o Report: Online Music Revenues to Grow 33.4% Annually to $4.4B by 2006

Scottsdale, Ariz. -- Despite the current controversy over the delivery of
digital music, online music revenues are expected to increase at a compound
annual growth rate of 33.4 percent between 2001 and 2006 to reach about
$4.4 billion, according to a report released on Monday by Arizona-based
market research firm In-Stat/MDR. "Physical media" such as CDs sold online
will represent the largest share of online music revenues, as revenues
from downloading and streaming are expected to remain less than 10 percent
of total revenues through the year 2004. In-Stat/MDR also predicts that
portable digital music player unit shipments -- which include hard drive-
and flash memory-based digital music players as well as those which play
MP3 CDs -- will grow from about 7.2 million in 2002 to almost 30 million
in 2006. The firm attributes all of these figures to the availability of
file swapping, new online subscription services and portable players with
10GB and higher storage capacities.

o Vivendi, News Corp. Deal Would End Litigation Over Digital TV Piracy

Paris -- French media conglomerate Vivendi Universal has agreed to sell
its Telepiu Italian digital pay TV unit to rival News Corp., in a deal
that would effectively settle a billion-dollar digital TV piracy suit
filed by Vivendi unit Canal Plus Technologies against News Corp. unit NDS.
In its suit, Canal Plus alleged that NDS conspired to hack technology that
protects its digital TV signals against piracy, and then publish this
information online so that pirates could use it to steal TV signals.
MSNBC.com reported that Canal Plus "had promised to march a series of
computer hackers before the court, threatening some embarrassing
revelations." Reuters reported that until the transaction is approved, all
litigation between the two firms will be halted. "I'm optimistic the
lawsuit will be dismissed and that's great news for NDS," Credit Suisse
analyst Can Elbi told Reuters.

o Broadband Provider Speakeasy.net Raises $6 Million in Second Round

Seattle -- Speakeasy.net, a nationwide provider of high-speed Internet
access services mainly via DSL, announced on Monday that it has raised $6
million in its second round of venture capital financing. New investor
Cornerstone Ventures led the round; previous investors Matthew G. Norton
and Granite Ventures also participated. Seattle-based Speakeasy.net's
digital media efforts include partnering to create a broadband service
tailored specifically for online gamers, and serving as a distribution
partner for Listen.com's Rhapsody digital music subscription service. The
company will use the funds to accelerate expansion into the small and
medium business market, build-out its network into regional areas and add
depth to its coverage in targeted urban markets.

o Rogue Movie Site Film88.com Announces Voluntary Shutdown

Tehran, Iran -- Film88.com, a site that irked the motion picture industry
by offering whole movies streamed online for $1, without having obtained
necessary licensing, announced that it will shut down its service. "We
wish to apologize to all users, Geeks, our service providers and
Hollywood, and hope that they will accept our apology for inconvenience
caused, if any," reads a note on Film88.com. In addition to efforts by the
Motion Picture Association (MPA) to have the company's ISP shut down
Film88.com, as well as an earlier incarnation called Movie88.com, the
company said in a note on its site that technical problems with its
streaming service also contributed to its shutdown. Film88 says it offered
Hollywood movie studios 30 percent of the site's revenue to compensate for
the use of their copyrights, but stated that "Hollywood has reacted
negatively" to the offer.

o Game Developer Midway Games to Repurchase $25 Million in Stock

Chicago -- Video game developer Midway Games on Monday announced that its
board of directors has approved a $25 million stock repurchase program.
Chicago-based Midway plans over the next year to repurchase from time to
time in open market or privately negotiated transactions about $25 million
worth of its own shares. The company currently has about 48.2 million
common shares outstanding.

the growing number of files being downloaded from file-sharing services
such as Kazaa that, instead of containing a full song, actually are little
more than loops of part of the song -- intended to both dissuade
file-sharing and to compel users to buy the physical CD. The article
points in particular to files purportedly containing songs from the
recently released Eminem album, "The Eminem Show," which in fact are
spoofs. There is some belief that the bad files are being seeded onto
networks by record labels themselves, but no direct evidence exists;
