o Consumer Class Action Suit Seeks Prohibition of Copy-Protected CDs

Los Angeles -- Several California consumers have launched a class-action
law suit against the major record labels, asking a court to make music
companies add warning labels or else impose an injunction against the
distribution of copy-protected CDs, The Los Angeles Times reported.
Matthew Dickey of Huntington Beach and Elizabeth Koluncich of San
Bernardino, California filed the suit, which argues that copy-protected
CDs are inferior products and in some cases hazardous to hardware. Their
case is being handled by the law firm of Milberg Weiss Bershad Hynes &
Lerach. Both consumers purchased copy-protected CDs and then either
couldn't make a personal back-up copy of the disc or could not play the
disc on a computer. "Music creators have the right to protect their
property from theft, just like owners of any other property," Recording
Industry of America president Cary Sherman told The Los Angeles Times.
"Motion picture studios, and software and video game publishers have
protected their works for years, and no one has even thought to claim that
doing so was inappropriate, let alone unlawful.

o Digital Music Firm FullAudio Raises $13 Million in Third Round

Chicago -- VentureWire reported on Friday that FullAudio, a provider of
branded digital music subscription services for radio stations and other
companies, has raised $13 million in the first closing of an
oversubscribed third round of funding. Investors in the round were not
disclosed, as the round is ongoing. The company is reportedly looking to
raise a total of $17 million for the round. Chicago-based FullAudio
operates the subscription services offered by radio giant Clear Channel,
which lets users download songs from artists on labels including BMG,
Universal, EMI and Warner Music.

o 24/7 Real Media Settles Ad Patent Suit With Advertising.com

New York -- Online advertising firm 24/7 Real Media announced that it has
settled its patent litigation against Advertising.com over online ad
delivery technology. Financial terms of the settlement were not disclosed,
but Baltimore, Md.-based Advertising.com will license 24/7 Real Media's
technology for future use.

o EU Examining Privacy Issues With Music Player Software

Brussels, Belgium -- The European Union is looking into music player
software that relays information on what songs and albums consumers are
listening as a possible invasion of privacy, Reuters reported. The EU is
most concerned with privacy issues surrounding Microsoft's .NET
initiative, but said it is also looking into other software that retrieves
consumer data and reports back to companies for purposes such as targeted
advertising. "We got complaints about Passport and have launched a debate
on that,'' an EU officer told Reuters. "As far as other software is
concerned, we are looking at all data gathering systems, but no
investigation has been launched." Companies including Microsoft,
RealNetworks and Gracenote all distribute software that admittedly
collects some form of data from its users and reports that data back to
the company.

companies, is expected to announce on Monday that Universal Classics &
Jazz International, a division of Universal Music Group, will promote a
new release from jazz artist Nils Petter Molvaer over SMS message

Switzerland and Australia. The new album will feature a sticker with a

(Washington) Radio and Internet Newsletter (RAIN) published a report
Friday on yesterday's hearing held by the House Subcommittee on Courts,
the Internet and Intellectual Property on the Copyright Arbitration
Royalty Panel (CARP) process, used by the U.S. Copyright Office to
determine recording industry royalty rates. The U.S. Librarian of Congress
rejected the most recent CARP's proposed rates last month; he is expected
to offer a revised royalty scheme by June 20.

Microsoft chairman Bill Gates' relationship with the cable television

decision not to include copy-protection developed by Macrovision on DVD
and VHS releases of the popular "Harry Potter and the Sorcerer's Stone" in

"short-sighted" and warns that it "undermines the legitimate market for
