o Proposed Bill Would Let Hollywood Hack File-Sharing Networks

Washington -- U.S. Rep. Howard Berman (D-Ca.) announced that he plans to
introduce legislation that would protect Hollywood copyright holders in
their efforts to use "technological self-help measures" against
peer-to-peer file-sharing services. Berman, whose constituency includes
the Southern California region where many studios and record labels are
situated, said that these copyright holders should be able to employ
tactics such as "interdiction, decoys, redirection, file-blocking, and
spoofs" as a means of deterring U.S. citizens from using online services
that fail to compensate copyright holders. For instance, labels would be
able to flood services with decoy files that were labeled "Eminem," but
contained only static. Some of the tactics mentioned may currently be
considered illegal under anti-hacking laws, Berman said. "I believe
Congress should free copyright creators to develop and deploy
technological tools to address P2P piracy. We could do this by providing
copyright owners with a safe harbor from liability for using such tools,"
said Berman, in a statement. The proposed legislation would be narrowly
crafted, Berman said, to prevent copyright holders from abusing or harming
users' PCs, and would have effective remedies for those who believed they
were targeted in error by copyright holders.

o Napster Granted $5.1M Bertelsmann Loan, But Delay Threatens Sale Process

Wilmington, Del. -- Napster has won approval from the judge overseeing its
Chapter 11 bankruptcy proceedings in Delaware court for a $5.1 million
debtor-in-possession loan from Bertelsmann, the German firm that has
offered to acquire the company's assets, according to Dow Jones and
Associated Press reports. Chief Judge Peter J. Walsh of the U.S.
Bankruptcy Court in Wilmington did not, however, approve all of the
procedures of the proposed Bertelsmann acquisition. Under its deal with
Bertelsmann, Napster must receive court approval for the acquisition to go
through by the end of July; several record labels and the office of the
U.S. Trustee have objected to this time frame, requested and were granted
more time from the judge to look into the deal further. Bertelsmann said
it could not accept the delay, and Napster was granted a recess to
negotiate further with Bertelsmann.

o U.S. House Votes 413-8 For New Ban On "Morphed" Child Porn

Washington -- The U.S. House of Representatives has voted 413-8 in favor
of a bill that would prohibit digital images that had been manipulated to
appear to depict child pornography. The vote comes shortly after a Supreme
Court decision that struck down a similar ban that had passed muster in
Congress. The new bill's language was changed to try to overcome the
Supreme Court's objection to the previous legislation. While the previous
ban was on any image that "appears to be" a minor, the new bill would ban
images "virtually indistinguishable from that of a minor engaging in
sexually explicit conduct." The Bush administration praised the House for
its action and encouraged the Senate to move forward with similar
legislation that has been introduced there. Opponents were skeptical of
whether or not the new bill would pass a test in the courts. "I don't
understand why they think this statute is going to eradicate any of the
problems that the Supreme Court explicitly delineated in its recent
decision," the Electronic Privacy Information Center's Megan Gray told
CNET News.com.

o Yahoo Discontinuing Yahoo Radio, FinanceVision Sections

Sunnyvale, Calif. -- Yahoo said on Wednesday that it will discontinue its
Yahoo Radio section, which provided streaming audio versions of
terrestrial radio stations' signals, instead focusing on its digital music
initiative with recently acquired Launch Media. The company will also
scrap FinanceVision, a video webcasting section that offered financial
news. Reuters reported that Yahoo said no more than 30 employees would be
affected through layoffs or reassignments. Yahoo began its foray into the
webcasting business in 1999 with its reported $5 billion purchase of
Broadcast.com from now-Dallas Mavericks owner Mark Cuban.

