o U.S. Intl. Trade Commission to Investigate Creative-Apple Patent Dispute

Scotts Valley, Calif. - MP3 player maker Creative Technology announced on Wednesday that the U.S. International Trade Commission (ITC) has answered its complaint and will launch an investigation into Apple's possible infringement of its MP3 player patent. Creative filed the ITC complaint in May, at the same time it sued Apple in federal court for infringement of its "ZEN Patent," which covers the user interface design on its Creative Nomad and Zen MP3 players. The complaint seeks an injunction against the import of Apple's iPods from the company's Asian manufacturers; the separate lawsuit seeks additional damages. Apple, for its part, has filed two countersuits against Creative, alleging the company's MP3 players infringe on several of Apple's patents. The ITC will likely hold an evidentiary hearing on Creative's complaint within the next eight months, and offer a ruling within a year to fifteen months.

o Blockbuster Files Counterclaim Against Netflix in Patent Dispute

Dallas - Video rental giant Blockbuster on Tuesday filed a countersuit against online DVD rental firm Netflix, claiming the patent infringement lawsuit Netflix filed against Blockbuster is "based on unenforceable patents that Netflix obtained through deceptive practices in an attempt to monopolize the online rental business." "For Netflix to claim exclusive rights over subscription movie rentals is like a fast-food restaurant trying to patent selling hamburgers through a drive-through window," said Marshall B. Grossman, an attorney representing Blockbuster. Netflix currently claims 4.9 million subscribers, while Blockbuster counts 1.3 million subscribers to its online rental service. Grossman also discounted Netflix's online movie queue technology: "We think it is obvious that if you are going to provide subscription rentals over the Internet, you have to let your customers list the items they want to receive and enable them to periodically update their lists," he said. Blockbuster's suit also claims Netflix failed to inform the Patent Office of prior innovations by NCR Corp. it was aware of that related to the technology it intended to patent -- a legal duty of patent applicants. Netflix sued NCR in March to have those patent claims invalidated.

o AOL Chairman: Company Has "No Desire" to Sell European Operations

Dulles, Va. - AOL chairman Jonathan Miller said on Wednesday that his company has no plans to sell its European arm, MarketWatch reported. Speaking at a conference in New York, Miller said that AOL has "no desire to sell AOL Europe," and in fact plans to expand its web presence throughout the continent. Miller, however, was less certain whether the company would continue to offer dial-up Internet access in Europe. Some news organizations had previously reported that AOL had retained Citigroup to help review the options for its European business.

o 10th Annual Webby Awards Presented at Ceremony in New York City

New York - The International Academy of Digital Arts and Sciences held its 10 Annual Webby Awards ceremony on Tuesday night, where those recognized for their outstanding websites in a range of categories gathered and delivered the Awards' trademark five-word acceptance speeches. The event was held in New York City and emceed by "Daily Show" correspondent Rob Corddry. When accepting his Webby Lifetime Achievement Award, Prince told attendees, "Everything you think is true." o MusicGremlin Introduces PC-Free Portable Digital Music Player

New York - MusicGremlin on Wednesday announced the availability of its wireless digital audio player for purchase from Amazon.com and its own website. The $299 device connects to MusicNet's library of two million licensed tracks over any Wi-Fi connection, and can then download tracks to the 8GB portable player without a PC. Browsing the MusicNet library is also possible without an active connection; songs purchased offline are then automatically downloaded the next time the device goes online. In addition to loading songs to the player from a PC, users can also subscribe to an unlimited tethered downloads service from MusicNet for $14.99 per month, or else purchase permanent song downloads for 99 cents each.

o Report: PC In-Game Ad Revenue to Top $400 Million in 2009

Dallas - Revenue from in-game advertising on PC game titles is expected to grow from $80 million in 2005 to more than $400 million in 2009, according to a report from market research firm Parks Associates. "Advertisers will soon realize they can reach the whole family using this medium," said Parks Associates analyst Michael Cai. "More and more adults play video games with their children and teens are even playing games with their parents. In addition, the 35-54 female gamers, who spend tens of hours playing casual games every month, are undermonetized." The online survey of more than 2,000 Internet gamers found that males under 34 are more open to seeing in-game ads than other groups; this group grows when the ads enhance game play, or if there is a chance to win prizes. Almost half of men under 35 said they prefer product placement over pre-game ads, while 42% of women over 35 said they prefer pre-game ads by a slim margin over product placement (36%). Most gamers additionally said they expect a discount on game prices in exchange for having to view ads.

