o Copyright Office Sets Webcasting Royalty Rates; $0.0007 Paid By All

Washington -- The U.S. Copyright Office on Thursday made a final
determination of the official royalty rates that webcasters must pay
copyright holders to stream music on the Internet. The Librarian of
Congress, on the recommendation of the Register of Copyrights, rejected a
proposal submitted by a Copyright Arbitration Royalty Panel (CARP) on May
20, and the Librarian issued final rates today. The most significant
difference between the CARP's determination and the Librarian's decision
is that the Librarian has abandoned the CARP's two-tiered rate structure
of $0.0014 per performance for "Internet-only" transmissions and $0.0007 for
each retransmission of a performance in an AM/FM radio broadcast, and has
decided that the rate of $0.0007 will apply to both types of transmission.
Other changes include: some other rates for noncommercial broadcasters
decreased, and the fee webcasters and broadcasters must pay for the making
of ephemeral recordings has been reduced from 9 percent of the performance
fees to 8.8 percent. The Librarian of Congress' ruling goes into detail
explaining why it made changes to the CARP's recommendation, and exactly
what the changes are. The rates will go into effect on Sept. 1, 2002, but
webcasters will be compelled to pay royalty rates retroactively for all
music they have streamed since October 28, 1998. All retroactive royalties
must be paid by Oct. 20, 2002.

o 'Net Gambling Bill Passes House Judiciary Committee Vote

Washington -- A revised bill from Rep. Bob Goodlatte (R- Va.) that would
outlaw most forms of online gambling has passed muster by the House
Judiciary Committee, despite complaints from opponents that the bill was
too restrictive and contained too many loopholes, Reuters reported. The
bill must now be approved by the Financial Services Committee before going
before the entire U.S. House. If passed, the bill would outlaw U.S.
citizens' use of offshore gambling sites, enable law enforcement to go
after such sites and allow U.S. banks to refuse to pay U.S. gamblers'
debts.

o Online Ad Firm L90 Avoids Nasdaq Delisting

Los Angeles -- L90, an online advertising firm, announced on Thursday that
the Nasdaq Listing Qualifications Panel has determined to continue listing
the company on the Nasdaq National Market. The company's stock price had
been trading below the $1 minimum requirement for continued listing for
some months. A recent investigation into L90's accounting practices
resulted in its restating of several earnings statements; the company also
recently restructured its management team.

(Los Gatos, Calif.) Netflix, a provider of online DVD rentals, announced
on Thursday that it has opened ten regional distribution centers across
the U.S., aiming to bring faster delivery times to 90 percent of the
country. The centers are located in Atlanta, Boston, Denver, Detroit,
Houston, Los Angeles, Minneapolis, New York, Seattle and Washington, DC.
Los Gatos, Calif.-based Netflix, whose recent IPO raised $95 million,
claims 600,000 subscribers for its service.

(Washington) The Future of Music Coalition, a non-profit group
representing the interests of artists in recording industry matters, has
released the results of a study it commissioned on consumer satisfaction
with commercial radio. The survey was conducted in partnership with Media
Access Project and the Rockefeller Foundation. Among the results found
were that radio consolidation is not popular among consumers, with eight
of ten favoring congressional action to protect or expand the number of
independently owned local stations.

(Calgary, Alberta) Canadian cable TV operator Shaw Cable announced on
Thursday the launch of video-on-demand services for its customers in
Calgary, Alberta. Content available on the service will initially be
provided through an agreement with Hallmark Interactive, with more diverse
film, TV and other properties to be added in the coming months. Shaw also
expects to roll out video-on-demand services for all of its subscribers in
the next six to eight months.

(New York) Nielsen/NetRatings, a provider of Internet audience measurement
services, announced on Thursday that it will change the manner in which it
reports the amount of content available in the three leading digital media
formats -- Microsoft's Windows Media, RealNetworks' RealMedia and Apple's
QuickTime. The new methodology shows RealNetworks and Microsoft nearly
equal in terms of the percentage of homes they reach, with QuickTime in
last place but placing considerably higher than under the previous
measurement methods.

(Glendale, Calif.) Korean game developer Phantagram Interactive announced
on Thursday that it will publish a massively multiplayer online game based
on the film, "Crouching Tiger, Hidden Dragon" in the fourth quarter of
2002. The company said it is currently developing a website dedicated to
the game, which will "focus on fast-paced, Kung-Fu-style fighting with a
deep storyline."

(San Francisco) Wired News reported on Thursday on the limited effect that
the recording industry's victory over file-sharing service Audiogalaxy
will have on its other court battles against the likes of Kazaa and
Morpheus. Unlike these, Audiogalaxy ran a type of centralized server, like
Napster, which the company is now using to filter in only content approved
for trading by copyright holders. "The RIAA just got Audiogalaxy to become
Centerspan. It's system stays empty until the music industry puts
something in it," the Electronic Frontier Foundation's Fred von Lohmann
told Wired News. Recording Industry Association of America (RIAA)
president Cary Sherman noted the legal differences between Audiogalaxy and
de-centralized systems like Kazaa and Morpheus: "the case against Kazaa
remains important to establish the law with regards to different forms of
(peer-to-peer) systems."
