
Grapevine, Texas -- Video game retailer GameStop Corp. announced
on Thursday that its proposed $1.44 billion merger with fellow
retailer Electronics Boutique will go ahead, following the
expiration of the waiting period under the Hart-Scott-Rondino
Antitrust Improvements Act. The merged company will operate a total
of 3,800 stores worldwide, and account for an estimated 20-30% of
the total video game retail market. The deal must still be approved
by both companies' shareholders, but is expected to close in the
third quarter of 2005.

Satellite Radio to Raise $300 Million in Public Offering
Washington -- Needing to raise cash for satellite-related
expenses, XM Satellite Radio, a provider of satellite radio services
with more than 4 million subscribers, said on Thursday that it plans
to raise about $300 million through a secondary stock offering. The
company is selling 9.7 million shares in the offering, which is
being underwritten by UBS Securities and is expected to close on
June 14. XM said that it will use a portion of the proceeds to pay
for the launch of its next satellite, XM-4, in mid-late 2006, as
well as for the construction of XM-5, to be built by Space
Systems/Loral and scheduled for delivery in 2007. XM has about 211.8
million common shares outstanding.

Journalists Name Best New Titles from E3 Expo
Los Angeles -- A group of journalists from 33 media organizations
has named its top video game picks from last month's Electronic
Entertainment Expo (E3), with Maxis/Electronic Arts' "Spore" taking
Best of Show at the 2005 Game Critics Awards. The event was
broadcast for the first time this year on Spike TV. EA's "Spore,"
developed by "Sims" creator Will Wright, also took the awards for
Best Original Game, Best PC Game and Best Simulation Game. Other
winners included Nintendo's "The Legend of Zelda: Twilight
Princess," which was recognized as Best Console Game and Best
Action/Adventure Game, as well as its "Nintendogs" title for the DS,
which won Best Handheld Game. Monolith/Vivendi Universal's "F.E.A.R."
was named Best Action Game, while Digital Illusions/Electronic Arts'
"Battlefield 2" won for Best Online Multiplayer title, and Namco's
"We Love Katamari" took home the award for Best Puzzle/Trivia/Parlor

Releases Chinese DVD on Same Day as Film's U.S. Theatrical Debut
Los Angeles -- In a bid to stem the rampant piracy of
newly-released films in China, Warner Bros. Entertainment this week
made the unprecedented move of releasing its film "The Sisterhood of
the Traveling Pants" on DVD in China on the same day it debuted in
U.S. theaters, the Los Angeles Times reported. Although the film was
not scheduled for release at all in Chinese theaters, the studio
said it will consider the practice on more prominent titles in the
future, in efforts to battle the large Chinese pirate DVD market.
"We will closely monitor the impact of this release on our other
businesses to determine whether to follow this same release strategy
with more high-profile titles," Warner Home Video president Jim
Cardwell told the Times. Fellow Hollywood studio Sony also recently
released a deeply-discounted DVD of its "Kung Fu Hustle" in China
just over a month after its release in Chinese theaters, and two
months before the film's U.S. release -- adding that it sold nearly
2 million of the discounted DVDs.

Planning to Sell Windows "N" in EU on June 15
Brussels -- Having complied with a number of EU antitrust
sanctions, software giant Microsoft announced that it plans to start
shipping the so-called "N" editions of its Windows XP operating
system, which come without Windows Media Player, to European PC
makers by June 15. Windows XP Home Edition N and Professional
Edition N -- the names chosen by the European Commission from nine
options -- will be available to retail outlets on June 1. Microsoft
said the new stripped-down operating systems would initially be
available in English, German, French, Italian and Spanish, but added
that additional versions in other European languages would be ready
by July 15. Microsoft said consumers who purchased the N versions
and still wanted Media Player would be able to download a Media Pack
from Microsoft's website.

Interactive Pays $7.5 Million to Settle SEC Accounting Charges
New York -- Video game publisher Take-Two Interactive, creators
of the "Grand Theft Auto" game franchise, announced on Thursday that
it has paid $7.5 million to settle charges brought by the U.S.
Securities and Exchange Commission (SEC) over the company's
accounting practices. New York-based Take-Two did not admit or deny
any wrongdoing related to SEC charges it inflated reported revenue
during 2000 and 2001. Several current and former Take-Two employees
-- including former chairman and CEO Ryan Brant, former COO Larry
Muller and former CFO James David -- also settled charges brought by
the SEC, agreeing to pay a combined $1.25 million and also return
$5.1 million in disgorgement and prejudgment interest.

Some Game Rights Back from Infogrames for $65 Million
Pawtucket, R.I. -- Toymaker Hasbro announced on Thursday that it
has reaquired the rights to develop video games based on its
products from France-based Infogrames Entertainment -- the parent
company of Atari -- for $65 million. The initial deal was struck in
December 2000, between Hasbro Interactive and Infogrames' Games.com
site. Hasbro said it has now entered into a new licensing agreement
with Infogrames, giving the company rights to publish games based on
ten Hasbro franchises. While Infrogrames and Atari will still
publish titles based on Hasbro's "Dungeons and Dragons," and a range
of board games like "Monopoly," "The Game of Life," "Clue" and
"Battleship," Hasbro reacquired the video game rights to its
"Transformers," "My Little Pony," "Connect Four," "Candyland" and
other properties.

Firm Adelphia Launches Digital Music Subscription Service
Greenwood Village, Colo. -- Adelphia, the nation's fifth-largest
cable operator -- recently acquired jointly by Comcast and Time
Warner Cable -- announced on Thursday the launch of an online music
service for its high-speed Internet customers. The Adelphia Music
subscription service offers unlimited streaming and downloading of
1.5 million tracks, provided by MusicNet, for $7.95 per month. While
downloads under the plan are tethered to the PC, and will expire if
a subscription lapses, the service also offers permanent downloads
for an additional fee. Adelphia also launched a second subscription
service, offering streamed Major League Baseball games, video clips
from CNN.com and The Weather Channel, online games, printable
greeting cards, and research tools from Encyclopedia Britannica. The
Adelphia NetPak will cost subscribers an additional $9.95 per month.
Adelphia said it partnered with Synacor to create the private-label
music portal and NetPak service.

(London) The Register reports that Apple Japan has denied a
report published in yesterday's Nihon Keizai Shimbun newspaper, and
carried by both The Register and this newsletter, that the company
plans to launch an iTunes Music Store in Japan in August. The
Japanese website Internet Watch quoted an Apple Japan spokesman, who
called the story "completely untrue." Apple said in April that it
plans to launch an iTunes Store in Japan by the end of the year; the
company has been in difficult negotiations with record labels in the
country, over the pricing and terms of song licensing.