o Universal Music to Promote Artists in "Second Life" Online Virtual World

New York - Major record label Universal's Motown Records Group announced on Wednesday that it has partnered with "Second Life," an online game where users interact in a virtual 3D environment, to create a space within the game where fans can interact with Universal artists and purchase music. "Soundscape" will feature virtual "meet and greets" with Universal recording artists including Chamillionaire and Hinder, where players' 3D avatars can chat in real-time with the artists' 3D avatars. The space will also feature the artists' music videos, and links to purchase their songs and albums online.

o Official World Cup Site Draws 5 Million Visitors on First Day

Reston, Va. - The official World Cup soccer site drew more than 5 million unique visitors worldwide on the tournament's first day last Friday, according to new figures from comScore Networks. The multi-language site, hosted by Yahoo, also served more than 400,000 video streams on the day. comScore said that 57% of the page views on opening weekend were from the English language section of the site. Of the non-English content, the Spanish-language section proved the most popular (14%). The BBC's online coverage of the tournament's opening days also proved popular. On opening day, the network's World Cup site received more than 1 million visits.

o PBS Names KQED Veteran John Bolan as First Chief Content Officer

Arlington, Va. - PBS on Wednesday announced the creation of a new position -- chief content officer -- and named KQED executive vice president John Boland to be the first person to serve in the new role. Bolan will direct PBS' TV programming, new media, education and promotion, overseeing delivery of content on platforms including the Web, video-on-demand and digital TV multicasting. "John Boland is the ideal person to help PBS realize the full potential of the digital revolution to serve and interact with audiences in new and meaningful ways," said PBS president and CEO Paula A. Kerger. "He has successfully created a model digital content organization at KQED, and is a respected leader in public broadcasting."

o Qpixel Technology Raises $25 Million in Second Round

Cupertino, Calif. - Qpixel Technology International, a developer of video and audio encoders and decoders for the digital consumer electronics and digital video communication industries, said on Wednesday that it has secured $25 million in its second round of funding, led by venture capitalist Bandel Carano. Other participants included Oak Investment Partners, Technology Associates Management Company (TAMC), Acorn Campus and iD SoftCapital Group. The company said that it will use the proceeds to expand its sales and marketing efforts, as well as accelerate its business and product development. Cupertino, Calif.-based Qpixel's technology is used in next-generation consumer electronics products, such as digital camcorders, digital still cameras, video phones and digital video recorders.

o Survey: Father's Day to Account for $9 Billion in Consumer Electronics Sales

Arlington, Va. - Father's Day consumer electronics gifts could account for more than $9 billion in spending this year, according to a new report from the Consumer Electronics Association. Then industry organization said that 24% of adults and 38% of teens are planning to purchase a consumer electronics device for their fathers this holiday. Though fathers surveyed far and away chose a "nice restaurant meal" as their most desired gift, 42% of them said that they'd like a consumer electronics device -- led by MP3 players and digital cameras -- beating out traditional options such as clothing (40%) and grilling equipment (30%).

New York - Social networking site MySpace is soliciting bids from Google, Yahoo and MSN for the rights to provide search-based ads to its 85 million members, Reuters reported. "We will auction off our search business to Google, Yahoo, or MSN," News Corp. chief operating officer Peter Chernin said on Tuesday, adding, "We've just scratched the surface of how to monetize (MySpace)."

o Blinkx Logs 4 Million Hours of Video in Web Search Index

San Francisco - Blinkx, a searchable index of Web video, announced on Wednesday that it has now accumulated 4 million hours of video content, making its Web video search engine more comprehensive than those offered by both Google and Yahoo. San Francisco-based Blinkx said it now serves over 3.5 million video search queries each day. New York - AOL announced on Wednesday that its AOL Black Voices section will offer a streaming sneak preview of the first episode of Sundance Channel's eight-part documentary series "House of Boateng," which chronicles the launch of fashion designer Ozwald Boateng's first clothing line. Redmond, Wash. - Microsoft's MSN Video announced on Wednesday that it will provide an exclusive webcast of the Dixie Chicks' first concert appearance in over two years, on Thursday from London's Shepherds Bush Empire. The performance will be broadcast at 10 p.m. EDT on June 15, and also adjusted globally for different time zones. MSN signed a two-year agreement with the band last year, which includes the placement of an MSN writer with the band for a year, and the rights to stream the band's new album from the MSN website.
