o RealNetworks Releases Its First Copyright Protection Technology

Seattle -- Media delivery technology provider RealNetworks released new
software on Wednesday designed to secure the licensing and delivery of
music and movies on the Internet, and compel more copyright holders to
release their works in a digital format. The RealSystem Media Commerce
Suite will be the technology used to protect songs on MusicNet, the
digital music paid subscription service that RealNetworks is developing
with AOL Time Warner, Bertelsmann and EMI. Seattle-based RealNetworks also
announced that it is working with a number of companies including Adobe,
IBM and Sony Pictures Digital Entertainment to develop a standardized
language called XMCL, which would govern the sale of digital media.
RealNetworks says XMCL will provide content providers with the ability to
use a number of rights management systems interchangeably, and more easily
offer the same content through different options like purchase, rental,
video-on-demand or subscription services. Notably absent from the list of
XMCL supporters is Microsoft, which has developed its own similar language
for e-books that it also plans to implement for movies and music.

o Mistrial Declared Over Fuzzy Math in MP3.com, TVT Records Case

Los Angeles -- A judge on Tuesday declared a mistrial in a copyright
infringement case filed by TVT Records against San Diego-based MP3.com, in
which jurors miscalculated the amount of damages it intended to award TVT.
U.S. District Court Judge Jed Rakoff told reporters that jurors had
"apparently omitted a zero" when calculating damages, and awarded TVT
about $300,000 when it meant to give them closer to $3 million. MP3.com
publicly praised the original award of $300,000 by the jury -- the company
could have been liable for as much as $8.5 million -- and said it would
seek to have a jury preside over all future copyright infringement claims.
The online music company has already been forced by judges to pay over
$150 million to record companies from other copyright infringement claims.
A new trial is set to begin on November 5th.

o Loudeye Technologies Buys Ad Insertion Firm Addition Systems

Seattle -- Loudeye Technologies, a provider of digital media encoding and
delivery services, announced on Wednesday that it has acquired Addition
Systems, a provider of technology that inserts ads into streaming media.
Terms of the transaction were not disclosed. El Segundo, Calif.-based
Addition Systems' technology can insert ads in syndicated broadcast
content that covers over the ads that appeared in the original broadcast
version of the program. This allows rebroadcasters to avoid extra fees
they would have to pay commercial actors. Seattle-based Loudeye said it
will offer Addition Systems' software as a standalone product, as well as
integrate it into its own products for Web and terrestrial radio
rebroadcasters. Loudeye also encodes and provides streaming song samples
to retail websites on behalf of all five major record labels.

o Sony Launching Consumer Broadband Entertainment Service

Long Beach, Calif. -- Sony Pictures Digital Entertainment announced that
it will launch an entertainment service aimed at young amateur musicians
and filmmakers that lets them create works online, the Associated Press
reported Wednesday from the Streaming Media West Conference in Long Beach,
California. The basic Screenblast service will let users edit together and
remix bits from Sony Music artists and clips from Sony Pictures offerings,
such as "Men in Black" and "Dawson's Creek." A paid upgrade lets users
upload and edit their own music and movies online, as well as host the
finished products so that others may see them on the site.

o MIT Sues AOL Time Warner, CNET Over 'Technology Review' Trademark

Cambridge, Mass. -- The Massachusetts Institute of Technology has filed a
trademark infringement suit against Time, Inc. and CNET Networks over a
new publication it is planning called "Fortune/CNET Technology Review,"
the Associated Press reported. MIT claims the magazine's title infringes
on its "Technology Review," which has been in print since 1899 and
trademarked since 1957. MIT is reportedly not seeking monetary damages in
the lawsuit.

o DirecTV to Use Global Crossing's Network for Personal Video Recorders

Beverly Hills, Calif. -- Global Crossing, a provider of global networking
services for broadcasters, announced on Wednesday that digital TV provider
DirecTV will use the company's fiber optic network to transmit data
destined for users with personal video recorders such as TiVo and
UltimateTV. The service will connect DirecTV's Los Angeles and
Colorado-based broadcast facilities. Beverly Hills-based Global Crossing's
network covers over 100,000 miles of cable that stretches between 200
cities. The company raised $100 million in April to develop a "worldwide
media and entertainment extranet," for which it expects DirecTV to be an
anchor tenant.

o Kodak Invests in Video Conversion Firm YesVideo

San Jose, Calif. -- Kodak announced on Wednesday that it has made an
undisclosed investment in YesVideo, a provider of services that convert
home video onto CD, DVD or content for the Web. Consumers can either mail
their videotapes to San Jose-based YesVideo or drop them off with
participating retailers. The two companies will work together to develop
new products for sale through Kodak's established distribution channels.
They will also merge Kodak's digital photography and digital video
services and integrate Kodak's photofinishing services into YesVideo's
products.

o Streaming Services Firm e-Media Merges with Zerotree Technologies

Stamford, Conn. -- e-Media, a provider of streaming media services and
hosting, announced on Wednesday that it will merge with Zerotree
Technologies, a developer of video compression technologies. Under the
terms of the transaction, e-Media shareholders will hold 50 percent of the
company following the merger. Connecticut-based e-Media's CEO Al Barber --
the former president of financial network CNBC -- will remain CEO of the
new company, which will be called e-Media and operate out of Stamford,
while Zerotree CEO Greg Brogger will become president. The merged company
will maintain Zerotree's research and development facility in Calverton,
Maryland.

Services (PWS) announced on Wednesday that it has licensed a wide variety
of music compositions from Sony/ATV Music Publishing for use as cell phone
ringtones. Cell phone users that are equipped to use SMS ("short messaging
service") can make their phones ring to the tune of songs by artists like
the Beatles, Destiny's Child and Ricky Martin. In the U.S., Santa
Monica-based PWS provides ringtones to Cingular customers, and has served
over 60 million ringtones to 10 million customers in Asia and Canada.

technology for wireless devices, announced on Wednesday that San
Diego-based PacketVideo has licensed its MPEG-4 video technology to the

service that it says will make it easier for artists to register their
works with the U.S. Copyright Office. San Diego-based MP3.com's Copyright
Wizard offers to complete the necessary forms, burn CD copies required for
the process, and submit the entire application to the Copyright Office on
behalf of artists. The service starts at $59.95 for those already in its
Premium Artist Service, and $69.95 otherwise.

questioning the recording industry's argument that Napster has had a
negative effect on CD sales. The article quotes major retailers who say
that the lack of high-selling albums this year as compared with 2000, as
well as a general downturn in the economy were more likely factors in
weaker sales. It also points to SoundScan figures that say CD sales
actually went down after Napster started to implement the court-mandated
filtering of copyrighted songs.