o Philips Asks U.S. to Ban Import of Unlicensed Recordable CDs

Washington -- Consumer electronics firm U.S. Philips Electronics announced
on Wednesday that it has filed a complaint with the U.S. International
Trade Commission (ITC), alleging that 19 foreign manufacturers and U.S.
trading companies are infringing on its patents for recordable CDs.
Several Taiwanese companies, including Mediatek and Gigastore, are named
in the complaint, which seeks to have the U.S. ban import and sale of the
unlicensed discs. "Philips asked the ITC to issue an order excluding
importation of all unlicensed discs into the United States so that the
more than 70 manufacturers currently licensed by Philips to make CD-Rs and
CD-RWs are not at a competitive disadvantage to the infringing imports,"
the company said in a statement.

o Virtual Ad Developer Princeton Video Image Gets $5 Million

New York -- Princeton Video Image, a provider of virtual advertisements
and programming enhancements for broadcasters, announced on Wednesday that
it has received an additional $5 million investment in the form of
convertible debt from cable TV operator Cablevision. New York-based
Princeton Video Image provides broadcasters with technology that inserts
virtual ads into broadcasts of sporting events and other programs. The
company's technology is used to create the "virtual 1st down line" in NFL
football telecasts and to insert ads behind home plate in some Major
League Baseball telecasts. Princeton Video Image will use the funds to
continue its transition from a technology firm to a full-service media
company.

o Games Firm 3DO Sees Near-Term Profit, Receives Nasdaq Delisting Notice

Redwood City, Calif. -- The 3DO Company, a developer of video games,
announced on Wednesday that it will return to profitability at the end of
the quarter, and expects to beat street estimates for net revenue, net
income and earnings per share. The company also expects within days to
announce a planned credit facility of up to $15 million. Separately, 3DO
said that it has received notice from the Nasdaq that its shares are not
in compliance with the exchange's $1 minimum requirement, and may be
de-listed from the exchange. The company plans to appeal the decision, and
may effect a reverse stock split to boost its share price in order to
maintain its listing on the Nasdaq. Redwood City, Calif.-based 3DO has
developed online games and titles for PC, Sony PlayStation 2, and
Nintendo's GameCube and Game Boy Advance.

o Content Delivery Network Speedera In Legal Spat With Rival Akamai

Santa Clara, Calif. -- Speedera Networks, a provider of content delivery
network services that speed data across the Internet, announced on
Wednesday that it has filed suit against rival Akamai Technologies,
alleging the company engaged in unfair competition, false advertising,
trade libel and intentional interference with prospective business
advantage. The suit seeks unspecified damages, as well as an injunction
against Akamai for making false statements about the company. "Over the
past several months we have received numerous reports from customers,
prospects and others that Akamai was making false statements about our
financial condition and the performance of our services in an apparent
attempt to influence our investors and our customers," said Speedera CEO
Ajit Gupta. Cambridge, Mass.-based Akamai has also filed suit against
Speedera, claiming the company stole prospects from Akamai from a
protected database operated by Keynote Systems, which monitors website
performance. Separately, Santa Clara, Calif.-based Speedera announced
Wednesday that the U.S. Patent Office has granted the company a patent
covering the core global traffic management and content delivery
technologies used in its network.

(Seattle) Media delivery technology firm RealNetworks said on Wednesday
that it plans to release a plug-in software application for its RealOne
media player that will allow consumers to transfer music from their PCs to
Sony consumer electronics devices. The release comes as part of a recent
multi-year deal between the companies to integrate RealNetworks technology
with Sony consumer electronics. Beginning July 8, consumers can download
the plug-in, which will convert songs from MP3 or RealAudio format into
Sony's proprietary ATRAC3 format before transferring them to a Sony Net MD
Walkman, Network Walkman or VAIO personal computer.

(Santa Clara, Calif.) TVN Entertainment, a provider of video-on-demand
technology, announced on Wednesday that it has partnered with chipmaker
Intel to bring entertainment on-demand to PC users with a cable modem
broadband connection. The companies have entered into a licensing and
co-development agreement, where Intel's Content Distribution Technology

technology on selected DVD titles. Warner recently made news when it
released some copies of the DVD version of its "Harry Potter and the

the DVD to videotape. "Warner is sending a clear message that it values
copy protection and is using Macrovision's analog technology to help
